    Another victim retrieved from Aklika river


    The river that claimed the life of the incumbent Assemblyman for the Teberebie electoral area in Tarkwa, Western Region, has now yielded another body.

    Manasseh Addison Sackey, also known as Teacher Obour, the head teacher and sitting assemblyman seeking re-election, reportedly drowned in a river connected to Aklika while en route to campaign in nearby villages.

    Notably, there’s a haunting parallel with the past, as reports suggest that a former assembly member, who had contested against Manasseh, met a similar fate two weeks before the elections four years ago.

    The late assemblyman, who also served as the deputy constituency secretary for the NDC in the Tarkwa Nsaem constituency, has prompted the party to suspend all activities for the next three days to mourn his tragic loss.

    The NDC Constituency Secretary for Tarkwa Nsuaem, Stephen Ayombisa, conveyed that the party will resume activities after the mourning period.

    During this time, they plan to collaborate with the family to finalize details regarding the burial and funeral rites.

    Mr Ayombisa shed light on the unfortunate circumstances, revealing that life jackets were unavailable when they reached the riverbank. Manasseh, unable to swim, succumbed to the tragic incident.

    “He is the constituency deputy secretary, therefore the party has decided to mourn him for the next three days, hence the decision to suspend all party activities so that after three days we sit with the family, and then we can come out with details of the burial and funeral rites.”

    “Unfortunately, I think at the time they got to the bank of the river, those jackets were not available and as for life jackets, they are there just that at the time they got there they were not available.”

    “More so, he doesn’t know how to swim so that also led to his timely death. There were five people in the boat when the boat capsized. Three of them were able to swim ashore, but two of them unfortunately couldn’t make it. On Wednesday morning, the other body has been retrieved.”

    Out of the five people in the boat, three managed to swim ashore, while two, including Manasseh, tragically did not survive. The latest update reports the retrieval of the second body on Wednesday morning.

    The National Democratic Congress (NDC) is urging religious leaders, Civil Society Organisations (CSOs), and other influential figures to openly oppose the proposed Legislative Instrument (LI) aimed at restricting the importation of specific items into Ghana.

    The suggested LI would mandate importers of 22 specified items, such as poultry, rice, sugar, diapers, and offal, to obtain licenses from a committee established by the Minister of Trade and Industry, KT Hammond.

    However, the opposition party contends that if the current draft document is approved by Parliament, it could lead to corruption within government ranks.

    During a press briefing as part of the party’s ‘Moment of Truth Series’ in Accra on December 6, the Minority Leader in Parliament, Dr. Cassiel Ato Forson, emphasized, “We also call on the Trades Union Congress (TUC), Civil Society Organisations (CSOs), traditional authorities, the clergy, and all progressive forces to speak up and join us to reject these obnoxious import restriction regulations, in the supreme interest of Ghana.”

    He further urged the government to retract the regulations promptly and expand its consultation with all key stakeholders.

    “Already, importers and the business community have amply demonstrated how these regulations lack broad consultation and consensus. We, therefore, call on the government to withdraw these regulations immediately and broaden its engagement with all key stakeholders.”

    On November 26, six business associations, collectively known as the Joint Business Consultative Forum, submitted a petition to Parliament opposing the proposed legislative instrument.

    The groups include the Ghana Union of Traders’ Associations (GUTA), Food and Beverages Association of Ghana (FABAG), Importers and Exporters Association of Ghana, Ghana Institute of Freight Forwarders (GIFF), Chamber of Automobile Dealership Ghana (CADEG), and Ghana National Chamber of Commerce and Industry (GNCCI). They argued that the enactment of the LI would severely impact their businesses.

    “Already, importers and the business community have amply demonstrated how these regulations lack broad consultation and consensus. We therefore call on government to withdraw these regulations immediately and broaden its engagement with all key stakeholders.

    Read below the statement by the NDC

    MOMENT OF TRUTH PRESS CONFERENCE ON THE PROPOSED “RESTRICTIONS ON THE IMPORTATION OF SELECTED STRATEGIC PRODUCTS REGULATIONS”, HELD ON 6TH DECEMBER, 2023 AND ADDRESSED BY DR. CASSIEL ATO FORSON, LEADER OF THE NDC MINORITY CAUCUS IN PARLIAMENT

    1. Friends from the media, I would like to extend our warm compliments to all of you, for your presence here this afternoon.

    2. This engagement has been necessitated by discussions surrounding a Legislative Instrument (LI) that the Akufo-Addo/Bawumia NPP government is desperately attempting to introduce in Parliament, which has very far-reaching implications for Ghanaians.

    3. The said LI, the Export and Import (Restrictions on Imposition of Selected Strategic Products) Regulations, 2023, seeks to give the Minister of Trade and Industry, the sole prerogative and unfettered power to grant licenses to any person desirous of importing into the country, some essential items numbering twenty-two (22).  These items are:

    • Rice
    • Guts, bladders, stomach and intestines of animals
    • Poultry
    • Frozen cuts and offal of fowl
    • Animal, vegetable, coconut and palm oil
    • Margarine
    • Fruit juices
    • Soft drinks
    • Mineral water
    • Ceramic tiles
    • Corrugated paper and paper board
    • Mosquito coil and insecticides
    • Soaps and detergents
    • Motor cars
    • Iron and steel
    • Diaper
    • Polymers (plastic and plastic products)
    • Fish
    • Sugar
    • Clothing and apparel
    • Biscuits
    • Canned tomatoes
    • Aluminium products.

    4. As expected, these ill-conceived regulations have faced stiff resistance from the NDC Minority in Parliament. Indeed, we have not been alone in this endeavour, as the business community and other well-meaning Ghanaians have joined us in opposing these restrictions which clearly do not bode well for our country.

    5. Indeed, the Joint Business Consultative Forum, comprising reputable associations such as:

    • the Ghana Union of Traders’ Associations (GUTA),
    • Food and Beverages Association of Ghana (FABAG),
    • Importers and Exporters Association of Ghana,
    • Ghana Institute of Freight Forwarders (GIFF),
    • Chamber of Automobile Dealership Ghana (CADEG), and
    • Ghana National Chamber of Commerce and Industry (GNCCI)

    argue that the LI if enacted, would have serious detrimental effects on their businesses.

    6. Let me make it clear, that in principle, the NDC is not against any legal regime or policy that seeks to protect indigenous businesses by regulating imports. What we are vehemently against, is a law that confers unfettered discretionary power on a single individual, in this case a Minister of Trade, to issue import licenses and to restrict the quantity of certain imports into the country, without any checks and balances.

    7. Such laws often breed corruption and cronyism, and can easily be abused to create a monopoly for some few individuals. As it is often said, power corrupts, but absolute power corrupts absolutely.

    8. Simply put, the proposed Import Restrictions Regulations of the failed Akufo-Addo/Bawumia NPP government, seeks to grant unchecked discretionary power to the Minister for Trade, to solely determine whether or not, to issue an import license to a person and to restrict the quantity of certain imports into the country, as he deems fit.

    9. The regulatory framework proposed by the LI is not only opaque, but can lend itself to arbitrariness and abuse. This clearly, is going to be an avenue for extortion and corruption if allowed to stand.

    10. Also, the proposed Regulations seek to impose both an application fee and a license renewal fee on prospective importers. This will in no doubt, impose an additional burden on businesses which are already wobbling under so much pressure from the several draconian tax measures and bad policies of the insensitive Akufo-Addo/Bawumia government.

    11. Even after one has fulfilled these requirements and paid the necessary application or renewal fees, the decision to issue or renew an import license, rests solely with the Minister of Trade, who can potentially use such unfettered powers to frustrate businesses of perceived political opponents.

    12. Additionally, under the proposed regulations, a Minister of Trade and Industry will constitute himself into a judge in his own cause, in the sense that the same Minister who seized with the power to grant, renew or cancel an import license, is equally clothed with the power to unilaterally determine a review application against his own decisions. This arrangement is clearly against natural justice.

    13. It is instructive to note that, currently, Ghana does not have any significant local capacity to produce some of the “strategic products” listed under the First Schedule of the proposed LI such as sugar, among others. Neither has the government outlined any specific interventions or incentives to promote the local production of such products. This completely belies the government’s claim that the proposed regulations are intended to promote local production of the affected products and conserve foreign exchange.

    14. More importantly, the proposed Regulations gravely offend some international trade treaties and protocols that Ghana is a party to. For instance, the regulations in their current form, contravene the World Trade Organisation (WTO) trade facilitation agreement, particularly on quantitative restrictions. This could lead to serious retaliatory action by our trade partners and eventually, affect exports from Ghana.

    15. It should be obvious to any discerning mind, that the excessive discretionary powers that the law grants a Minister for Trade, will afford him the opportunity to subject the issuance and renewal of import permits to crony or state capture. If this law is allowed to pass, a Minister of Trade will be handed a blank cheque to deny those who are not in his good books, licenses and create powerful trade cartels who will monopolise the importation of these essential commodities. This has the potential to create supply disruptions and shortages of certain goods in the economy with its concomitant effects on inflation.

    16. The NDC holds the view that the right to import essential commodities into the country cannot be limited to the whims and caprices of a Minister of Trade and Industry, his deputy or a certain Import Permit Committee, which will be constituted by the Minister under Regulation (2) of the proposed regulations.

    17. The alternative view of the NDC on this matter is that:

    • Where credible data exists to show that Ghana has adequate domestic capacity to produce a particular product, or where the consumption of a product has been proven to be injurious to public health or safety, government can simply place a ban on the importation of such products into the country.

    • However, where a particular product has not been proven to be harmful to public health or safety, and there is no credible data to show that adequate domestic capacity exists to fully meet the demand for that product, government can regulate the importation of that product in two main ways:

    I. One of the ways is to introduce a transparent quota system for the importation of certain products, as was done by the erstwhile NDC/Mahama administration in the poultry sector.

    A quota system requires a prospective importer of a particular product to first show proof of utilizing existing local capacity by procuring a certain percentage of his intended import volume, locally.

    When the erstwhile NDC/Mahama government realized that the local poultry industry had capacity to meet about 20% of total domestic consumption, the government introduced the 40% rule in the year 2014, which required poultry importers to purchase at least, 40% of their total stock from local poultry farmers.

    This policy was implemented alongside the Ghana Broiler Project and the provision of incentives for local poultry farmers, aimed at enhancing the domestic production of poultry.

    II. Another mechanism that can be used to regulate imports with the aim of protecting indigenous industries, is the imposition of tariff and non-tariff measures on certain products to encourage the patronage and consumption of locally-produced commodities.

    18. It is a known fact that trade volumes at our ports have dropped drastically under the failed Akufo-Addo/Bawumia NPP government due to high duties and taxes. Similarly, smuggling of goods out of Ghana to other neighbouring countries has intensified due to the porous nature of our borders. This obnoxious Legislative Instrument will exacerbate these problems and negatively impact livelihoods and the economy as a whole.

    19. As you may be aware, the insensitive Akufo-Addo/Bawumia NPP government is also seeking to introduce a new raft of draconian tax measures on the already-impoverished Ghanaian public, on the back of the 2024 budget which is yet to be approved.

    20. These tax measures which are currently before Parliament include;

    i. Imposition of VAT on non-life insurance such as:

    • Motor or car insurance
    • Marine insurance
    • Fire insurance
    • Building insurance
    • Goods-in-transit, etc.

    ii. Imposition of 5% VAT flat rate on residential and commercial real estate. Ghanaians should get ready to pay 5% VAT anytime you buy a house from an individual or a real estate company.

    iii. Imposition of VAT on:

    • Textbooks,
    • Exercise books,
    • Newspapers,
    • Publications,
    • Architectural plans,
    • Scientific and technical works,
    • Magazines,
    • Periodicals,
    • Calendars,
    • Trade catalogue,
    • Price list,
    • Diaries,
    • Stationery etc.

    iv. Imposition of VAT on domestic air travels.

    v. Imposition of VAT on the domestic transportation of passengers by road, rail and water.

    vi. Increase of stamp duty rates across board.

    vii. A new Excise Duty Amendment Bill, which seeks to increase the excise duty on Cider beer from 20% to 47.5% of ex factory price.

    The bill also seeks to introduce excise duty of GHS100 per annum for all petrol and diesel vehicles i.e internal combustion engines. This new tax applies to;

    • Private cars,
    • Trotro,
    • Uber,
    • Taxis,
    • Motorcycles,
    • Aboboyaa
    • Pragyia
    • Okada
    • “Mahama can do”, etc.

    This particular tax is regressive since all vehicles will pay the same amount of GHS100 per year whether you are using V8, articulator or an uber car.

    Further more, the bill seeks to introduce excise duty of GHS100 per tonne of carbon dioxide emissions by industries.

    Also contained in the bill, is a 20% excise duty on Akpeteshie.

    21. It is the considered view of the NDC, that the proposed import restriction regulations are regressive, counter-productive and have the potential to breed corruption just like the days of “essential commodities” and “price control”. The law is completely unwarranted and unwelcome.

    22. Already, importers and the business community have amply demonstrated how these regulations lack broad consultation and consensus. We therefore call on government to withdraw these regulations immediately and broaden its engagement with all key stakeholders.

    23. We also call on the Trades Union Congress (TUC) , Civil Society Organisations (CSOs), traditional authorities, the clergy and all progressive forces to speak up and join us to reject these obnoxious import restriction regulations, in the supreme interest of Ghana.

    11 lives lost to Nkwanta conflict – MP

    Geoffrey Kini, the Member of Parliament for Nkwanta South, has disclosed that eleven individuals were reported dead within the initial 24 hours of the conflict that erupted in the Nkwanta township.

    The dispute, arising from disagreements over the Akyodes’ 2023 annual yam festival rites, has led to numerous injuries and property damage, forcing many residents to flee the area.

    During his address to Parliament, MP Kini expressed deep concern about the conflict’s adverse impact on education and farming activities. He called on all stakeholders to collaborate in restoring peace and normalcy to the region.

    “Within the first 24 hours of the outbreak of hostilities, eleven people were officially reported dead. The usually vibrant and boisterous town degenerated into a ghost town with hundreds taking flight to near and distant towns and villages, with others barricading themselves and their families in their homes to escape from being killed.

    “Mr. Speaker, let me commend the security agencies comprising a combined teamwork of police and soldiers for their swift response, which helped to stop the carnage. But for their intervention, the fighting would have reached a more catastrophic proportion and claimed more precious lives.”

    Minister of Interior, Ambrose Dery, added that many individuals have faced prosecution for violating the imposed curfew in Nkwanta township, emphasizing that the curfew remains in effect.

    “Let me inform the House that the curfew is being imposed and enforced, and a number of people who have breached it have been sent to court, convicted, and fined, so there has been some calm. However, we also have to admit that because the case is a land matter, we cannot take it for granted.”

    The Managing Director (MD) of the Ghana Publishing Company, David Asante, has officially declared his candidacy for the New Patriotic Party (NPP) parliamentary primaries in Nkawkaw.

    Taking to Facebook on Tuesday, December 5, Mr Asante revealed that his decision to contest follows extensive consultations with party stakeholders in the constituency.

    With a strong commitment to delivering quality leadership, Mr. Asante aims to elevate Nkawkaw to its rightful position in Ghana’s political landscape.

    Expressing optimism about his chances in the primaries, he expressed his dedication to serving the constituency with integrity and sincerity.

    “After broad consultations with the leadership of the New Patriotic Party at the polling station, constituency, regional, and national levels, I have decided to contest the parliamentary primaries in the Nkawkaw Constituency.

    The nomination period for interested candidates will be open from December 20 to December 22, 2023, with detailed guidelines provided for the conduct of the primaries.

    The current MP for Nkawkaw is Joseph Fempong.

    The Member of Parliament for Old Tafo, Vincent Ekow Assafuah, has expressed his full support for the decision of the Attorney-General to appeal the jail term handed to the Chinese national convicted for illegal small-scale mining,(galamsey), Aisha Huang.

    Mr Assafuah contends that the judge committed an error in delivering a sentence of four and a half years in prison for Aisha Huang.

    He highlighted the importance of a proper application of legal principles, specifically Articles 19(5) and 19(11), as prerequisites for initiating legal proceedings.

    “The question is, was the judge wrong or did the judge err in pronouncing that Aisha Huang after her conviction be given a term of four and a half years? The combined effect of Articles 19 (5)  and 19(11) is very clear.  The combined effect is that at every material time, there should be a definition of an offense and that offense should also have the punishment that has been stated in a  written law.  To me, you cannot even go to court without Articles 19  (5) and 19(11). Articles 19(5) and 19(11), to me, is prerequisites for you to initiate Article 19(6), a prerequisite because you have to go to court first to initiate a prosecution against the person and after the conviction of the supposed accused person then Article 19 (6) can come in.  That is why the edge said she cannot give any severe punishment to the accused person.

    “I was tempted to lean with the A-G that there should be an appeal because to me the judge erred based on Article 19(6) because 19(5) and 19(11) is the combined effect for any initiation of any precautions,” he said on the Nig Issue on TV3 Wednesday, December 5.

    The High Court, under the jurisdiction of Justice Lydia Osei-Marfo, sentenced Aisha Huang to four years in prison, as per the Minerals and Mining (Amendment) Act, 2015 (Act 900), and imposed a fine of GHC48,000.00.

    The Attorney-General, Godfred Dame, has signaled his intent to appeal the judgment, aiming to ensure the application of the new sentencing regime introduced by Act 995.

    This move underscores the commitment to punishing illegal mining offenses while addressing concerns about the nature of the punishment meted out to Aisha Huang.

    The Attorney-General has urged the public, including legal practitioners, to be mindful of the facts surrounding the case and refrain from comments that may jeopardize the sound and efficient administration of justice or undermine the fight against illegal mining (Galamsey).

    He expressed appreciation for the relatively swift delivery of justice in this case, emphasizing its significance in reinforcing the commitment to combating illegal mining activities.

    Hearts of Oak board member, Dr. Nyaho Nyaho-Tamakloe, has condemned former coach Martin Koopman, labeling him as ‘immature, frustrated, and bitter.’

    This stern response comes in the wake of Mr Koopman’s accusations that the board interfered with his coaching decisions and dictated player selections.

    Dr. Nyaho-Tamakloe dismissed Mr Koopman’s claims, stating, as reported by Ghanasoccernet, “When they [Koopman and Rene Hiddink] came, we decided to allow them to work without any interference.”

    He countered Koopman’s assertion that certain players were forced out, insisting that Koopman had autonomously made those decisions.

    Challenging Koopman’s credibility, Dr. Nyaho-Tamakloe remarked,

    “They said they couldn’t work with some of the boys, and those he mentioned were players he sorted out himself and virtually asked them to leave the team because he said they were not up to standard.”

    “He is immature, frustrated, and bitter, he is a complete liar because of all the names he mentioned one can check from the Ghana Football Association or even our records to see whether they have not been featured since he came,” Dr Nyaho-Tamakloe countered.

    Highlighting the professionalism expected from a coach, he emphasized, “If as a coach you have realized that the wingers are not good, you train them, but you don’t complain. You don’t come out and lie to the media that the board doesn’t want you to use certain players. That’s not professionalism.”

    Mr Koopman’s tenure with Hearts of Oak ended after 10 games, during which the team secured only two wins. Despite his departure, the team’s performance has not significantly improved, facing setbacks in the MTN FA Cup and a recent defeat at Aduana FC.

    The upcoming match against arch-rivals Kotoko in Kumasi on Sunday adds further anticipation to the team’s challenges.

    The Chairperson of the Electoral Commission, Jean Mensa, has expressed deep concern over the alarming threats of violence against citizens during elections in Ghana.

    She highlighted that such violence is deliberately instigated by power-hungry individuals who are willing to go to any lengths to attain authority.

    Addressing the issue during a meeting with the Inspector General of Police, George Akuffo Dampare, and the Chief of Defence Staff (CDS) in Accra on Tuesday, December 5, 2023, Jean Mensa noted a shift from historical causes of election-related violence to a more premeditated and well-orchestrated strategy.

    This strategy aims to unleash violence before, during, and after elections, with the specific intent of undermining the credibility and integrity of institutions such as the Electoral Commission, the Police, and other security agencies.

    Jean Mensa acknowledged that the pursuit of power in contemporary politics has led to the use of brute force by Ghanaian politicians and their supporters, putting the lives of ordinary citizens at risk.

    “We are aware of the security threats we face today when elections are coming. The evidence of threats to our security confronts us daily. Indeed, elections have become the lifeblood of our society, people eat, drink, and breathe elections 24 hours a day. We do witness the dialogues on our radio and TV on a 24-hour basis, the quest for power today has become so fierce.

    “In the bid to capture power, our politicians and their supporters use all manner of methods to achieve their goal. In the wake of this, our security and safety are not spared. Today, we witness a mysterious and targeted approach by sections of our society to destabilize the peace of our nation and threaten lives, all in a bid to control power and the resources that come with it,” Jean Mensa concluded.

    She emphasized the daily evidence of security threats faced in the lead-up to elections, with a growing trend of orchestrated efforts to destabilize the nation’s peace and endanger lives for the sole purpose of gaining control over power and associated resources.

    Daughter of the late Nigerian Fela Aníkúlápó Kuti has stated that blaming Naira Marley for the tragic passing of his ex-associate, Mohbad, is unwarranted.

    Motunrayo Anukulapo-Kuti, who was responding to Iyabo Ojo’s accusations on Instagram stated that Naira Marley cannot be held responsible.

    Iyabo Ojo had earlier criticized Naira Marley for perceived silence during an Instagram live session where Sam Larry allegedly harassed Mohbad in the presence of Daddy Freeze.

    In a social media exchange, Iyabo questioned Naira Marley’s inaction during Mohbad’s bullying, prompting Motunrayo to confront Iyabo Ojo, Daddy Freeze, and another participant in the live session.

    “When Sam Larry was bullying Mohbad, what did Naira Marley do? Why didn’t you come out to say ‘this boy is my boy, why are you bullying him up and down, why did he keep silent?’ Was it right the way they were beating him up and down, torturing him,”

    “When Mohbad was being bullied, you all in this video what did u people do about it? What did ur talking do about it . But he died now and una wan come out come talk. Abegi jooo.”

    However,Motunrayo Anukulapo-Kuti has emphasized that everyone remained silent when Mohbad faced bullying, and now, assigning blame for his death, including pointing fingers at Naira Marley, is unjustified.

    She argued that no one is to blame for Mohbad’s death, including Naira Marley, and criticized celebrities for not taking action when Mohbad was being bullied.

    Motunrayo questioned the selective support and defense in the industry, highlighting that individuals have the right to decide what they want to be involved with.

    “Nobody is to blame for his death and definitely no NM. Why are they all coming out to point fingers? Everyone knew he was being bullied and no one did anything about it. Nothing like why NM. If they want to push blame every one of these celebrities are (sic) to blame cause they had the platform but they didn’t do shiiii.”

    Ghanaian artist Diana Hamilton shared a harrowing experience of a life-threatening stomach ailment that unfolded shortly after the release of her song ‘Adom.’

    Despite seeking consistent medical care and receiving various medications, the severe pain persisted.

    In an interview with Power FM, she revealed that her condition escalated, leaving her unable to eat for three days.

    “My meditation for one of my songs came after I was attacked with a serious condition. I was sick for days and admitted to one of the hospitals. It happened after I released my song titled ‘Adom’ in the early part of last year. I felt sick in the United Kingdom (UK) and I was transferred from one hospital to the other, they could not tell me the exact problem.

    “Every antibiotic they pushed couldn’t work. My stomach was aching seriously and because the drugs weren’t working for three days I couldn’t eat. One time after I took an MRI scan I was not briefed on the results. So I asked the nurse and she told me I should wait for the Doctor. At that moment I was filled with the fear of death. Within a twinkle of an eye, the results changed and the Doctors told me there was no problem with me so they cleared me to go home and start eating. Right there I was overwhelmed because it was by God’s grace,” she recounted.

    The situation took a miraculous turn when, after undergoing an MRI scan, the initial concerns about her health vanished, and she was pronounced healthy by doctors.

    Reflecting on the ordeal,the musician attributed her recovery to divine intervention.

    She mentioned that the inspiration for one of her songs came during this challenging period.

    The incident occurred in the UK, where she was shuttled between hospitals without a precise diagnosis.

    The artist expressed gratitude for the unexpected change in her medical results, acknowledging it as a manifestation of God’s grace.

    Deputy Attorney General Alfred Tuah-Yeboah has officially confirmed that the Guan Constituency, set to be created, will gain representation in Parliament following the 2024 elections.

    While residents eagerly anticipate participating in the upcoming District Level Elections (DLEs), the significant revelation is that they will have to wait until 2025 to elect their Member of Parliament (MP).

    “It’s clear that SALL will have a constituency. The CI has been prepared and submitted for Parliamentary approval. While residents can vote in the DLEs, they will need to wait until December 2024 to elect their MP,” Mr Tuah-Yeboah explained in an interview on Face to Face on Citi TV on Tuesday.

    Tuah-Yeboah shed light on the procedural aspect, stating that a Constitutional Instrument (CI) has been meticulously prepared and submitted for Parliamentary approval.

    He outlined the crucial timeline, emphasizing that residents must be patient until December 2024 to exercise their democratic right in electing an MP for the newly formed Guan Constituency.

    The Deputy Attorney General elucidated on the constitutional constraint, underscoring that the creation of new constituencies is prohibited while the current Parliament is in session. However, he provided a nuanced perspective, clarifying that in the event of an MP’s resignation or demise, a bye-election could be conducted.

    In tandem with this development, the Electoral Commission (EC) has officially announced that the District Level Elections (DLEs) in the Jasikan and Guan Districts are slated for December 19, 2023.

    The Office of the Special Prosecutor initiated investigations after a viral video showed Sarfo-Kantanka seeking a refund of alleged payments to assembly members to facilitate his approval after facing rejection for the second time.

    The full trial at the Kumasi High Court began on October 20, 2022, with six witnesses called by the prosecution.

    The Office of the Special Prosecutor, in an update, revealed that the prosecution has concluded its case.

    The previously rejected nominee pleaded not guilty to all charges and was subsequently granted bail of GH¢90,000.

    MP Francis-Xavier Sosu shared pictures of the protest on X, condemning Akufo-Addo’s actions as undemocratic and a violation of the rights of vulnerable women.

    “The President’s action is an infringement on our democracy and a violation of the rights of these vulnerable women,” he wrote on X.

    Background:

    President Akufo-Addo declined to assent to three significant bills, including the Criminal Offences Amendment Bill 2023, which seeks to criminalize attacks on alleged witches.

    The Speaker of Parliament, Alban Bagbin, criticized the president for not communicating his position on the bill.

    The presidency refuted having received the bill until November 27, 2023.

    The United States government has allocated $3 million for a collaborative initiative with the Netherlands, aiming to introduce women-specific body armor for peacekeeping in Ghana and Zambia.

    In a signing ceremony at the UN Peacekeeping Ministerial in Accra, Ghana, United States Ambassador to the United Nations, Linda Thomas-Greenfield, emphasized the changing landscape of UN peacekeeping with an increasing number of women participating.

    From only 20 women peacekeepers in the late 1980s, the figure rose to approximately 4,800 women in military peacekeeping and nearly 12,000 in formed police units in 2023.

    Thomas-Greenfield highlighted the positive impact of women peacekeepers, noting their approachability to women and girls, especially survivors of gender-based violence.

    She stated that women peacekeepers play a crucial role in effective communication with the communities they serve, offering valuable perspectives on conflict, reconciliation, and peacebuilding. Additionally, they serve as inspiring role models for the next generation of peacekeepers.

    She added that “we know that women peacekeepers are more approachable to women and girls – and especially survivors of gender-based violence. They help ensure that peacekeeping missions are effectively communicating with communities they serve.

    Despite these advancements, the ambassador expressed concerns about the underrepresentation of women in communities that require their presence. One significant barrier identified is the inadequacy of “unisex” personal protective equipment for women peacekeepers.

    In response, the United States has committed $3 million to a joint partnership with the Netherlands to pilot women-specific body armor in peacekeeping efforts in Ghana and Zambia.

    The women-specific body armor, designed with a tailored cut, rounded chest, shortened torso, and adjustable back, aims to provide better coverage of vital organs, addressing the shortcomings of the “unisex” predecessor.

    The pilot project will assess the effectiveness of this specialized equipment in enhancing operations and safety during training.

    Ghana and Zambia, recognized leaders in promoting the meaningful participation of women in peacekeeping and surpassing UN Gender Parity Strategy goals, will be the beneficiaries of the pilot project. The initiative includes the procurement and delivery of women-specific body armor, comprising vests, attachments, and armored plates.

    Ambassador Thomas-Greenfield expressed gratitude for the partnership, praising Ghana and Zambia for their consistent leadership in empowering women peacekeepers with not only armor but also the necessary training, infrastructure, and support. She emphasized that investing in this specialized armor is an investment in women, communities, and the overarching goal of empowering and protecting peacekeepers dedicated to safeguarding civilians in conflict zones.

    The promotion of women in peacekeeping is a key theme of the 2023 UN Peacekeeping Ministerial in Accra, Ghana, with partnership serving as a cross-cutting theme.

    The Convention People’s Party (CPP) has undergone a significant transformation following the decision made during its National Executive Committee (NEC) meeting held on December 5, 2023, in Kumasi.

    In an official statement released by Interim Secretary Kwame Nkrumah Botsio, the entire national leadership of the CPP has been dissolved, and an Interim Council (IC) has been appointed to manage the party’s affairs.

    The statement highlighted that the removal of all National Executive Officers was a result of the NEC meeting’s deliberations and decisions.
    According to the CPP’s constitution, the NEC delegates wielded the necessary authority to make such changes and appointed an Interim Council to guide the party through this transitional phase.

    Among the notable figures affected by this restructuring are the General Secretary, Nana Yaa Jantuah, and the National Chairperson, Nana Akosua Frimpomaa Sarpong-Kumankumah. This decision reflects a significant shift in the leadership dynamics of the CPP.

    The statement did not only confirm the removal of these key figures but also emphasized the establishment of an Interim Council to take charge of the party’s administration during this period of transition.

    “The Convention Peoples Party (CPP), on Tuesday 5th December 2023, held its National Executive Council (NEC) meeting in Kumasi. At the said meeting, all National Executive Officers were removed from power. At the selfsame meeting, the delegates of NEC, clothed with the requisite power under the Party Constitution, appointed an Interim Council (IC) to steer the affairs of the Party,” the statement said.

    Responding to the circulated inaccuracies, Ophelia Mensah Hayford addressed the claim of selling Mfantseman’s heritage, specifically referring to the Lithium contract between the Government of Ghana and Barari DV Ghana Limited.

    She emphasized that the government thoroughly examined all available options before entering the agreement, asserting that the aim is to preserve the heritage of Mfantseman.

    “As stated in the press statement issued on Monday, December 4th, 2023, by the Minerals Commission, I would like to reiterate that the government thoroughly examined all available options before entering into the agreement. I represent the best interests of Mfantseman. The lease agreement is available to the general public; therefore, I would urge Mr. Bambir to read it and see that the aim is to preserve the heritage of Mfantseman”.

    “The assertions he makes that the heritage of Mfantseman has been sold are nothing short of false accusations.”

    Regarding the issue of pulling down billboards in the constituency, she clarified that she issued no orders for such actions and, upon learning about them, instructed an immediate halt.

    She highlighted the commitment of the Nana-Bawumia-Ophelia government to democratic, free, and fair elections, expressing her dedication to constituents freely choosing their leaders.

    “To borrow Mr. Bambir’s words, the Nana-Bawumia-Ophelia government advocates democratic, free and fair elections. I am committed to the constituents of Mfantseman exercising their right to choose freely who to lead them. The resignation of the previous vice chairman was his independent action and we maintain a cordial relationship.

    “I have never held and, or presented my very self as a lawyer, neither have my representatives. I have begun my legal education and successfully graduated with an LLB degree. As an MP, I have been transparent about this information and would reiterate that I am not and have not held and or represented myself as a lawyer”, she stated.

    Addressing allegations about her professional background, Ophelia Mensah Hayford clarified that she has never presented herself as a lawyer, holding only an LLB degree.

    She reiterated her transparency about this information and called on John Bambir to apologize and retract his statements. She warned that failure to comply would lead her to initiate legal proceedings to address the harm caused by the false statements.

    Stephen Blewett is set to become the new Chief Executive Officer of MTN Ghana, effective March 2024.

    Mr Blewett takes over from Selorm Adadevoh, who has also been appointed as the Chief Commercial Officer of MTN Group.

    Mr Blewett rejoined MTN in July 2023 as the Operations Executive for Markets.

    He will be responsible for MTN’s smaller West and Central Africa markets and provide broader operations support across the region.

    Mr Blewett, formerly the Chief Operating Officer of Digicel, has a history with MTN, serving as CEO for MTN Benin and MTN Cameroon for seven years.

    As part of our work to ensure orderly leadership succession, MTN Group announces the appointment of MTN Ghana CEO, Selorm Adadevoh, a Ghanaian, to the new role of MTN Group, Chief Commercial Officer, taking over from Jens Schulte-Bockum who steps down as Group Chief Operating Officer at the end of his contract term in March 2024.

    At the same time, Stephen Blewett, MTN Operations Executive, Markets, will assume the role of CEO of the important MTN Ghana subsidiary.

    Selorm will become a member of the MTN Group Executive Committee. Jens will step down from his executive role on 31 March 2024 but will remain a non-executive director on the boards of major subsidiaries – MTN South Africa, MTN Nigeria and Bayobab.

    The Krobo District of the Electricity Company of Ghana plans to extend its prepaid meter installation to other areas within the District during the second quarter of 2024.

    Ing. Christopher Apawu, the District Manager, shared this information during a media briefing at the office premises in Somanya on December 4, 2023.

    While the ongoing prepaid meter installation is still in progress in the Yilo and Lower Manya Krobo areas, the District Manager revealed that customers in Akrade and Atimpoku will soon have the actual prepaid meters installed.

    The initial steps, including pre-installation surveys and education on meter functionality, have already commenced. Similar processes will soon be carried out in Akuse and Asutsuare, both falling under the Krobo District.

    The District Manager emphasized that over 10,000 meters will be installed in these areas at the expense of ECG, with no cost incurred by customers for the replacement. He clarified that meter replacements differ from new service requests, which involve fees.

    Ing. Apawu cautioned customers against installing unauthorized meters, emphasizing that it is illegal.

    He stated that all meters slated for replacement are already documented, and any unauthorized additions will be identified and dealt with accordingly.

    Regarding the working relationship between the District and customers, Ing. Apawu highlighted a cordial and improved partnership.

    Seven individuals were apprehended by the police for firing shots indiscriminately during the installation of a Paramount Chief at Sampa on November 30, leading to one fatality and severe injuries to seven others.

    Addressing Parliament, the MP called for the summoning of the Ministers of National Security and Interior to provide a comprehensive briefing on the situation.

    “I request your office to invite the regional minister, the rucksack of the new regime, and the national security minister, and the interior minister to appear before this august house and answer questions about what led to the demise of the innocent persons and the injuries sustained by the others.”

    A group identifying as Concerned Citizens of Ghana has issued a threat to stage a protest at the Ghana Revenue Authority (GRA) premises on January 15, 2024, regarding the prolonged tenure of the Commissioner-General, Rev. Dr. Ammishaddai Owusu-Amoah.

    The group asserts that the GRA head has surpassed the legal age limit for a public officer to hold office, prompting an immediate call for him to retire.

    Charles Akowuah, the group’s spokesperson, alleges that both Rev. Ammishaddai and Ms. Julie Essiam, the Commissioner responsible for the Support Services Division of the GRA, have exceeded the constitutionally stipulated 60-year period for civil servants.

    “Our investigations reveal that both Rev. Ammishaddai and Ms. Julie Essiam have opted to remain in their positions beyond the age of 60, despite their contracts being extended until 2021. This raises concerns about adherence to established retirement policies within the GRA.”

    “We anticipate around 1,500 individuals to occupy the GRA office immediately after January 15, 2024.”

    Deputy Attorney-General and Minister for Justice, Alfred Tuah-Yeboah, has underscored the potential dangers of extending the payment deadline for the founder of the now-defunct Capital Bank, William Ato Essien.

    Mr Tuah-Yeboah expressed concern that such an extension could establish an undesirable precedent, suggesting that individuals with outstanding payments might exploit the system if given leniency.

    During an interview on Face to Face on Citi TV, Tuah-Yeboah emphasized the significance of upholding agreements with the state, emphasizing the need for strict adherence to proposed timelines.

    “In this case, the judge then agreed, and it was adopted. In such agreements, you make sure that there’s a default clause that, in case the accused person fails to pay, then the outstanding sum becomes payable. In that particular case it was almost GH¢90 million, he paid GH¢30 million. He was supposed to have been paying GH¢20 million every other four months. The first GH¢20 million he defaulted, and so, we had to trigger the clauses in the agreements to the effect that all the outstanding sum was to be paid.”

    “He couldn’t pay, so the only option was for the court to slap a custodial sentence on him. It could have set a dangerous precedent if the time was extended. Other people may say you can agree with the state even if you default. The state will extend the time for you, and for that matter, the law will not even work.”

    He warned against defaulting on agreed-upon terms, stating that the legal system would take appropriate action in response.

    The cautionary statement comes in the aftermath of William Ato Essien’s sentencing to 15 years in prison for embezzling over GH¢90 million from Capital Bank.

    Mr Tuah-Yeboah explained that Essien’s failure to meet the stipulated repayment deadlines, as outlined in an agreement with the Attorney-General, resulted in the initiation of custodial measures.

    “If you agree with the state, make sure that whatever proposal that you bring, you will go by it. In this particular case, he was talking about one year, and we said we will give him 6 months,” he entreated.

    The Deputy Attorney-General urged individuals engaging in agreements with the state to honor their commitments promptly to avoid legal consequences.


    In October 2023, William Ato Essien was sentenced to 15 years of imprisonment with hard labor by the Accra High Court for embezzling over GH¢90 million of the bank’s funds.

    Essien, on December 13, 2022, entered a guilty plea for 16 counts of stealing and money laundering, admitting to misappropriating more than GH¢90 million in liquidity support provided to Capital Bank by the Bank of Ghana (BoG). Although convicted by the court, he managed to avoid immediate incarceration by reaching an agreement with the Attorney-General (A-G) to repay the GH¢90 million as restitution.

    Pursuant to Section 35 of the Courts Act, 1993 (Act 459), which allows individuals on trial for causing economic loss to the state to admit guilt and make restitution to potentially avoid imprisonment, Essien paid GH¢30 million in December of the previous year. According to the court-adopted agreement, he was obligated to settle the remaining GH¢60 million in three GH¢20 million installments, with the first payment due on or before April 28, 2023, the second on or before August 31, 2023, and the final tranche on or before December 15, 2023.

    However, Essien found himself incarcerated when he failed to meet the stipulated deadlines for payment, prompting the A-G to file an application under the same Section 35 of Act 459. This led the court to impose the custodial sentence.

    As of October 12, 2023, when the imprisonment was imposed, Essien had only paid GH¢7 million out of a potential GH¢40 million, missing the installment payments due on April 28 and August 31 of that year as per the agreement. In total, he had paid GH¢37 million of the GH¢90 million, leaving an outstanding amount of GH¢53 million.

    Addressing the recent economic challenges, Dr. Addison underscored the country’s strong economic fundamentals, stable financial sector, and advanced payment system architecture. Despite facing an unprecedented global shock in 2020 due to the pandemic, he commended the government’s swift response and clear public policy initiatives that effectively managed the consequences.

    To finance pandemic-related expenses, the Bank of Ghana, the IMF (through the Rapid Credit Facility), and the World Bank intervened.

    Dr. Addison highlighted the successful purchase of GHS10 billion of the Government’s Covid-19 bonds by the Bank of Ghana, which bridged the exceptional financing gap and helped contain the pandemic’s effects.

    However, he pointed out that the fiscal cost associated with pandemic containment, coupled with spillovers from the Russia-Ukraine war in 2022, led to widened sovereign spreads on Ghana bonds and downgrades by Credit Rating Agencies.

    This situation hindered Ghana’s access to international capital markets, causing the country to miss planned external borrowing of about US$3 billion.

    Dr. Addison highlighted the importance of external borrowing to manage debt liabilities, including energy-related payment obligations, as Ghana faced annual external debt service payments and energy payments ranging from 3 to 4 billion US dollars annually as of 2020.

    “For now, I’m going to concentrate on my business. They think some other people can do it better. In political parties, you do not hold on to things.     In response to the vacuum left by the departing executives, a thirteen-member interim body was formed, comprising regional chairmen, a council of elders member, regional secretaries, regional organizers, and representatives of women and youth.

    She clarified that the harmonized prospectus, included with the placement form, outlines sub-items for each student, and during the verification process, students are not required to pay any fees. Thus, if a school demands money for registration, it is considered illegal.

    Twum Ampofo emphasized that uniforms fall under the government’s responsibility and are covered by the free Senior High School (SHS) package. She stated, “No school has approval to ask first-year students to pay registration fees. During the verification process, students don’t pay anything. If a school is taking money for registration, then it’s illegal.”

    Assuring concerned parents, Twum Ampofo pledged that the GES would conduct a thorough investigation into the raised concerns.

    The report revealed that despite warnings from his team about potential risks, Sackey insisted on proceeding with the campaign tour, assuring them that the destination was in close proximity and he would return promptly.

    Tragically, their canoe capsized in the middle of the river, resulting in the loss of Sackey’s life and another individual through drowning. Three survivors from the incident recounted the unfortunate event.

    The body of the deceased has been transported to the Tarkwa municipal mortuary for autopsy and preservation.

    Ten individuals, including a woman, have been arrested by the Winneba District Police Command after they threw stones at the police during a demonstration outside the Effutu Municipal Assembly.

    The residents initiated the protest on Tuesday, expressing their grievances over the alleged sale of a Ramsar site for mining.

    Despite prior warnings from the police not to break through the blockade near the assembly premises, the protesters attempted to breach it by pelting stones at the police.

    In response, the police used tear gas to disperse the crowd and subsequently detained ten individuals.

    On Tuesday morning, residents of Effutu took to the streets to voice their displeasure over allegations of the potential sale of the Ramsar site in Winneba for lithium mining.

    Led by Names Kofi Annan, the founder and owner of Challenging Heights, a non-governmental organization, the residents marched through the principal streets of Effutu.

    Wearing red and black attire, they chanted songs to express their dissatisfaction, contending that the sale of the site to Green Metal Resources Limited would prevent the people of Winneba from enjoying the Aboakyire festival, as the Ramsar site, where they catch deer, had supposedly been sold to investors.

    James Kofi Annan, the leader of the group, vehemently opposed the granting of leases, permits, or any concession to Green Metal Resources for mining purposes.

    “We are registering our displeasure to the Green Metal Resources or any other company for the sale of the Ramsar site to them. In the year 2007, there were several attempts to carry out mining in the Aboakyire hunting ground. The Caribbean Atlantic Holding Ghana Limited applied to the Minerals Commission for a mining concession, but it was opposed. In 2012 Obotan Resources Limited also did same but was opposed. In 2016 Elite Resources applied but was also turned down.

    The demonstrators have submitted a petition to the Minerals Commission.

    The Attorney General and Minister of Justice, Godfred Yeboah Dame, has announced his intention to challenge the trial court’s decision regarding the sentencing of illegal miner Aisha Huang under the Minerals and Mining (Amendment) Act, 2015 (Act 900).

    Mr Dame plans to appeal the judgment at the Court of Appeal, aiming to ensure that the updated sentencing provisions introduced by the Minerals and Mining (Amendment) Act, 2019 (Act 995), are applied to Aisha Huang.

    Aisha Huang was sentenced to four and a half years in prison on December 4, 2023, for mining without a license, along with a GH¢48,000 fine. The judge, considering both prosecution and defense arguments, found Aisha Huang guilty.

    Notably, the accused had previously been acquitted of similar charges, but the judge could only impose a four-year sentence due to the older legal regime, which had a maximum penalty of five years.

    The new Act introduces a significantly higher jail term of over 20 years for such offenses.

    In a statement issued on Tuesday, the Attorney General acknowledged the efficiency of the justice delivery system in Aisha Huang’s trial.

    “Whilst applauding the efficiency of the justice delivery system witnessed in the trial of Aisha Huang, the Attorney General will however test the soundness of the decision of the trial court to punish the accused person under Act 900, by filing an appeal at the Court of Appeal, against the sentence to ensure that the new sentencing regime imposed by Act 995 is applied to the accused person.”

    However, he expressed the intention to test the trial court’s decision by filing an appeal at the Court of Appeal.

    The objective is to ensure that the updated sentencing regime stipulated by Act 995 is appropriately applied to Aisha Huang.

    Additionally, Mr. Dame appealed to the public, urging caution in commenting on the judgment.

    He highlighted concerns about misleading comments and emphasized the need to avoid statements that could undermine the efficient administration of justice and the ongoing fight against illegal mining (galamsey).

    “The Attorney-General hereby, respectfully, entreats members of the public including lawyers, to be mindful of the facts stated above and desist from comments which not only jeopardise the sound and efficient administration of justice but also undermine the fight against illegal mining (galamsey),” Mr Dame said.

    Ghana secures $50m emission reduction agreement

    The Ministry of Lands and Natural Resources, through the Forestry Commission, has formalized a groundbreaking Emission Reduction Payment Agreement (ERPA) with Emergent Forest Finance Accelerator Incorporated (Emergent), a non-profit organization based in the United States.

    Serving as the convenor and coordinator of the Lowering Emissions by Accelerating Forest Finance (LEAF) Coalition, Emergent will facilitate the payment of up to Fifty Million US Dollars (US$50,000,000.00) to Ghana.

    This payment is in recognition of emission reductions amounting to five million tonnes of carbon dioxide equivalent, valuing each tonne at Ten Dollars (US$10.00).

    Signed during the twenty-eighth session of the Conference of Parties (COP28) of the United Nations Framework Convention on Climate Change (UNFCCC) on December 1, 2023, the agreement marks Ghana as the inaugural country globally to sign an ERPA under the LEAF Coalition.

    This collaboration ensures the supply of high-integrity jurisdictional REDD+ emission reductions and removals credit.

    Notably, Costa Rica followed suit and inked a deal with Emergent, totaling Fourteen Million US Dollars (US$14,000,000.00). This positions Ghana and Costa Rica as the only forest countries to achieve such a remarkable feat.

    The LEAF Coalition, initiated in April 2021 by the Governments of the United Kingdom, the United States, and Norway, along with global companies, is a voluntary coalition aiming to provide finance for tropical and subtropical forest conservation.

    By raising global climate ambition and contributing to halting deforestation and forest degradation by 2030, the coalition ensures that forest jurisdictions have access to large-scale, predictable, performance-based finance for reduced deforestation and sustainable rural development.

    Ghana, Nepal, and Ecuador were initially selected after a Call for Proposals involving thirty countries. After the technical screening process, they became the first countries to sign a Letter of Intent with the Coalition.

    Minister Samuel A. Jinapor of the Ministry for Lands and Natural Resources signed Ghana’s Letter of Intent at COP26 in Glasgow, subsequently forming a committee to secure a binding ERPA.

    This historic ERPA will complement Ghana’s ongoing efforts to combat climate change through initiatives such as the Green Ghana Project, the Ghana Forest Plantation Strategy, and the Ghana REDD+ Strategy.

    Ghana has already received over US$4.8 million under the Ghana Cocoa REDD+ Programme and is implementing the Ghana Shea Landscape Restoration Programme with Green Climate Fund support.

    Minister Samuel Abu Jinapor emphasized the urgency of global collaboration to address climate change, citing the importance of forest and nature-based solutions. The ERPA will expand Ghana’s climate action beyond its Carbon Fund area.

    Emergent’s Founder and CEO, Mr. Eron Bloomgarden, lauded Ghana’s commitment, making it the first African nation to sign such an agreement, expressing optimism in delivering forest solutions to climate change.

    UK’s Minister for Energy Security and Net Zero, Graham Stuart, acknowledged the critical role of halting tropical deforestation in addressing climate change.

    Minister Andreas Bjelland Eriksen of Norway commended Ghana and Costa Rica’s ERPA under the LEAF Coalition, urging increased public and private finance for forest countries in collaboration with the Coalition to deliver high-quality forest carbon.

    Forest and nature-based solutions have been central to successive COPs since 2021, contributing significantly to global climate solutions.

    “And so, having arrested her, and having claimed by our charge sheet that she committed these offences except the immigration offence, between 2015 and 2017, the only punishment that could be exacted on her is the punishment sanctioned under Act 900,” Tuah-Yeboah said.
