  • Woman’s faulty bed sex fall claim rejected at High Court

A woman left paralysed after being “catapulted” from her new bed during sex has lost a seven-figure damages claim.

Claire Busby, 46, suffered spinal injuries when she landed on her head after shifting position and falling from the super king-size double divan.

She said a “defective” product supplied by Berkshire Bed Company, trading as Beds Are Uzzz, was to blame.

Read: Costa Rica Supreme Court rules against same-sex marriage ban

But a High Court judge ruled the case was a “tragic accident”.

Rejecting her case, Judge Barry Cotter found the bed was “not defective”, and the claim had failed.

    ‘Heard a snap’

The court previously heard Ms Busby, of Maidenhead, Berkshire, was having sex with her then partner John Marshall a week after the bed was delivered.

She told the court she had been kneeling before she “swung her legs” out from underneath her, causing the bed to give way.

Read: My life in sex: the 21-year-old saving herself for marriage

“I spun around, I put my hand down and then I felt like I was catapulted off the back,” she said.

“I fell to the side and heard what felt like a spring in my body snap”.

Mr Marshall said he had been badly affected by the accident, which he had initially laughed off.

    ‘Most unfortunate positioning’

Ms Busby claimed the bed had not been properly assembled when it was received in August 2013 – which was denied by lawyers for the company.

The firm had argued the lovers had “simply lost balance and toppled backwards” as a result of being too close to the edge of the mattress.

Read: This simple practice will help you deal with toxic people

In his ruling, Judge Cotter said the “simple accident” was caused by “a most unfortunate and unusual combination of positioning on the bed and movement,” he said.

The judge said Ms Busby had no means of support, other than placing her arm down on the bed, as she attempted to swing her legs around from underneath her in what was “not an easy manoeuvre”.

He added: “Having carefully considered the totality of the evidence I am not satisfied that the difference in level between the two divans played any part in Ms Busby’s loss of balance backwards.

“Rather, I am satisfied that this was a simple but tragic fall; she simply overbalanced probably in part because she was sitting on a mattress as opposed to a firm surface, and underestimated the amount of give underneath her body.”

Richard Manders, director of Berkshire Bed Company, said: “We are delighted the court has ruled in our favour.

“We are sorry that Ms Busby was injured and we wish her and her family well for the future.”

  • Libya election to take place in early 2019: UN envoy

United Nations Special Envoy to Libya Ghassan Salame has said he expects elections to take place in the war-wracked country in the early 2019.

The announcement on Thursday is the first official acknowledgment that elections in Libya will be difficult to hold on December 10, as had been agreed by rival leaders at a Paris summit in May.

Salame said a national conference in early 2019 will set the stage for the vote.

“The National Conference is to be held in the first weeks of 2019. The subsequent electoral process should commence in the spring of 2019,” Salame told the Security Council.

Divisions along regional, tribal and linguistic lines have complicated the north African country’s transition to democracy since the overthrow of longtime leader Muammar Gaddafi seven years ago.

The existence of two rival legislatures – the internationally recognised Government of National Accord in Tripoli and the eastern-based House of Representatives (HOR) each with its own central bank and national oil company – is indicative of the country’s plight as it tries to enact the necessary reforms and, ultimately, hold elections.

Salame accused the two rival chambers of delaying the vote to waste time and advance their own narrow interests at the expense of Libyans.

“To both houses, elections are a threat that must be resisted at all costs, but to the citizens, elections are a means of liberation from the ineffective and increasingly illegitimate authorities,” Salame said.

“According to our latest poll, which I received this morning, 80 percent of Libyans insist on having elections”.

Experts, however, say elections will fail to achieve any progress if armed militias aren’t reined in. Libya is one of the world’s largest oil producers with production estimated at 1.3 barrels per day.

“[…] these figures obfuscate the truth: Libyans have been increasingly impoverished while criminals employ violence and patronage networks to steal billions from the national coffers,” Salame said.

Salame, who is the sixth UN envoy since Gaddafi’s ouster in 2011, said clashes between rival militias in the capital Tripoli in September served to highlight the delicate security climate and worked as an incentive to demobilise and integrate armed groups into the formal security apparatus.

  • John Boyega and Letitia Wright to star in sci-fi romance

John Boyega and Letitia Wright are to star in a sci-fi romance story that is being billed as Romeo and Juliet meets Gravity.

The film is based on author Katie Khan’s novel, Hold Back the Stars.

The book is about a couple who reminisce on their love and life together on Earth with only 90 minutes of oxygen left.

“Hooray! Some absolutely dream casting for my novel,” Khan tweeted earlier today.

“Beside myself with excitement” she continued.

However, this isn’t the first time the British breakout stars have united.

Long before rocking the Met Gala red carpet together (and fuelling many rumours of dating), the pair have actually been good friends for a while, dating back to their days as students of the Identity School of Acting.

Stars Wars actor Boyega told The Grio in March that he and Wright would hang out at McDonald’s after classes and speak about their dreams and visions for the future. Little did they know they’d end up in some of the biggest films of the decade.

“I felt Letitia was the best thing in Black Panther. She was fantastic. Every time she came onto the screen, my heart was uplifted,” he continued.

    Future starring roles

Boyega will reprise his role as Finn in Star Wars Episode IX which is expected to be released in December 2019.

He will also be providing the voice of Bigwig for the new Watership Down miniseries, airing on BBC One this Christmas.

Wright will also reprise her role as Princess Shuri in the Black Panther sequel and the Avengers film coming next April.

Mike Cahill will direct Hold Back the Stars. His most notable work, Another Earth, won two awards at the Sundance Film Festival in 2011.

  • US proposes rule banning asylum for illegal migrants

Illegal migrants entering through the southern US border will no longer be eligible for asylum under a new rule, the Trump administration has said.

Announced by the Departments of Justice and Homeland Security, the ruling would stop asylum for those who breach any presidential restriction on entry.

The president can stop migration in the “national interest”, a statement said.

Immigration was a major focus in President Trump’s 2018 mid-term election campaign.

Read: US sending 5,200 troops to border with Mexico

Frequently attacking a caravan of thousands of Central Americans making their way north through Mexico, Mr Trump ordered troops to the border and declared the migrants to be an “invasion”.

    What is the new rule?

Acting Attorney General Matthew Whitaker and Homeland Security chief Kirstjen Nielsen announced what is known as the Interim Final Rule on Thursday.

The joint statement said presidents have the power to “suspend the entry of all aliens” and to impose “any restrictions he may deem to be appropriate on them” if they are judged to be “detrimental” to US interests under the Immigration and Nationality Act.

Accordingly, if the president issues a suspension or ban on entry through the US/Mexican border, those who illegally manage to enter the US will not be allowed to apply for asylum once there.

“Today, we are using the authority granted to us by Congress to bar aliens who violate a Presidential suspension of entry or other restriction from asylum eligibility,” the statement said.

The rule will not apply retroactively. President Trump is expected to sign it shortly.

Under US law, there is a legal obligation to hear asylum claims from migrants if they say they fear violence in their home countries.

Read: Migrant caravan: Mexico offers temporary work permits

Those seeking asylum must be fleeing due to a serious fear of persecution. Under international law, these are considered refugees.

If an asylum seeker enters the US illegally, they have been – until now – still entitled to a hearing of their claim.

    What have critics said?

The American Civil Liberties Union declared the move “illegal”.

“US law specifically allows individuals to apply for asylum whether or not they are at a port of entry,” they said.

Human rights group Amnesty International also came out against the rule.

Secretary General Kumi Naidoo issued a statement attacking the president’s “dehumanising rhetoric”.

“Asylum is not a loophole, it is a lifeline,” Mr Naidoo said. “This policy needlessly places the lives of thousands of people in danger.”

Earlier efforts by the Trump administration to limit migration prompted a political and legal backlash.

In June the president signed an executive order promising to “keep families together” in migrant detentions, after undocumented parents and children were separated at the border.

Days later, the Supreme Court upheld the president’s controversial travel ban against people from several Muslim majority countries.

A number of lower courts had originally deemed the measure unconstitutional.

  • Drogba loses USL Cup final with Phoenix Rising in what could be his last game

Didier Drogba has lost what could be the final game of his career, as Phoenix Rising were beaten 1-0 by Louisville City FC in the United Soccer League Cup final.

The former Chelsea striker, 40, has said this will be his last season.

In April 2017, Drogba became player-co-owner of Phoenix Rising in the second tier of US football.

Read: Official: Hearts of Oak appoints Kim Grant as head coach

Fellow owner Berke Bakay thanked him for his “amazing contributions to the beautiful sport” after Friday’s loss.

Drogba scored a goal in each of the club’s three play-off matches en route to their first ever USL Cup final.

“You have laid the foundation of something really special that we are all going to enjoy for many years to come,” tweeted Bakay.

Before the final, Bakay told BBC World Service that Drogba would be moving into the boardroom after retires.

Writing on the Phoenix Rising website last month, Drogba had said: “I joke with people that they need to give me the cup, so I can retire in peace. And that if I don’t get it, I’ll come back. But the truth is, this is my last season.”

Read: Takyi Arhin kicks against Normalisation Committee $1.5 million demand

The club did not confirm his retirement when asked by BBC Sport.

Drogba scored 157 goals in 341 appearances during his first spell at Chelsea from 2004 to 2012, winning three Premier League titles and the Champions League.

Following moves to Shanghai Shenhua in China and Turkish side Galatasaray, where he won the Super Lig and Turkish Cup, Drogba returned to the Blues for the 2014-15 season, scoring seven goals in 40 appearances and helping Jose Mourinho’s side to the title.

He then had 18 months with Montreal Impact before joining the Phoenix.

He scored 65 goals in 104 appearances for the Ivory Coast and was named African Footballer of the Year twice.

  • Madina-Adenta highway: Were highly disappointed in Transport, Roads Ministry – OccupyGhana

Pressure group, OccupyGhana have expressed their disappointment in the Transport Ministry, Roads and Highways Ministry and the Ghana Highways Authority for their slow reaction towards the handling of the recent spate of fatalities at the Madina-Adenta highway.

According to the group, the aforementioned authorities have not taken any serious and active measures that would save the lives of the pedestrians who ply that stretch on daily basis.

Read: Work to begin on Madina-Adentan footbridges next week after massive protest

They quizzed why the footbridges had been abandoned by successive governments, thus making it unsafe for pedestrians to cross the multiple lane highway.

Although the Ministry of Roads and Highways has announced that work on the six uncompleted pedestrian bridges in Adenta will commence in a week, OccupyGhana hopes government will act on its word stressing that they (OccupyGhana) will hold them accountable till the bridges are completed.

Read: Residents block Madina-Adentan road as car knocks down one more person

Frustrated residents on Thursday staged a protest burning tyres and blocking the highway after a first-year student at WASS was knocked and killed by a speeding taxi driver.

They blamed the development on the failure of government to ensure that there are footbridges for pedestrians on the highway.

Following that, OccupyGhana has given immediate solutions that would reduce the carnage on the Madina-Adenta Highway. They provided a six-pointer solution that they prayed government adheres to in order to immediately resolve the situation.

OccupyGhana® presents immediate solutions for reducing the carnage on Tetteh Quarshie-Adenta highway (N4).

OccupyGhana® is alarmed at the spate of pedestrian deaths on the Tetteh Quarshie-Adenta Highway (N4) in Accra due to the unavailability of safe crossing facilities on the road. The latest fatality in which a first-year female student of West Africa Senior High School (WASS) was killed becomes the 194th reported death on the Madina-Adentan Highway this year.

    https://www.facebook.com/theindependentghana/videos/322071761721572/

OccupyGhana® joins the nation in grieving with the bereaved families of the deceased.

The incident which caused angry residents to set ablaze car tyres to register their protest to the government is deeply regrettable and avoidable had government been proactive in arresting the situation sooner.

OccupyGhana® is surprised that after 11 years of construction of the highway, none of the footbridges have been completed, thus making it unsafe for pedestrians to cross the multiple lane highway. It is expected that footbridges, which forms the integral safety of pedestrians must be constructed before the commissioning of any highway.

OccupyGhana® is disappointed in the slow reaction of the Ministry of Transportation, Ministry of Roads and Highways, and the Ghana Highways Authority in handling this issue thus causing the loss of a reported 194 lives. The mentioned authorities have not taken and safety measures to save the lives of innocent Ghanaians crossing our roads. We however acknowledge government’s statement in dealing with the situation and we will hold them to it.

    https://www.facebook.com/theindependentghana/videos/297374127529132/

OccupyGhana® therefore calls for the following immediate solutions to be implemented in curbing the carnage on the Tetteh Quarshie-Adenta Highway (N4)

    1. Effective immediately, rumble strips should be constructed on the long stretch of road beginning from the University of Ghana to the Pantang end of the highway to reduce the unnecessary speeding of drivers.

Read: Madina-Adenta Highway: Another pedestrian knocked down by speeding truck

    2. Government should replace all faulty traffic lights that have been faulty with modern and solar powered controlled traffic lights. Further to this, extra traffic lights with toucan crossing system must be fixed to allow free flow of traffic.

    3. Public education must be extended to the schools in educating the public on safe crossing of the highway by the National Road Safety Commission. The Road Traffic laws must be implemented to arrest drivers and pedestrians who flout the regulations of speeding and Jay walking respectively.

    4. Officials of the MTTD of the Ghana Police must be on duty round the clock to control the traffic situation till all works are completed on the repair and installation of the traffic lights and rumble streets.

    5. Government must provide adequate road signs and markings along this stretch, as well as reflectors fixed on the kerbs. Marked crosswalks where pedestrians have priority over vehicular traffic e.g. zebra crossings should be provided

    6. Government should fix all streetlights along the corridor and ensure they are maintained.

OccupyGhana® is concerned about road safety measures on other highways, most especially the N1 highway that is claiming a lot of lives. Government should apply these same measures on the N1 highway.

Read: Adenta highway protest: 6 WASS students knocked down this year Headmaster

The number excludes the young girl who died on Thursday and those reported to have died last week.

The disclosure comes in the wake of the national anger following the failure of authorities to respond to calls by Adenta residents to address the incessant car knockdowns in the area.

  • Ive spent GHC20,000 on my constituents in a week Osei-Wusu

Bekwai MP and First Deputy Speaker of Parliament Joseph Osei-Wusu has bemoaned the overburdening nature of responsibilities borne by members of Parliament in Ghana.

According to him, while in other jurisdictions the MP simply directs the constituents to the source of help, the situation is vastly different in Ghana.

“In other areas, your role as the MP is to direct the person to where the help is, in our case it is you they want the help from. And if I were to show you my mobile money today, in the last one week I have transferred over GHC20,000 to people,” the lawmaker disclosed on the ‘America Decides’ show on Starr FM.

Also expressing frustration about demands on MPs from the electorate, Asawase MP Muntaka Mubarak said his colleagues have had to resort to other ventures in order to keep.

“ The way we run our democratic dispensation with the parties just opening up the flood gate, I am predicting that by the next 20 years we would have to beg decent people to come to parliament.

“Out of the 275, I am sorry that I have to say this, you cannot put your finger on 150 members of parliament who are dedicated and committed and are always in the house to do the work,” he said.
