    Alec Baldwin: Manslaughter charges in connection with shooting dropped

    Alec Baldwin no longer faces criminal charges in connection with a fatal on-set shooting in October 2021.

    In connection with the event that occurred while Rust was being filmed in New Mexico, the Emmy Award-winning actor was charged with two counts of involuntary manslaughter.

    Halyna Hutchins, a cinematographer, was murdered by a real bullet fired from a pretend gun that Baldwin was using.

    The development comes less than two weeks before a trial was set to begin.

    A statement released by New Mexico special prosecutors Kari Morrissey and Jason Lewis said that “over the last few days… new facts were revealed” in the case, requiring further investigation.

    “This decision does not absolve Mr Baldwin of criminal culpability and charges may be refiled,” the statement continued, adding: “Our follow-up investigation will remain active and ongoing.”

    A lawyer for Mr Baldwin praised the move by prosecutors.

    “We are pleased with the decision to dismiss the case against Alec Baldwin and we encourage a proper investigation into the facts and circumstances of this tragic accident,” his lawyer, Luke Nikas, told the BBC in a statement.

    Mr Baldwin had been practising firing the gun on set at a ranch near Santa Fe when it went off, fatally striking 42-year-old Ukrainian-born Hutchins and wounding director Joel Souza.

    The actor denied pulling the trigger, although an FBI report later concluded that the gun could not have been fired without the trigger being pulled.

    He had been due in court for a preliminary hearing on 3 May.

    The film’s armourer, Hannah Gutierrez-Reed, is also facing two counts of involuntary manslaughter. The statement from the special prosecutors says the charges against her remain unchanged.

    A lawyer for Ms Gutierrez-Reed told BBC News that they “fully expect at the end of this process that Hannah will also be exonerated”.

    The rust set

    According to the LA Times, prosecutors had recently learned that the gun used in the shooting, a .45 Colt revolver, had been modified with a new trigger in a way that could have made a misfire more likely.

    Thursday’s statement by prosecutors made no mention of the gun, but said that the newly revealed facts “demand further investigation and forensic analysis”.

    Prosecutors had accused Mr Baldwin, 65, of showing a “reckless” disregard for the safety of his colleagues.

    Mr Nikas, a lawyer for the star of The Hunt for Red October, previously called the initial decision to charge his client “a terrible miscarriage of justice”.

    “Mr Baldwin had no reason to believe there was a live bullet in the gun – or anywhere on the movie set,” Mr Nikas said.

    “He relied on the professionals with whom he worked, who assured him the gun did not have live rounds.”

    In an Instagram post after the announcement was made, the 30 Rock actor thanked his lawyer and his wife, Hilaria Baldwin.

    “I owe everything I have to this woman. (and to you, Luke),” he posted.

    In order to have been found guilty prosecutors would have had to convince a jury that he had acted with “criminal negligence”.

    If convicted, he could have faced up to 18 months in prison.

    The Santa Fe district attorney had initially added a firearm enhancement charge, which could have added five years to his sentence.

    But it was dropped after prosecutors determined that the enhancement law was not in place at the time of the shooting.

    The decision to drop the charges comes on the same day that Rust resumed filming – 18 months after the shooting.

    Melina Spadone, a lawyer for Rust Movie Productions, said new rules on the set “will bar any use of working weapons and any form of ammunition”.

    “Live ammunition is – and always was – prohibited on set.”

    According to Variety magazine, Mr Baldwin is currently filming Rust on location in Montana.

    Hutchins’ widower, Matthew, will be an executive producer. Baldwin last October reached a settlement in a wrongful death lawsuit brought by her family.

    Rust Movie productions, which Baldwin is part of, said in February the scene that was being rehearsed when Hutchins was shot has now been rewritten.

    Filming on Alec Baldwin’s Western movie Rust is resuming on Thursday, 18 months after the fatal on-set shooting of cinematographer Halyna Hutchins.

    Baldwin, who has pleaded not guilty to two counts of involuntary manslaughter, is remaining in the the starring role.

    Principal photography is starting up again at a new location in Montana.

    “It will bar any use of working weapons and any form of ammunition,” said Melina Spadone, lawyer for Rust Movie Productions.

    “Live ammunition is – and always was – prohibited on set.”

    Bianca Cline will take Hutchins’ place as cinematographer, with Joel Souza, who was injured in the shooting in New Mexico, returning as director.

    Hutchins’ husband Matthew will be an executive producer. Baldwin is a producer as well as the film’s star.

    Rust Movie productions, which Baldwin is part of, said in February the scene that was being rehearsed when Hutchins was shot has now been rewritten.

    The company added that Cline, whose credits include Marcel the Shell With Shoes On and American Horror Story, will “complete Halyna’s vision for the film” and donate her salary to charity.

    Souza said in February: “Though bittersweet, I am grateful that a brilliant and dedicated new production team joining former cast and crew are committed to completing what Halyna and I started.

    “My every effort on this film will be devoted to honouring Halyna’s legacy and making her proud. It is a privilege to see this through on her behalf.”

    Charges denied

    In October 2021, Baldwin was rehearsing a scene on the set at a ranch near Santa Fe, New Mexico, when the “prop” gun he was holding fired, resulting in the death of the 42-year-old Ukrainian-born cinematographer.

    Charges of involuntary manslaughter were brought against him and the film’s armourer Hannah Gutierrez Reed by the Santa Fe District Attorney’s office last month.

    Lawyers for both denied any wrongdoing and said they intended to fight the charges in court.

    Baldwin’s lawyer, Luke Nikas, called the decision to charge the actor “a terrible miscarriage of justice”.

    “Mr Baldwin had no reason to believe there was a live bullet in the gun – or anywhere on the movie set,” Mr Nikas said. “He relied on the professionals with whom he worked, who assured him the gun did not have live rounds.”

    A two-week preliminary hearing is due to begin in Santa Fe in early May to decide whether there is enough evidence for the case to proceed to trial.

    The Hollywood star has reached a settlement in a wrongful death lawsuit brought by Mr Hutchins.

    In February, Hutchins’ family filed a new civil lawsuit against Baldwin and the production company seeking damages for alleged battery, intentional infliction of emotional distress, negligence and loss of consortium.

    Hutchins’ widower Matthew also approved a documentary about her in February.

    According to the Source at Alec Baldwin spent time at N.Y.C.’s private club Zero Bond on Tuesday hours after Santa Fe County District Attorney Mary Carmack-Altwies formally filed charges against him

    The source says that “Alec seemed chill and low-key” as he visited the exclusive spot in the NoHo neighborhood of Manhattan with his wife, Hilaria Baldwin, adding: “They didn’t engage with anyone but headed straight to where everyone plays poker.”

    The area at the back of the private members’ club is only available to poker players, the source tells PEOPLE.

    “After spending around 30 to 40 minutes in the back poker area, Alec and Hilaria came back out and sat in the lounge,” the source says, adding that the pair “chatted away” in the lounge. (Fox News obtained photos of Alec outside of Zero Bond on Wednesday.)

    Zero Bond states on their website that they maintain a “rigorous process in regards to member selection,” and only members who “display a high level of integrity” and demonstrate an ability to contribute to the private community are accepted.

    Once a potential member submits a formal application and is accepted into the club, they are required to pay an initiation fee and an annual fee that varies by age.

    The charges against Baldwin and Gutierrez-Reed, 25, include two counts of involuntary manslaughter. Hutchins’ death came after a prop gun held by Baldwin — that contained live rounds — was discharged.

    Alec Baldwin to be charged with manslaughter in fatal shooting on the set of ‘Rust,’ DA says

    Oscar-nominated actor Alec Baldwin will be charged with involuntary manslaughter in the fatal shooting of cinematographer Halyna Hutchins on the New Mexico set of the Western movie “Rust,” prosecutors said Thursday.

    Baldwin and the film’s armourer who was in charge of weapons on the set, Hannah Gutierrez-Reed, will each face two counts of involuntary manslaughter, according to New Mexico First Judicial District Attorney Mary Carmack-Altwies.

    “Rust” first assistant director, David Halls, has agreed to plead guilty to negligent use of a deadly weapon, according to the DA’s office.

    “This decision distorts Halyna Hutchins’ tragic death and represents a terrible miscarriage of justice,” according to a statement by Baldwin’s attorney, Luke Nikas.

    “Mr. Baldwin had no reason to believe there was a live bullet in the gun — or anywhere on the movie set. He relied on the professionals with whom he worked, who assured him the gun did not have live rounds. We will fight these charges, and we will win.”

    An attorney for Gutierrez-Reed also vowed to prove his client isn’t culpable.

    “Hannah is, and has always been, very emotional and sad about this tragic accident. But she did not commit involuntary manslaughter,” defence lawyer Jason Bowles said in a statement.

    “These charges are the result of a very flawed investigation and an inaccurate understanding of the full facts. We intend to bring the full truth to light and believe Hannah will be exonerated of wrongdoing by a jury.”

    Involuntary manslaughter is a fourth-degree felony and is normally punishable by up to 18 months behind bars and a $5,000 fine, prosecutors said. But a firearm enhancement on the charges could make the crime punishable by a mandatory sentence of five years in jail, prosecutors said.

    “After a thorough review of the evidence and the laws of the state of New Mexico, I have determined that there is sufficient evidence to file criminal charges against Alec Baldwin and other members of the ‘Rust’ film crew,” Carmack-Altwies said in a statement, adding charges will be filed before the end of the month.

    “On my watch, no one is above the law, and everyone deserves justice.”

    Hutchins was fatally shot nearly 15 months ago during the filming of “Rust” at the Bonanza Creek Ranch in New Mexico on Oct. 21, 2021.

    Baldwin was rehearsing with a pistol for a scene set inside a church when the gun went off, killing Hutchins and wounding the director, Joel Souza.

    No charges will be filed in connection to Souza’s wounding, the prosecutors said.

    “If any one of these three people — Alec Baldwin, Hannah Gutierrez-Reed or David Halls — had done their job, Halyna Hutchins would be alive today. It’s that simple,” special prosecutor Andrea Reeb said in a statement.

    “The evidence clearly shows a pattern of criminal disregard for safety on the ‘Rust’ film set. In New Mexico, there is no room for film sets that don’t take our state’s commitment to gun safety and public safety seriously.”

    Hutchins, 42, was survived by her husband, Matthew Hutchins, and their 9-year-old son, Aldous.

    Nearly a year after the fatal shooting accident on the set of Rust, in which Alec Baldwin fired a prop gun which killed cinematographer Halyna Hutchins and injured director Joel Souz, the actor is seeking to clear his name.

    The New York Times reports Baldwin on Friday filed a lawsuit against the armorer and three other crew members in Los Angeles Superior Court. Baldwin’s attorneys claim Hutchins died due to the negligence of the film’s armorer, Hannah Gutierrez-Reed; assistant director David Halls; props master Sarah Zachry; Seth Kenney, who supplied the guns and ammunition, and Kenney’s business, PDQ Arm and Prop.

    “More than anyone else on that set, Baldwin has been wrongfully viewed as the perpetrator of this tragedy,” the lawsuit reads.

    “This tragedy happened because live bullets were delivered to the set and loaded into the gun, Gutierrez-Reed failed to check the bullets or the gun carefully, Halls failed to check the gun carefully and yet announced the gun was safe before handing it to Baldwin, and Zachry failed to disclose that Gutierrez-Reed had been acting recklessly off set and was a safety risk to those around her,” Baldwin’s cross complaint said.

    Baldwin is seeking unspecified damages for the “immense grief” he’s endured since the tragic incident.

    Last December, in an interview with ABC’s George Stephanopoulos, Baldwin said he “didn’t pull the trigger” on the firearm that killed Hutchins.

    “Well, the trigger wasn’t pulled, I didn’t pull the trigger.” Asked for clarification, he replies, “No, no, no, no. I would never point a gun at anyone and pull the trigger at them, never. … Someone put a live bullet in a gun, a bullet that wasn’t even supposed to be on the property.”

    Pressed about if this is the worst thing that’s ever happened to him, the 63-year-old answers, “Yes. Yup. Because I think back, and I think of, ‘What could I have done?’”

    Alec Baldwin and the family of Halyna Hutchins have come to an agreement after Alec fired a prop gun.

    Filming of Rust will continue in January, with Ms Hutchins’ husband Matthew as an executive producer, news agency Deadline reported.

    A lawsuit filed against Mr Baldwin, producers, and others, alleged several violations of industry standards.

    All parties believe Ms Hutchins’ death was an accident, her husband said.

    The exact terms of the settlement, which is subject to court approval, have not been disclosed.

    In a statement reported by Deadline, Mr Hutchins said he would take on the role of executive producer, and that all original players would be involved in the resumption of filming, which he said would “pay tribute” to his wife’s final work.

    He has “no interest” in apportioning blame for his wife’s death, he said.

    Alec Baldwin’s attorney, Luke Nikas of Quinn Emanuel, said in a statement: “Throughout this difficult process, everyone has maintained the specific desire to do what is best for Halyna’s son. We are grateful to everyone who contributed to the resolution of this tragic and painful situation.”
