  • Mahama’s removal of CHRAJ boss same as Akufo-Addo removal of EC boss- Hamid

Government has fought off opposition claims it masterminded the removal of EC boss Charlotte Osei and her two deputies insisting the President only acted according to the constitution.

Information minister Mustapha Abdul-Hamid said President Akufo-Addo only acted the same way President John Mahama acted in 2015 when he removed Chairperson of the Commission on Human Rights and Administrative Justice (CHRAJ) Mrs Lauretta Lamptey for abusing her office.

“Like now, President John Mahama, at the time, had no option but to act first on the petition, and lastly on the recommendation of the Committee”, he said at a press conference Friday.

“Remember that the President took an oath to abide by the dictates of the Constitution of Ghana, failing which he pledged to subject himself to penalties arising there from”.

Ghana’s first female chairperson of the Electoral Commission was removed on six counts of “misbehavior and incompetence” bringing her three-year-old leadership to an abrupt end.

Her own staff triggered the process of her removal in a petition to the President in July 2017 which was passed on to the Chief Justice to determine the merits of the allegations.

An investigative committee she set up has determined, the EC boss unilaterally cancelled and awarded contracts. Head of Procurement unit testified against the EC boss while she also testified against her deputies, Georgina Amankwah and Amadu Sulley.

But an enraged NDC has accused the NPP government of trying to destroy the Electoral Commission using trumped-up charges.

But the Information minister has maintained any individual who claims the removal is politically motivated does not have the interest of the nation at heart.

He maintains the removal was in strict accordance with the laws of Ghana following a petition by some staff of the EC.

“It would be tragic for the country, in the face of these facts and circumstances, for anyone to attempt to turn this matter into a party-political affair. Those who do so do not seek the welfare of the country” he said.

  • Morocco complain to FIFA over referee ‘injustice’

The Moroccan Football Federation on Thursday complained to world soccer’s governing body FIFA over what it said were a series of refereeing mistakes in their World Cup Group B matches against Portugal and Spain which led to their elimination.

The federation said the “serious referee errors” led to their early exit and that the video assistant referee (VAR) had been used or not used in order to serve the interests of their opponents.

“We want to express our indignation at the injustice suffered by our national team, following serious refereeing errors that led to (the team’s) premature exit from the first round of the 2018 World Cup,” federation president Fouzi Lekjaa said in a letter to FIFA President Gianni Infantino.

“The severity of these refereeing errors is all the more evident in the fact that in these two matches (against Portugal and against Spain), the use of VAR served only to preserve the interests of our competitors,” it said.

Lekjaa went on to list what he said were three incidents from their 1-0 defeat by Portugal, including Cristiano Ronaldo’s fourth-minute winner, which he said should never have counted as a Portugal player had committed a foul.

He also said five decisions from the 2-2 draw against Spain, with his team already eliminated, including the Spanish last-gasp equaliser, had gone against Morocco.

The African side, who also lost their group opener to Iran, had been fuming following their loss to the Portuguese, their second group game, that had killed off their chances of advancing.

“With what has happened we can only express our serious concern at the persistence of these injustices and the negative impact on the image of FIFA and the future of football,” he said.

Lekjaa urged Infantino to “take the necessary measures and make the necessary adjustments in order to repair these injustices and guarantee the conditions of a competition with equal opportunities for all teams”.

  • AFAG support calls for prosecution of sacked EC Chair, 2 deputies

Alliance for Accountable Governance (AFAG) has backed calls for the prosecution of fired Electoral Commission (EC) Chair and her two deputies as recommended by a court’s committee that investigated them.

The group wants government to “make public the full report of the Chief Justice’s investigation as a matter of transparency, to give confidence in the wisdom of the President’s decision to fire, and above all to establish the basis of the sack.”

AFAG in a release Friday added “although the electoral commissioner’s posturing before, during and immediately after the elections were questionable, we consider the events leading to this investigation as God-given.

According to the Commission, the accusation and counter-accusations among the commissioners showed that all wasn’t well with the commission regarding teamwork, decision making and financial management.

The Alliance, therefore, called for the prosecution of the EC Chair and two deputies if the allegations and counter allegations of corruption among them were established by the CJ’s committee.

It commended the boldness to which the staff of the Commission staff defied all odds and stood up against incompetent management at the helm of affairs.

    Below is the statement

    PROSECUTE FIRED EC AND DEPUTIES

AFAG welcomes and congratulates the President for the bold decision of sacking Mrs Charlotte Osei and her two deputy commissioners implicated in the Chief Justice’s investigation. This move has been our long-standing call as a result of our position against corrupt public office holders.

Although the electoral commissioner’s posturing before, during and immediately after the elections were questionable, we consider the events leading to this investigation as God-given. This notwithstanding, we commend the boldness to which the EC staff defied all odds and stood up against incompetent management at the electoral commission.

Indeed, the accusation and counter-accusations among the commissioners showed that all wasn’t well with the commission regarding teamwork, decision making and financial management.

It is in this regard that AFAG welcomes the recommendation of the court’s committee and the decision to sack by the president. The rule of law has been upheld without considerations to who is before the judge.

    This notwithstanding, AFAG demands from the government;

    1. To make public the full report of the Chief Justice’s investigation as a matter of transparency, to give confidence in the wisdom of the President’s decision to fire, and above all to establish the basis of the sack.

    2. Prosecute the EC Chair and the deputies if the allegations and counter allegations of corruption among them were established by the CJ’s committee.

If Indeed there is a basis to sack based on financial irregularities as we were made to know by the deputy EC commissioners, then we will want the courts to justify or otherwise make a declaration in this regard.

Simply put we want all persons implicated in any act of corruption to face the law. This will serve as a deterrent to other public office holders. AFAG has taken the position that if “corrupt” public officials are merely fired for corruption, it serves no purpose to jail petty thieves.

  • NDC to stage demo over Charlotte Osei removal

The National Democratic Congress (NDC), has said it plans to demonstrate against the removal of the Electoral Commission (EC) Chairperson, Charlotte Osei.

Though it is unlikely the party has given the police a formal notice in line with the Public Order Act, it has announced that its supporters will converge on the Obra Spot, near the Kwame Nkrumah interchange this [Friday] morning.

“[Today] the anger of the people will be shown on the streets,” the NDC National Organiser, Kofi Adams, told the press Thursday night.

“We must all rise and speak [and say] that enough is enough. They have done enough destruction. We will not allow them to continue with this destruction,” Kofi Adams said.

He described the shake-up at the EC the latest “bastardization” of institutions by the government.

“That destruction must not be extended to the Electoral Commission. This is an institution that we will religiously guard and protect,” he stressed.

The removal of Charlotte Osei and her two deputies, Amadu Sulley and Georgina Opoku Amankwah from office followed a recommendation from a Committee set up by the Chief Justice.

The Chief Justice set up the committee to probe multiple complaints against the EC officials.

Allegations of fraud and malfeasance were brought against them, following which the Chief Justice established a prima facie case against them.

The committee cited misbehaviour and incompetence as reasons for the dismissal, pursuant to Article 146(4) of the Constitution.

The Committee concluded that Charlotte Osei blatantly breached procurement laws in the award of several contracts in her three-year period at the helm of affairs, prior to the 2016 elections.

Excerpts of the report released by government and made available to Citi News, says the committee investigated six separate allegations of various procurement breaches, for which a prima facie case was established against Madam Charlotte Osei.

A statement by a Minister for Information, Mustapha Abdul-Hamid on Thursday, said the President had directed the three persons to hand over their respective schedules to the Director of Human Resources at the Commission while thanking them for their service to the country.

Ahead of the insinuations from the NDC, the government stressed that the shake-up at the EC was not politically motivated.

The Director of Communications at the presidency, Eugene Arhin acted strictly according to the recommendations of the committee set up by the Chief Justice.

“Those critics will be completely off the mark. When this matter first broke our, we heard the two deputies were virtually against the chairperson herself. You heard the allegations they made. These persons who petitioned the president against Charlotte Osei were persons who worked at the Commission.”

    Background

Back in December 2017, the EC Chairperson, Charlotte Osei and her two Deputies, Amadu Sulley (in charge of Operations) and Georgina Amankwa (in charge of Corporate Services) met with the Chief Justice over a petition filed against EC.

A five-member committee was subsequently set up by the Chief Justice to investigate the alleged corruption.

Some staff of the EC petitioned President Nana Akufo-Addo in July 2017, to remove Mrs. Osei from office over allegations of fraud and financial malfeasance as well as abuse of office.

Some of the allegations involved the unilateral award of contracts by the EC boss in the run-up to the 2016 general election.

The petition against her alleged among others the funnelling of GHc3.9 million to partition an office, the receipt of a Toyota Land Cruiser from the Mahama government and the use of about $14 million when the Public Procurement Authority had authorized her to use only $7.5 million.

Mrs. Osei also responded by making allegations of corruption against her deputies.

She claimed she was only being hounded because she sought to introduce systems to curb mismanagement.

Charlotte Osei accused a deputy Chairperson of the Commission of illegally signing contracts worth over GHc 40 million without her approval.

Another individual, by name Douglas Seidu, also petitioned the President in August 2017 seeking the removal of the EC Chair, on grounds of “financial misconduct, incompetence, conflict of interest and breaches of the public procurement processes.

President Akufo-Addo in accordance with the constitution forwarded both petitions to the Chief Justice to look into the matter, which culminated in their removals.

  • NDC reacts to dismissal of Charlotte Osei and two deputies

The opposition National Democratic Congress (NDC) says it is shocked and sad that President Nana Addo Dankwa Akufo-Addo has decided to terminate the appointment of the chairperson of the Electoral Commisison, Mrs Charlotte Osei and her two deputies, Amadu Sulley and Georgina Opoku Amankwaa.

At a press conference at the NDC headquarters at Adabraka in Accra Thursday night, Mr Kofi Adams, the national organizer said: “We are here this evening and many will be wondering why we will not wait till tomorrow before speaking to you [the press] and lovers of democracy, and we tell you, this is a matter that you cannot sleep over.”

“This is a matter that we need to let everybody know, people who love Ghana, and those who care about the progress of this country, people who care about the democracy we have all sacrificed and worked for.”

“We learned with shock, and of course, sadness the decision of President Akufo-Addo to terminate or dismiss the chairperson of the Electoral Commission and the two deputies this evening.”

“As we speak today, many of us lovers of democracy do not know even these petitioners. We were told by the President that he was just a conveyor belt of petitions, and so any petition that comes before him, he will forward it but I will prove to you that, that is not the case. We are very much aware that there are other petitions, more than three months old petitions before His Excellency, against the Chief Justice of this country that has not also been forwarded like he did, if he claim he is a conveyor belt.”

Mr Adams announced that the NDC together with other political parties will be meeting Friday to give more details on what they would be doing on the matter.

    Demand

“We demand almost immediately that they must give us reasons for which they think that the chairperson of the Electoral Commission and the two deputies stand indicted and should be removed from office.

“It is very clear that this government that has so far failed…, lost the fight against corruption…, the attempt and the fear for which reason they have set out to remove an arbiter of our elections and the two deputies so as to allow them to continue their rigging machinery, Ghanaians will not allow that to happen, we will resist any attempt,” Mr Adams told the journalists at the party headquarters.

Mr. Adams also accused President Akufo-Addo’s administration of embarking on needless transfer of workers at some state institutions including the Electoral Commission, which he said the NDC will employ legal means to resist.

“What they have done is to destroy our institutions, what we have built over the years but we will not allow them to extend their destruction to institutions like the Electoral Commission. This is an institution that we will religiously guide and protect,” he said.

Street protest against Charlotte Osei’s removal Friday morning

Mr. Adams announced that, the NDC and followers from some opposition parties will hit the streets in Accra on Friday morning, “tomorrow [Friday], the anger of the people will be shown on the street.

“We will meet at Obra Spot to continue…and there, we will say other things that we have to say,” he added.

Dr Charles Wereko Brobbey who uses the name Eyetarzan Anokyenana on Facebook also posted the following.

Removal of EC Boss and her deputies self-inflicted Gabby Otchere Darko

Commenting on the removal of Mrs Osei from office together with her two deputies, Mr Gabby Asare Otchere-Darko said the development was self-inflicted.

In a Facebook post, the founder of policy think tank Danquah Institute said: “Let it be stressed that the events that led to the removal of the EC chairperson and her two deputies had nothing, absolutely nothing to do with the government, political parties or even civil society groups.

“It started (we must all recall because it was all in the media) with infighting at the very top of the Commission shortly after the Dec 2016 elections. All gloves were off. The EC Chairperson and her two deputies began throwing mud at each other – publicly! They accused each other of corruption and abuse of power. They were soon joined by staff members of the EC.

“It is what they said about each other, the evidence they provided against each other, and the decision by their respective supporters to compile all the pieces of evidence into separate petitions which their own loyalists filed that triggered the constitutional process which eventually led to their removal, after full hearings. The President had a simple perfunctory but important role to play and that role was strictly provided by the Constitution.

“First, he had no choice but to pass on the petitions to the Chief Justice once received. Secondly, he had no option, per the Constitution, but to act according to the recommendations of the Committee of Inquiry once received. This is the truth and the whole truth according to the facts and the law.”

However, the leadership of the opposition party says the accusations against Charlotte Osei are trumped up claiming that the decision remove her as well as her two deputies, is part of a well thought out plan by the governing New Patriotic Party (NPP) to rig the 2020 elections.

“We demand almost immediately that they must give us reasons for which they think that the chairperson and her two deputies should be removed from office. The attempt and the fear for which reason they have set out to remove an arbiter of our elections so that they can rig the 2020 elections,” Kofi Adams told the journalists.

Mr. Adams also accused the Nana Akufo-Addo administration of embarking on needless transfer of workers at some state institutions including the Electoral Commission, which he said the NDC will employ legal means to resist.

“What they have done is to destroy our institutions but we will not allow them to extend their destruction to institutions to the electoral commission. This is an institution that we will religiously guide and protect,” he rallied the supporters who gathered at the event.

Mr. Adams announced that, the NDC and followers some opposition parties will hit the streets in Accra on Friday, “to show their anger” to the government over the removal of the three top EC officials. “Will meet at Obra Spot to continue…and there we will say other things that we have to say,” he said.

  • Removal of EC boss: Akufo-Addo had no choice Anyenini

President Nana Addo Dankwa Akufo-Addo was bound by recommendations by the five member committee set up by the Chief Justice, Justice Sophia Akuffo to remove Mrs Charlotte Osei from office as Chair of the Electoral Commission (EC) private legal practitioner Samson Lardy Anyenini has said.

Her two deputies: Georgina Opoku Amankwah and Amadu Sulley, were also removed from office by the president with immediate effect on Thursday, 28 June 2018.

A committee set up to investigate separate complaints brought against the three persons by Ghanaian citizens, recommended their removal.

Reacting to this development, Mr Anyenini in a Facebook post explained that Nana Akufo-Addo is bound by the recommendations of the committee.

The post read: “PRESIDENT IS BOUND BY RECOMMENDATIONS – In the Ms. Lamptey case, lawyers for Petitioner and Respondent were directed by the panel to submit written addresses after the hearing which travelled seven months despite the fact that at least two days were dedicated to ensure speedy conclusion, and the chairman insisted on fidelity to those days. We were supplied with certified copies of the record of proceedings for the purposes of the addresses. We each analyzed the evidence and made references to the relevant laws and authorities to make a case for our clients.

“The panel eventually submitted its report to the CJ and she forwarded same to the President. The President then issued the letter communicating the recommendation of her dismissal in November 2015. The report is submitted to the CJ because it is the CJ who sets up the committee. President, like the CJ, is bound by the recommendations and cannot alter anything in the report or act contrary to same. The wisdom in keeping the President in the picture from commencement to completion is to afford him (the appointing authority) the opportunity of knowing what is happening to his/her appointee, and also to perform the ceremony of issuing the letter of dismissal.”

The committee was set up in 2017 after some staff of the EC petitioned Nana Akufo-Addo to remove Mrs Osei from office over allegations of fraud and financial malfeasance as well as abuse of office.

Mrs Osei also counter-alleged corruption against his deputies insisting that she has done nothing wrong and only being hounded out because she is fighting internal graft.

The president, in accordance with the constitution, forwarded the petition to the Chief Justice to look into the matter.

This comes after a committee set up by the Chief Justice, Justice Sophia Akuffo, pursuant to Article 146(4) of the Constitution, to investigate separate complaints brought against the three persons by Ghanaian citizens, recommended their removal from office.

The Committee recommended their removal on the basis of stated misbehavior and incompetence, pursuant to Article 146 (1) of the Constitution.

A statement by a Minister for Information, Mustapha Abdul-Hamid on Thursday said, the President had directed the three persons to hand over their respective schedules to the Director of Human Resources at the Commission, while thanking them for their service to the country.

President Akufo-Addo in accordance with the constitution forwarded both petitions to the Chief Justice to look into the matter.

  • Egypt FA boss: ‘Ramadan affected World Cup’

The Egypt Football Association (EFA) president Hany Abo Rida says that fasting ahead of the World Cup affected the Pharaoh’s campaign in Russia.

The squad chose to fast during the Muslim holy month of Ramadan that ended the day before Egypt’s opening game.

Egypt lost all of its group games to Uruguay, hosts Russia and Saudi Arabia.

“It affected us badly, I talked with them before world cup but they refused (to break their fasting),” Abo Rida said.

“We ended Ramadan one day before Uruguay but the fasting affected them.”

Abo Rida added: “I can assure, many Arabian countries made their players break their fasting.”

He says the EFA has begun its search for a new coach to replace Hector Cuper, who left his role as coach after the failure in Russia.

However he insisted that they have not tried recruit Morocco’s French coach Herve Renard.

“I know he (Renard) is under contract with Morocco, so we will not talk about him, but if he ended his contract or become free sure I would start negotiations with him to lead Pharaohs.” he said.

Egypt are yet to win a game at its three appearances at the World Cup and now switch their attention to qualifying for the 2019 Africa Cup of Nations in Cameroon.

The seven-time African champions, who were runners-up in 2017, began their 2019 campaign with a 1-0 loss to Tunisia.

The Pharaohs next Nations Cup qualifier is against visiting Niger in September.

  • I did not receive payment for Anas to kill case – Egbert Faibille

Egbert Faibille. Jnr has responded to Kennedy Agyapong’s allegation that he received payment in 2009 on behalf of investigative journalist Anas Aremeyaw Anas to kill a case.

Below is his post on Facebook

A few weeks ago, Hon. Ken Agyapong gave an audio recording of Anas interviewing an arrested fraudster sometime in 2009 to one of the radio stations in the Multimedia stable; in respect of a multi million gold scam during which interrogation, Anas was heard mentioning my name in words to the effect that as he was speaking, the scammed company had engaged me as a lawyer and that I was at the bank tracking the 419 money that they obtained as 419ers.

I took the pain to issue a statement here on Facebook on the issue. Last Friday, Hon Ken Agyapong called me on phone and asked that I meet him to watch the video he was going to show today.

I declined on the basis that the video he was going to show is only a pictoral rendition of the part of the video where Anas mentioned my name to show to the scammers that the duped company was tracking who recieved the money.

Indeed, my work as a lawyer led to the prosecution of Hafiz, the lead scammer and his accomplices at an Accra High Court.

I did not receive any payment from the scammers for and on behalf of Anas to kill the case as Hon. Agyapong is dubiously trying to portray and I challenge him and the scammers to provide any proof of any lodgment into my account from them.

The vociferous Member of Parliament (MP) for Assin Central, Mr Kennedy Agyapong, Wednesday night showed his exposé video, dubbed: Who watches the watchman, at the forecourt of Ken City Media at Madina in Accra.

The video, he said was his own version of secret recordings of how the investigative journalist, Anas Aremeyaw Anas, operates undercover.
