2024 polls: Don’t use our names to heighten political – GAF warns media, general public

Ghana Armed Forces (GAF) have issued a stern warning against the use of their names to heighten political tension as the country gears up for the 2024 elections.

This follows allegations that the Armed Forces had plans to stage a coup if the 2024 elections became too violent for the Ghana Police Service to manage, similar to concerns raised during press conferences held  in 2016 and 2020.

GAF in a statement released on Friday, August 23, 2024, denied allegations of a coup plot by its outfit adding that it would only intervene in the 2024 elections once it is called on by the Ghana Police Service, a move which is not tantamount to an overthrow.

“GAF wishes to call on civil society groups and the media to desist from using its name to heighten political tension in the country.

We wish to draw the attention of the public that GAF will only support the Ghana Police when the latter requests for assistance and that does not constitute an overthrow of a government” the statement read.

The Military went on to call on all stakeholders to ensure that all Ghanaians feel secured and safe while they exercise their legal rights in selecting new leaders.

“We wish to urge all stakeholders to join hands in ensuring that all citizens feel free and safe to undertake their lawful activities in an atmosphere of tranquillity.

GAF, like all peace-loving institutions and individuals, is looking forward to peaceful elections come December 2024. We therefore call on all institutions and groups not to associate GAF with anything that has the potential of heightening political tension in the country”.

Refuting claims of staging a coup on December 7, GAF announced its commitment to thwart any effort by a group, individual or institution that will make any such attempt.

“We wish to make it clear that GAF has no intention to stage a coup and will prevent and resist any individual, group or organisation seeking to unlawfully take over the power of government either acting alone or in collaboration with any security agency” it warned.

  • Martin Kpebu asks Akufo-Addo to consider 5-year contract for ACP Agordzo as reparation

Martin Kpebu asks Akufo-Addo to consider 5-year contract for ACP Agordzo as reparation

A private legal practitioner and counsel for the recently acquitted Assistant Commissioner of Police (Rtd), Dr Benjamin Agordzo, has proposed a unique form of reparation.

Martin Kpebu is advocating for the Ghana Police Service to grant ACP Agordzo a five-year contract appointment, allowing him to regain his lost dignity and continue his dedicated service to the nation.

The High Court’s decision on January 24 to acquit ACP Agordzo, along with Colonel Samuel Kodzo Gameli and Corporal Seidu Abubakar, of treason charges marked the end of a protracted legal battle. Kpebu believes that offering a contract appointment to Dr. Agordzo would not only restore his professional standing but also contribute to the positive work he was undertaking for Ghana.

Speaking on the January 24 edition of Ghana Tonight on TV3, Kpebu expressed his sentiments, stating, “It will not solve all the problems, the destruction. It will not make him regain everything he’s lost, but at least, it will rehabilitate him a bit, because they’ve destroyed him on frivolous evidence.”

Kpebu further revealed that they are preparing to take legal action against the government for malicious prosecution. He asserted that the state prosecuted Dr Agordzo for political gains, accusing them of abusing the criminal justice system to stifle dissent and silence public officers critical of the government.

“We are building a case, malicious prosecution. When we say malicious prosecution, it is a case where somebody takes you through the criminal justice system, through trial, etc., without justifiable reason,” Kpebu explained. “We will show how this was an abuse of the process from day one.”

He also challenged the government’s motives, questioning why similar statements made by President Akufo-Addo during his time in opposition did not lead to any legal action against him.

Meanwhile, despite Agordzo’s acquittal, six other individuals, including three soldiers, were sentenced to death by hanging for their involvement in the same case. The verdict has ignited discussions about the legal proceedings and the implications for those accused in the high-profile trial.

Alleged coup plot: I am going to sue the State – Acquitted ACP Agordzo

The legal representative of Assistant Commissioner of Police (ACP) Benjamin Agordzo has pledged to initiate legal action against the State.

Lead Counsel, Martin Kpebu has demanded compensation for his client, citing the framing of a trivial case against his client.

“…..he said is it active, the tug group as an NGO and there’s going to be a demonstrating and he said look pass through the legal means. He said look pass through means and said conditions are ripe in Ghana for another spring and you see since the time he spoke its gotten worse and that was before COVID-19 hit and you are aware that when COVID-19 hit about 850,000 more of fellow Ghanaians were pushed below the poverty line.

“So now more people are hungry, out of jobs, unemployment, these are the things he was talking about so he said if you are going to demonstrate on such matters pass through the legal channels, that’s all that he said and yet the State moved a very frivolous to the highest degree around his neck. And you see today the Court has exonerated him. We will sue the State for compensation because the has been frivolous from day one,” he added.

This decision follows the recent acquittal of ACP Agordzo, Colonel Gameli, and another junior military officer, Corporal Seidu Abubakar.

The verdict, delivered on Wednesday, January 24, 2024, was originally slated for November 22, 2023, following the submission of written arguments by the involved parties.

The charges, stemming from April 24, 2021, implicated Dr. Frederick Yao Mac-Palm, the late Chief Executive Officer of Citadel Hospital, ACP Dr. Agordzo, and eight others.

The accused faced a range of charges, including conspiracy to high treason, abetment to high treason, and high treason.

Colonel Samuel Kodzo Gameli and ACP Dr. Benjamin Agordzo were charged with abetment.

All ten accused individuals pleaded not guilty and were granted bail during the trial.

The passing of Dr. Mac-Palm led to the removal of his testimony from the records, officially confirmed by the Court.

The prosecution, led by AG Godfred Yeboah Dame, included figures from the Attorney General’s Department, such as Yvonne Atakora Obuobisa, Director of Public Prosecution, Hilda Craig, Winifred Sarpong, Lawrencia Adika, and Akosua Agyapomaa Agyemang.

Notable defense attorneys included Rita Akukunti Ali, Victor Kodjogah Adawudu, Anthony Lartey, Eric Kpongo, Lamptiig Apanga, Matthias Yir-Eru, Kormivi Dzotsi, Ephraim A. Vordoagu, and Maud Opoku.

The three-member panel of judges, sitting as additional High Court judges, consisted of Justice Afia Serwah Asare-Botwe, Justice Hafisata Amaleboba, and Justice Stephen Oppong, with Justice Asare-Botwe serving as the President of the panel.

Throughout the trial, State Prosecutors presented 13 witnesses, including seven soldiers. The Prosecution concluded its case on July 12, 2022, after a trial that commenced on June 8, 2021.

  • Treason Trial: Female accused tried to seduce civilian officer – Military

Warrant Officer Class One (WOI) Esther Saan allegedly seduced a civilian employee, Samuel Kotei, when he was serving her water as instructed.

Major General Nicholas Peter Andoh, second prosecution witness in the ongoing treason trial told the High Court.

He said when the civilian driver brought the water, the door of the guardroom where WOI Saan was kept was left opened and accused who was coming out asked him to send it to the room.

Major General Andoh was disclosing the content of the report of the alleged seduction as investigated by the military police.

The key to where the female accused person was kept and at all material times were in the control of the soldiers on duty and that the civilian employee had no access to the place, the lawyer asked.

Major General Andoh said the report on the alleged attempt by the accused person to jump bail would be made available to the Court.

In a cross-examination by Apanga Lamtiig, lawyer for WOI Esther, the witness said when the driver entered, the accused held him from the back, came to the front, raised her dress without panties and asked him to do something.

“In the process a corporal came in and raised the alarm.”

Mr Lamtiig put it to the witness that none of the accused persons had shot a gun or taken a violent action against the President of the Republic or any member of the executive.

Major General Andoh rebutted that the preparation, acquisition and planning were towards the end (coup plot) and the security did not have to wait till they fired before taking appropriate action.

Bede Tuuku, counsel for L/Cpl Ali Solomon, asked whether the witness knew his client and that the case he had against him was the fact that he attended a meeting at the Next Door Beach Resort.

However, the witness said it was not only that but the fact that L/Cpl Ali also visited Dr Mac Palm at his residence.

Dr Frederick Mac Palm, Donya Kafui, Bright Alan Debrah, Johannes Zipki, Colonel Kojo Gameli, WOI Esther Saan, Corporal Seidu Abubakar, L/Cpl Ali, L/Cpl Sylvester Akanpewon and Assistant Commissioner of Police Benjamin Korsi Agordzo are standing trial for conspiracy to commit high treason, high treason, abetment among others.

They have all denied their respective charges and have been granted bail.

  • Coup plotters lament over ‘military escort’ to court

Some Military Officers who are being held allegedly over treason-related charges have lamented to an Accra High Court over how some of their colleagues have been detailed to follow them to court.

Mr Eric Pongo, who held the brief of Kojogah Adawudu, indicated that Colonel Kojo Gameli, his client who is on court bail is being followed to the court.

Counsel for Warrant officer II Esther Saan, Ziyeli Agambilla, also indicated that his client was also being given a military escort to the court.

A practice, both lawyers found to be intimidating and needless, praying the court to intervene.

Squadron Leader Sandra Efusah Nana Agyemang, a lawyer of the Ghana Armed Forces who stood as a friend of the court explained that the said: “military escort” was part of the Ghana Armed Forces protocol and the practice did amount to intimidation but offer some morale to the accused.

The trial Judge, Mr Samuel K Asiedu, a Justice of the Court of Appeal sitting with additional responsibility as a High Court judge, held that he saw nothing wrong with the practice since the practise did not infringe on the rights and liberties of those officers.

Dr Frederick Yao Mac Palm and ten others are being held over alleged treason charges.

All the accused persons have met their bail conditions except Donyo Kafui, Johannes Zikpi, a civilian worker for the Ghana Armed Force and Corporal Seidu Abubakar, a soldier.

Prosecution had earlier told the Court that Dr Mac Palm is a medical doctor and the Director for the Citadel Hospital, Donyo, alias Ezor is a blacksmith, Debrah is a Freight Manager, whereas WO 2 Saan, Corporal Abubakar, Lance Corporal Ali and Sylvester Akanpewu are soldiers.

Prosecution said Colonel Kojo Gameli and Assistant Commissioner of Police (ACP) Benjamin Korsi Agordzo are senior military and Police officers in that order. All the accused belong to “Take Action Ghana,” a Non-Governmental Organisation.

According to the Prosecution in June 2018, security agencies picked up intelligence of the group’s intention to overthrow the government and usurp executive powers, thus, they held several meetings to that effect at the expense of Dr Mac Palm.

Prosecution mentioned some of the issues discussed at the meetings as recruiting more soldiers, acquire arms, procurement of electronic gadgets, on how to capture the President among some key personalities in government as well as drew a road map for their operation.

Prosecution said their discussions also included whether to kill the President, adding that, all these were recorded.

According to prosecution, Zikpi, who is skilled in communication gadgets, was recruited by Colonel Gameli, whilst Donyo was employed by Dr Mac Palm to manufacture arms, and that Colonel Gameli had also advised Dr Mac Palm to be careful with the site for their meetings.

The Prosecution said Donyo was brought to Accra from Alavanyo in the Volta Region, to the Citadel Hospital to manufacture local arms and was agreed later that Dr Mac Palm would procure more to augment his armoury.

Prosecution said investigations revealed that the group was incorporated in August 2018 and a WhatsApp platform was created to recruit members, where ACP Agordzo was added, and he, in turn, supported them with GH¢1,000.00 and drafted a speech for Dr Mac Palm.

The prosecution said on September 19, 2019, Dr Mac Palm and Donyo went to the Military Shooting Range to test fire their weapons where they were arrested.

According to the prosecution after their release, they went to the hospital to conceal the manufactured weapons, but luck eluded them when the military and other security agencies stormed there the next day, leading to their arrest. The rest were also arrested and handed over to the National Investigations Bureau,(NIB)where a search at the Hospital revealed the weapons.

The trial has been adjourned to May 4.

  • Fate of coup plotters in a balance as jury isnt available to decide on case

The fate of the 10 persons standing trial for allegedly plotting a coup to destabilise the country and possibly overthrow the government is still undecided as the jury is not fully constituted.

According to a Graphic report, this made the High Court adjourn the trial to November 20, in an expectation that the required pool of jurors will be constituted from which seven will be selected for the trial.

The jury was expected to be empanelled on Friday October 16, but the presiding judge announced that the jurors were not available at that particular time.

Justice Samuel Asiedu, the high court judge hearing the case, indicated that letters had been sent to various institutions as well as organisations to make their members available for jury duties but those institutions have yet to respond.

“I will get the registrar to get the members ready for the jury to be empanelled,” Justice Asiedu said, when he was announcing the adjournment of the trial.

The accused persons standing trial include Dr. Frederick Mac-Palm, the main person accused of masterminding the alleged plot, Donya Kafui, Bright Alan Debrah Ofosu, Johannes Zikpi, Corporal Seidu Abubakar, Lance Corporal Ali Solomon and Corporal Sylvester Akanpewon.

Dr. Mac-Palm, Kafui, Debrah, Dekuwine, Abubakar, L/Col Akanpewon and Zikpi have pleaded not guilty to the charge of treason felony and conspiracy to commit treason felony, while Dr. Mac-Palm and Kafui have separately pleaded not guilty to the charge of conspiracy to possess explosives and ammunition without lawful excuse, and possession of explosives and ammunition without lawful excuse.

Col. Gameli and ACP Dr. Agordzo have pleaded not guilty to the charge of abetment in a treason felony.

    Background

The 10 who are part of a group known as TAG, an NGO, are alleged to have planned on demonstrating against the Government of Ghana and “possibly take over the government”.

Prosecutors say the group had a map in their possession when they were arrested with some important state installations targeted.

The alleged state institutions targeted are the Jubilee House, the Ghana Broadcasting Corporation (GBC), Burma Camp, the 37 Military Hospital and the National Police Training School.

Dr. Mac-Palm, Kafui and Debrah as part of the alleged coup plot had planned on kidnapping the President, the Vice-President, the Speaker of Parliament and the Chief of the Defence Staff and force the President to announce his overthrow.

“Again, there were discussions on whether or not to kill the President in the process of overthrowing the government,” the prosecutors added.

The prosecution indicated that in June 2018, the security agencies picked up intelligence that the accused persons had planned to overthrow and take over the government.

Col. Gameli is said to have recruited Zikpi, who was a signal specialist with the GAF, to help jam the radio signals of the National Communications Authority with the exception of the Ghana Broadcasting Corporation.

The prosecution said in furtherance of the plot, Dr. Mac-Palm invited Kafui, who was a blacksmith at Alavanyo, to Accra to manufacture explosives and pistols for TAG.

The prosecution added that ACP Dr. Agordzo donated GH¢2,000 to TAG to aid in its cause and also drafted a speech for Dr. Mac-Palm to be read at the planned demonstration by TAG.

    13. State security agencies assure the general public that they remain vigilant, and will work to safeguard national security and public safety. The public is encouraged to remain calm and advised to provide information on any suspicious persons or activities to the police for necessary action.

    14. The Government of Ghana will also continue with efforts to provide the necessary logistics and motivation to the security agencies for intelligence gathering, capacity building and other operations, to protect the country from terrorism, subversive activities, and other violent crimes.
