    FIFA has suffered a damaging blow after a court ruled that the Swiss-based body’s imposition of CAS is illegal, opening the possibility of several legal challenges against the football governing body in ordinary law courts.

    Several football cases ruled by CAS can now be challenged in ordinary law courts putting the game in utter chaos.

    Several banned officials like Sepp Blatter, Michel Platini, Jerome Valcke and several others who feel unfairly treated by CAS will now heard to court to try to overturn long term bans.

    The Brussels Court of Appeals ruled that the statues of FIFA, UEFA, CAF and GFA imposing CAS as the final place for ruling on football matters is illegal.

    The Belgian court ruled on a dispute between the Belgian club RFC Seraing on one side and FIFA and UEFA on the other.

    The judge said FIFA cannot impose on Belgian club RFC Seraing any proceedings before the Court of Arbitration for Sport (CAS).

    The Brussels Court of Appeal said in a judgment published on Friday, August 31.

    For the Belgian courts, the clauses of the statutes of FIFA, the European Union football (UEFA), CAF and national football federations imposing the use of the CAS are illegal.

    This judgment is part of a dispute between the RFC Seraing and the investment fund Doyen Sports against FIFA, UEFA, the Belgian Football Union and FIFPro, the global union of football players .

    The club had been sanctioned by FIFA for a contract called “third-party property” (cession of a portion of economic rights on a player), concluded with Doyen Sports, a practice banned since January 2015 by FIFA.

    RFC Seraing and Doyen Sports had questioned the legality of a court of arbitration like the CAS which partly funded by FIFA.

    The court, which is headquartered in Lausanne, confirmed in March 2017 the sanction of recruitment ban for four seasons imposed by FIFA on 4 September 2015 on RFC Seraing.

    “FIFA and UEFA may be summoned before any state judge”

    The Brussels Court of Appeal had ruled that the legality of CAS should be examined in relation to European law and the European Convention on Human Rights, and the ” general prohibition on ordinary courts ” issued by FIFA in disputes between a club and FIFA or UEFA.

    In its judgment, the Court of Appeal considers that arbitration can only exist if there is a real consent of the parties.

    Arbitration can not, therefore, relate generally to all disputes that may arise between the federations and a club or a player.

    “Clearly, not only FIFA and UEFA can no longer hide behind the CAS, but they can be assigned to any state judge,” said RFC lawyers Seraing, adding: “In view of this judgment and for the future, it is illusory for the international federations to try to impose on everyone and for all an arbitration before the CAS. Moreover, regarding the past, it is highly likely that the validity of many awards rendered by the CAS may be called into question, because of the illegality of the clauses which imposed the jurisdiction of the CAS. “

    On the merits of the case, the RFC Seraing and Doyen Sports request the lifting of the transfer ban imposed by FIFA.

    The debate will continue on 4 October.

    Power transmitter, Ghana Grid Company (GRIDCo) is struggling to operate due to the failure of as many as 39 companies to pay for services provided. The Electricity Company of Ghana (ECG) is one of the major debtors with an outstanding amount of GHS 694 million.

    GRIDCo says the debt situation has caused a reduction in energy transmitted and triggered inadequate capital needed to facilitate smooth operations.

    Joy News has sighted a copy of GRIDCo’s statement of account dated August 17, 2018, and shows the main debtors captured in the report are the Volta Aluminium Company Limited (VALCO) and the Electricity Company of Ghana (ECG).

    While ECG was required to make payments of GHS957 million as of August 17, 2018, VALCO was to settle an amount of GHS29 million.

    The two succeeded in making part payments leaving VALCO with an outstanding commitment of GHS2.5 million while that of ECG stood at GHS253million. The two are named in another document titled Issues Affecting GRIDCo’s Financial performance.

    Parts of the documents read “current capital ratio for 2014, 16 and 17 are 1.85, 1.00 and 0.98. The declining current ratio confirms the high receivables held by ECG and VALCO and weak liquidity support.”

    This document states that the standard capital ratio to be 2:1 but that of GRIDCO currently stands at 0.96.

    Other companies indebted to GRIDCo include Northern Electricity Distribution Company (NEDCO), Volta River Authority (VRA), Great Consolidated Mines, Asogli Thermal Station, Ameri Power Plant, Bui Hydro Power, Karpowership among others.

    The story written by one Gibril Abdul Razak alleges that the Auditor General, Daniel Domelevo did not go through the right tender process in the said purchases.

    On 8 June 2018, the chairperson of the adjudicatory chamber of the Ethics Committee provisionally banned the President of the Ghana Football Association, Kwesi Nyantakyi, for a duration of 90 days.

    Today, the chairperson has decided to extend this provisional suspension for an additional period of 45 days. During this time, Mr Nyantakyi will continue to be banned from all football-related activities at both national and international level.

    The extension of the ban will commence on 6 September 2018.

    The Senior minister has said local automobile company, Kantanka will benefit from the same government incentives to be given to the Volkswagen.

    Yaw Osafo-Marfo said government is keen on protecting the local manufacturing industries so it won’t allow the local market to be used as a dumping ground.

    He made the revelation in an interview with Joy Business on the sidelines of the 2018 Ghana Economic Forum in Accra, Tuesday.

    The German car company and government last week signed a memorandum of understanding (MoU) to establish a car assembling plant by the first quarter of next 2019.

    As part of the MoU, there will be a preferential procurement policy for locally assembled vehicles.

    “We as a government are encouraging local industrial growth in all sectors of the economy there whatever incentives we give to foreign investors will be given to their local counterparts.

    “For instance, whatever government is giving to VW to establish an assembly plant in Ghana will be giving to Kantanka in Ghana,” Mr Osafo-Marfo said.

    He said one of the Akufo-Addo’s government’s key promises was to provide jobs for the teaming unemployed Ghanaian populace.

    Government has embarked on many initiatives to ensure that the growth in the economy is sustained.

    He said, “we’ve got to protect the industrial base such that we take steps to stop Ghana being used as a dumping ground for substandard produce”.

    This year’s forum is under the theme: Building a competitive economy for sustainable growth.

    The Ministry of Education (MoE) and the Ghana Education Service (GES) have created centres across the country where parents and guardians of students entering into Senior High Schools (SHSs) can go for assistance in relation to their placement into SHSs.

    Dr Yaw Osei Adutwum, Deputy Minister of Education, said the ministry thought it necessary to create these centres to prevent overcrowding at the offices of the MoE and the GES nationwide, as some students and their guardians may encounter challenges with their placement.

    Speaking on State of Affairs on GHOne TV on Tuesday, 4 September, Dr Adutwum said: “Solution Centres have been created in all the regions where parents and guardians can go for assistance.”

    He added: “For instance, in Accra, parents can go to the Independence Square where one of the centres has been created for support.”

    The Computerised Schools Selection and Placement System (CSSPS) has asked some 67,382 Basic Education Certificate Examination (BECE) students who were not placed into any senior high schools and technical institutes (TIs) of their choice to do a self-placement to get themselves into schools with vacancies.

    Out of the 521, 710 registered candidates, 490, 514 candidates qualified to be placed. 423, 134 were automatically placed while the remaining 67, 382 candidates could not be matched with any of their choices.

    The students have been advised to select schools of their choice through the following process:

    Dial *713*24# to buy a placement pin code of GHS5.00;

    After obtaining a pin code log onto the site www.cssps.gov.gh;

    Enter the pin code details (serial number and pin);

    Click and submit and wait for placement to show up;

    Print the form if you have been placed and send to school to begin admission;

  • Labour Ministry intervenes in layoffs at Consolidated Bank

    The Employment and Labour Relations Minister, Ignatius Baffour Awuah has stated that he will by the end of the week meet with stakeholders and workers of the Consolidated Bank alongside some labour unions to address their concerns.

    Among other things, the meeting would seek to deliberate on labour plans for the consolidated bank and what would be factored in case labour restructuring was necessary.

    Some reports suggest that the consolidated bank will lay off 1,700 workers out of the 3,700 staff that it assumed from the five banks in order to cut down on cost in managing 191 branches of the bank.

    However, about seven hundred workers of defunct Beige bank have been asked to go home by the end of this week.

    In an interview with Citi Business News, Ignatius Baffour Awuah said it is critical he meets with the stakeholders in order to in order to address the concerns of all those involved.

    “Before the end of the week, I am going to meet stakeholders including some of the workers of the Consolidated Bank and the Bank of Ghana as well as the various labour unions,”he stated.

    He explained that although the law permits for employers to undertake redundancy exercises, due process needed to be followed.

    The 10 aged between 18 and 20 usually stationed themselves along the road leading to the southern gate of the Ho Technical University and around the Dave campus of the University of Health and Allied Sciences to rob students, mostly ladies of their mobile phones, laptops and other valuables after 9pm.

    Confirming the arrest to the media, the Volta Regional Police Commander, DCOP George Tuffuor, indicated all suspects have admitted to committing various crimes reported and under investigation.

    One of the suspects, Isaac Okai, confirmed he shot a man who blew his cover in the leg in Dave in June, 2018, while Agbesi Okai who wears dreadlocks admitted to robbing students around the Ho Technical University and surrendered two mobile phones of victims he robbed on 27th and 28th of August, DCOP Tuffuor revealed.

    Meanwhile, there would be an identification parade at the Volta Regional Police Headquarters this morning before the suspects would be arraigned before court.

    The number of people killed has risen to 157, as against the 149 killed in July 2017, representing a 5.3% increase.

    This brings the number of commuters killed between January and July 2018 to 1,369.

    This means the figure went up by 13.33%, from 1,208 killed in the first seven months of last year.

    The July fatalities comprised 124 males and 33 females.

    The number of commuters injured in July 2018 witnessed a 6.6% rise, from 872 in 2017 to 930 in 2018.

    The number of persons injured in road crashes between January and July this year registered 11.05% jump from 6,869 recorded in the first seven months of 2017 to 7,628 in the same period in 2018.

    Data compiled by the Motor Traffic and Transport Department (MTTD) of the Ghana Police Service and verified by the National Road Safety Commission (NSRC) shows that the number of pedestrians knocked down went down by 5.24% from 1,948 last year to 1,846 this year.

    The total number of motor vehicles involved in accidents witnessed 14.31% increase between January and July 2017 from 11,032 to 12,611 in the 7-month period under consideration.

    The number of commercial vehicles involved rose from 4,462 between January and July last year to 4,909 within the same period this year, representing 10.02% spike.

    18.76% spike in private vehicles involved in accidents

    Similarly, the number of private vehicles also increased from 4,633 in the first seven months of 2017 to 5,502 during the same period in 2018. This represents an 18.76% increase.

    The data shows that the number of motorcycles involved in accidents also rose from 1,937 during the period last year to 2,200 in 2018.

    A high-powered FIFA delegation is expected in the country this week to finalise the composition of a Normalisation Committee to steer the affairs of Ghana Football.

    A highly-placed source has revealed this to Graphic Sports Online.

    The source said the FIFA team are scheduled to do due diligence on all the nominees proposed by government to form the Normalisation Committee before arriving at a firm conclusion.

    Though Graphic Sports Online investigations revealed that a list of names has already been forwarded to FIFA by the Ministry of Youth and Sports, the persons involved can only be endorsed after they have been thoroughly screened.

    The source said the FIFA team would, therefore, embark on a one-on-one encounter with each of the nominees and also do a background check on them before deciding on their fate.

    However, the source assured that the selected personalities were men of integrity who have the interest of both Ghana Football and the nation at heart.

    It said the government was determined not to let Ghanaians down after coming thus far in its bid to chart a new course for Ghana Football to the satisfaction of all.

    All things being equal, the Normalisation Committee will officially be named by FIFA by the close of the week after the screening.
    The source, however, declined to drop any name till the process is over.

    Thousands of jobless youths in Ghana have stormed the principal streets of Accra to protest the escalating job deficits in the country.

    The demonstration was organised by the Economic Fighters League, a group of unemployed youths to coerce the NPP government to fulfil its promise of job creation during the 2016 electioneering campaign.

    Another jobless graduate said, “government has said they had created over 10 million jobs but where are the jobs…we want the government to come to our aid because we are suffering.”
