Chief Justice may not be reinstated – Fmr Council of State member

Former Council of State member, Sam Okudzeto, has raised concerns about the chances of Chief Justice Gertrude Torkornoo being reinstated by President John Mahama once the ongoing inquiry into several petitions against her is concluded.

In an interview with Accra-based TV3, Mr. Okudzeto admitted that the President acted in accordance with the Constitution by suspending the Chief Justice and initiating a committee to look into the allegations. However, he was doubtful that the outcome of the investigation—regardless of its findings—would result in her return.

“The President has the power to reinstate that person [the Chief Justice],” he stated. “But of course, I don’t see it happening in this case.”

Justice Torkornoo’s suspension was announced on April 23, 2025, following recommendations from the Council of State and in line with Article 146(6) of the 1992 Constitution, which requires a probe once a prima facie case is determined against a judge of the superior court.

Although he acknowledged the legal process was being followed, Mr. Okudzeto suggested that the timing and volume of petitions—especially given that a similar complaint was previously dismissed during President Akufo-Addo’s administration—could indicate political motivations.
