A court in Spain has convicted former Barcelona and Brazil footballer Dani Alves of raping a woman at a nightclub in Barcelona.
The 40-year-old, known as one of football’s most accomplished players, has been sentenced to four and a half years in prison.
Alves, who denied the allegations, had been accused of sexually assaulting the woman in the early hours of a day in 2022. Despite his lawyer’s request for acquittal, Alves may appeal the verdict.
The court found that Alves had lured the woman to a VIP toilet area in the nightclub and determined that she did not consent to the encounter.
In its statement, the court cited evidence corroborating the victim’s testimony.
Additionally, Alves has been ordered to pay €150,000 (£128,500) in damages to the victim.
He has been in pre-trial detention since January 2023.
During the trial, Alves altered his testimony several times. Initially denying knowing the accuser, he later admitted to encountering her in the restroom but claimed nothing untoward happened.
Eventually, he asserted that the encounter was consensual.Prosecutors argued that Alves and a friend had bought champagne for three young women, inviting one to accompany him to another area, where he became aggressive and coerced her into sex despite her protests.
Alves, who played over400 games for Barcelona and was part of Brazil’s 2022 World Cup squad, faced a nine-year prison term, as requested by the prosecution.
In Spain, convictions for rape can result in sentences ranging from four to 15 years. Recent legal reforms prioritise consent, known as the “Only Yes is Yes” principle.
Barca’s annual spending ceiling has been further reduced by €66 million, dropping from €270 million to €204 million, signalling the urgent need for the club to offload players during the upcoming summer transfer window.
The Sun reports that players such as Frenkie de Jong, Robert Lewandowski, Gavi, Raphinha, Ronald Araujo, and Pedri are all potential candidates for sale, as they possess significant market value and command high wages.
This reduction comes after a previous slash of €400 million in September, underscoring the formidable challenge ahead for Barcelona as they strive to regain competitiveness in the transfer market.
Sources disclosed to ESPN that the club’s squad costs, which the cap regulates, exceed €400 million, more than double the limit imposed by La Liga.
Consequently, Barcelona faces stringent financial constraints, restricting them to spending only a percentage of their savings in salaries or transfer fees earned, with the percentage contingent upon the magnitude of the savings.

His mother, accompanied by one of his brothers, blew kisses and made a heart-shaped sign with her hands as Alves, handcuffed and escorted by police officers, entered the room.
The three-judge panel denied a request by Alves’ lawyer, Ines Guardiola for the trial to be suspended on the basis that he was not given enough time to prepare for his first police interview after his arrest and had suffered a parallel trial by the media.
Sexual assault is a dominant political theme in Spain, even more so after the alleged non-consensual kiss that then Spanish Football Federation chief Luis Rubiales planted on the lips of Jenni Hermoso after the team’s World Cup triumph last August.
Alves’ trial is one of Spain’s highest-profile since a 2022 law from the socialist-led government made consent a key factor in sexual assault cases and increased the minimum jail time for such assaults involving violence.
The law was prompted by the 2016 gang-rape of a teenager during the San Fermin bull-running festival after the five men were originally convicted by a lower court of sexual abuse, sparking mass protests. The country’s top court subsequently ruled they were guilty of rape.
The case triggered national soul-searching on the topic, which continues to this day as gender violence rates remain high.
In Spain, a claim of rape is now investigated under the general accusation of sexual assault, with rape as an aggravating factor.
The Alves trial is expected to last three days.
The alleged victim testified on Monday in a closed-doors session. She talked from behind a screen, with her voice distorted to protect her identity.
Alves has won more than 40 trophies for Brazil and clubs including Barcelona, Sevilla, Juventus and Paris Saint-Germain. Following his arrest, he was fired by Mexico’s Pumas UNAM.

Barcelona president Joan Laporta mentioned on Friday that a European Super League initiative could kick off as early as next season, expressing indifference towards English clubs’ participation.
In 2021, Barcelona and Real Madrid initiated a Super League project, but it swiftly disintegrated due to fan and institutional backlash, leading other clubs to withdraw.
In December, the European Union’s Court of Justice ruled that FIFA and UEFA had violated competition law by obstructing the breakaway league.
Following this, A22 Sports Management, the promoters of the Super League, promptly outlined plans for a new 64-team tournament, positioning it to rival or potentially replace UEFA’s Champions League.
“The Super League could start next season, or it will be in 2025–26, and if not, I will rethink everything,” Laporta told RAC1 radio station. Six Premier League clubs were part of the initial proposal but pulled out and have shown no intention of returning. “I don’t care if the English teams join,” added Laporta.
“They already have their Super League, the Premier League.”
“The European Cup started in 1955 with very few clubs and later became the top competition in Europe,” said Laporta.
“I imagine a first phase like this, and (more clubs) then integrating.”
The Barcelona president has proposed potential participants for the European Super League alongside Real Madrid, such as Inter Milan, AC Milan, Roma, and Napoli from Italy.
Joan Laporta also mentioned Portuguese clubs Porto, Sporting Lisbon, and Benfica, along with Dutch teams Ajax, Feyenoord, and PSV Eindhoven.
Additionally, French side Marseille and Belgian outfits Club Brugge and Anderlecht were listed. However, both Bayern Munich and Paris Saint-Germain, prominent teams in Germany and France, respectively, have criticised and distanced themselves from the Super League project, declaring non-involvement.
The European Super League has been suggested as a solution for financially struggling clubs to enhance their economic stability.
“The Super League means that you’re putting 100 million euros ($109 million) on the table for a club just for competing in the competition, at least, and you don’t even get that for winning theChampions League,” said Laporta.
While Pep Guardiola remains eternally linked with Barcelona due to his significant association with the club, Joan Laporta, the club’s president, does not envision Guardiola returning to Camp Nou in 2024 as the successor to Xavi.

If he continues until the end, it’s up to him. I’m not going to sack him, no matter what. He doesn’t deserve it. He deserves that we trust him. We are not throwing in the towel in the league; in the Champions League, we face Napoli, but Xavi is very motivated. I have no doubts about Xavi and the motivation and commitment of the players. Xavi is honest and if the formula doesn’t work, he would say so.”

“As a Culer, thinking about the club and the players, I think they will be freed up and calmer. Thinking as a club man, I think the best thing to do is to leave on June 30.
“That said, I’ll give it my all the remaining four months. I think we can have a good season and hopefully the dynamic will change,” Xavi insisted.
“I love the president very much, both him and [Vice President] Rafa [Yuste], Alejandro, and [Sporting Director] Deco,” Xavi went on.
“Their confidence until today was full but it’s time. I’m not moved by economic situations; I’m moved by the heart and I think it’s the best situation for the club.
“I don’t want to be a problem. We played a totally unfortunate game and it’s time for a change of direction for the players, who don’t deserve it.
“It was a blow to see how they beat you in a match that you had come back from. I don’t remember a match as cruel as today’s in my career,” Xavi claimed.
“We need a change of course for the good of the club and this will de-escalate the situation surrounding Barca,” he suggested.
This surprising turn of events coincides with reports from Cadena SER suggesting that Thiago Motta is being considered as a potential successor to Xavi, who has held the coaching position since November 2021.

The former vice president of the refereeing committee in Spain, José María Enríquez Negreira, is now required to testify as a defendant concerning payments his companiesreceived from Barcelona.
This decision follows a judge’s dismissal of Negreira’s claim of dementia, with the judge, Joaquín Aguirre, ruling that although Negreira experiences some memory impairment, he remains mentally capable of appearing in court and potentially facing prosecution.
Negreira, who was previously a referee in the Spanish top flight, is scheduled to testify on Feb. 21.
Barcelona made payments exceeding €7 million ($7.3 million) to Negreira’s companies between 2001 and 2018 during his tenure as the vice president of the committee. Last March, Negreira, along with his son Javier Enríquez Romero, was charged with corruption related to these payments.
Other individuals charged in the case include former Barcelona presidents Sandro Rosell and Josep María Bartomeu, as well as former executives Oscar Grau and Albert Soler.
Bribery charges were added in September after the judge said Negreira “exercised public functions” as vice president of the committee, which equates him to a civil servant.
In October, current Barça president Joan Laporta was also charged with bribery when the judge ruled his first spell in charge, between 2003 and 2010, should not be time-barred.
Laporta has insisted the money was for “technical reports about referees” and, along with the club, has repeatedly denied ever “buying referees or influence.”
However, prosecutors have accused Rosell and Bartomeu of having an agreement with Negreira in which “he would carry out actions aimed at favouring Barca in the decision-making of the referees in the matches played by the club and thus in the results of the competitions.”
Rosell was Barca president from 2010 to 2014, before Bartomeu replaced him. After six years at the helm of the Catalan club, Bartomeu resigned in 2020, with Laporta elected as his replacement in 2021.
Barcelona coach Xavi Hernández expressed optimism about the club’s future, whether or not he remains in charge, following their 4-2 loss to Athletic Club in the Copa del Rey quarterfinal on Wednesday.
The defeat at San Mamés came on the heels of a 4-1 loss to Real Madrid in the Spanish Supercopa final just 10 days earlier, leaving Barcelona’s chances for silverware this season dependent on La Liga and the Champions League.
Despite the disappointment in the result, Xavi commended the team’s young players, highlighting the contributions of teenagers Lamine Yamal, Pau Cubarsí, Hector Fort, and Marc Guiu in the match against Bilbao.
“All coaches at big clubs depend on trophies, but I feel pride at how we competed against a great team until the end, especially the youngsters,” Xavi said in his postgame news conference.

“We’re bruised [after the Madrid loss], that’s true. We have to start again with a clean slate, but the players believe in what we are doing.”

“We are closer to success than defeat. I understand the criticism; I know where I am, but I have the same desire as day one. I will never be a problem for Barça. The moment they say I am a problem, I will be gone.
“Above all, I am a fan. I love this club. I will never be a problem for the president [Joan Laporta], Deco, the players… Everyone knows that.”
Barça sporting director Deco said it makes “no sense” to question Xavi’s future after Sunday’s Clásico setback, while Laporta was present at training on Wednesday to reaffirm his belief in the coach and his players.

Fort also dismissed the claim that some of the workers are being paid less than the minimum wage.
“There are five pay slips [in El Periodico’s investigation] when there are more than 2,000 during the entire execution of the work,” she said.
“And one thing is that there could be an error in those pay slips. We are reviewing that. But all contracts go through social security.
“Not a single contract that has been made is below the agreed terms. In the construction contracts, by agreement, work is done six days a week, a maximum of 12 hours [per day].”
Finally, to the allegation that one worker has been sleeping outside Camp Nou due to fears of losing their job if they arrive late, Fort said she was not aware of that particular case, but “we don’t have 2,000 workers sleeping on the streets, which means things are working.”
