    Lawyers for Trump claim Stormy Daniels resisted subpoena outside of bar in Brooklyn

    Donald Trump’s lawyers tried to give Stormy Daniels a subpoena when she came to an event at a bar in Brooklyn last month. She is supposed to be a witness at the former president’s trial. But she refused to take it and left.

    A person delivering legal papers for Trump’s lawyers said he gave the papers to Daniels but had to leave them on the ground because she wouldn’t take them. This was stated in a court document released on Wednesday.

    “I told her she was given the papers and told her what they were,” said Dominic DellaPorte, who delivers legal documents. “She ignored me and continued walking into the place, and she had a blank expression. ”

    Before a showing of the “Stormy” movie at the 3 Dollar Bill club, there was a fight between Trump’s lawyers and Daniels’ lawyer. This fight has been going on for a month and is still going on this week as Trump’s criminal trial starts in Manhattan.

    Trump’s lawyers want Judge Juan M. to do something. Merchan wants Daniels to follow the subpoena. They included a picture that they said DellaPorte took of Daniels as she walked away.

    Clark Brewster, Daniels’ lawyer, says they did not get the papers. He said the requests were like looking for something that is not necessary and have nothing to do with Trump’s trial for breaking the law.

    Brewster wrote a letter to Merchan on April 9, saying that the process set up before the trial seems like it’s meant to harass or scare a regular witness. Brewster didn’t answer a message from The Associated Press right away.

    Trump’s first criminal case that involves paying hush money is now going to trial. Seven people have been chosen to be jurors. The process of choosing the jury will start again on Thursday.

    Daniels will talk about getting $130,000 in 2016 from Trump’s lawyer, Michael Cohen, to keep quiet about a sexual encounter she had with Trump years ago.

    Cohen got paid back by Trump’s company for the payment. Trump is being blamed for changing his company’s records to keep secret the payment and other things he did to hide bad news during the 2016 election.

    Last year, Trump said he didn’t do 34 bad things related to lying about his business records. He says he didn’t have sex with Daniels. His lawyers say that the money given to Cohen was for valid legal costs and was documented accurately.

    The Manhattan district attorney’s office said that if Trump decides to speak at the trial, they will question him about his recent legal losses to test if he is telling the truth. The documents were filed last month and kept confidential.

    Trump has to give $454 million as a punishment because a judge said he lied about how much money he has. In a different court case, a group of people decided that he had to pay $83. 3 million for saying bad things about writer E. Jean Carroll said that he accused him of sexually hurting her.

    Merchan said he wants to have a meeting on Friday to decide if it will be allowed.

    According to the law in New York, prosecutors can ask witnesses about their past legal issues in some situations. Trump’s lawyers disagree. Trump wants to speak in court, but he doesn’t have to and can decide not to later.

    Regarding the subpoena argument, Trump’s lawyers are trying again to get important information about Daniels, who is an important witness for the case.

    They want a lot of papers about how the movie “Stormy” was made. The movie is about Stormy Daniels and how she became famous after being linked to Trump. It also talks about her time in the adult film industry.

    They also want Daniels to say how much money she was paid for the movie.

    Trump’s lawyers argue that the movie’s debut on NBC’s Peacock streaming service last month, a week before the trial was supposed to start, created bad publicity for Trump, making it hard for him to get a fair trial.

    Trump’s lawyers say that Daniels is just trying to make money by using her reputation as a witness.

    The subpoena asks for messages between Daniels and other people who might be witnesses in the trial, like Cohen and Karen McDougal, a former Playboy model who says she had a relationship with Trump. It also asks for any messages between Daniels and Carroll.

    Earlier this month, Merchan stopped Trump from getting information about the documentary from NBC Universal by using legal power. He said that the subpoena and its demands are like a fishing trip, trying to find something.

    Stormy Daniels has offered to “testify in divorce proceedings” on behalf of Melania Trump, the spouse of Donald Trump.

    In the wake of last week’s historic court appearance by Trump, the former adult star sat down with ITV’s Good Morning Britain to share her story.

    She stated in a different interview with Piers Morgan that she felt “the King has been dethroned” and that the former president was “no longer untouchable.”

    She stated in an interview with ITV regarding Melania that anything she said would be speculation and that she didn’t need anyone else to speak for her.

    ‘Perhaps her not speaking is her speaking. Silence speaks volumes if you will.

    ‘I feel bad for her, she’s a mother. I would assume as a mother her main priority is her child.

    ‘The other side to that is we don’t know about their private life. We don’t know what goes on behind closed doors. We don’t know what kind of arrangement they had.

    Morgan said: ‘You asked him on that first night about his wife, Melania. They’d only been married quite recently. She’d just given birth to their son. What did you feel about that?

    ‘You’ve been criticised for that part of it. You already said that.’

    Ms Daniels replied: ‘I didn’t think anything was going to happen, you know what I mean? Why would I assume this person was going to be half-dressed and outside a bathroom door when we had talked about his daughter, which people try to sexualise, and it absolutely wasn’t.

    ‘And he had shown me pictures of his wife and son. We were just talking about how cute he was. Not any different than if we showed pictures right now of each other’s kids.’

    Trump made history when he became the first US president to face criminal charges.

    It is over money paid during Trump’s 2016 presidential campaign to two women who alleged they had extramarital sexual encounters with him.

    Trump has denied the allegations.

    According to Stormy Daniels, Donald Trump shouldn’t go to jail for the $130,000 in hush money payments he made to her during the 2016 presidential campaign.

    The adult film celebrity talked extensively on the former president’s arrest and court arraignment after being charged with 34 felonies during an interview with Piers Morgan.

    In a segment from the interview that will air on TalkTV later today, Ms. Daniels says she believes Trump should go to prison for his long list of alleged misdeeds, but not for the ones that include her.

    ‘Specific to my case I don’t think that his crimes against me are worthy of incarceration,’ she said.

    ‘I feel like the other things that he has done if he is found guilty, absolutely, because our bigger problem is that if these allegations against him– or whatever else that we don’t know– if he is found guilty or the evidence suggests that he is and he doesn’t [go to jail] that is going to basically, it opens the door to other people to think they can get away with doing that and worse.’

    During the candid 90 minute one-on-one, she reveals she would testify if called to give evidence as she has ‘nothing to hide’.

    ‘It’s daunting, but I look forward to it,’ she added.

    ‘I am the only one that has been telling the truth.’

    Ms Daniels said she looked forward to testifying in court as it would ‘legitimise her story’, and would be offended if she was not asked to speak during the trial.

    ‘I feel like if they don’t it paints a picture that they know something about me that makes me untrustworthy or not reliable,’ she told Morgan.

    ‘Having them call me in and putting me on the stand legitimises my story and who I am– and if they don’t it almost looks like they’re hiding me and people will automatically assume– I would– “oh she must not be a good witness.”’

    Ms Daniels first made headlines in 2018 when she spoke of an alleged affair between her and Mr Trump in 2006.

    The hush money payments allegedly occurred in 2016, just days before the presidential election, when Daniels offered to sell her story to a gossip magazine.

    Trump reportedly instructed his attorney, Michael Cohen, to make the payments to Daniels to prevent the story from going public.

    Cohen later pleaded guilty to eight criminal charges related to the payments.

    The charging documents also mention two more alleged hush money payments- $150,000 to former playboy model Karen McDougal and a $30,000 payment to a doorman at Trump Tower who claimed he had information that Mr Trump had fathered a child with a woman while married to Melania Trump.

    Mr Trump ‘repeatedly and fraudulently falsified New York business records to conceal criminal conduct that hid damaging information from the voting public during the 2016 presidential election,’ the charging documents read.

    Today, when Donald Trump makes his court appearance as the first former US president to be charged with a crime, history is likely to be made in a New York courtroom.

    A judge will take his photo, take his fingerprints, and bring the guy who oversaw one of the most powerful nations in the world for four years to court.

    It happens after he formally began his 2024 presidential campaign.

    But what specifically is the issue?

    Adult film star Stormy Daniels claims she had a sexual encounter with Trump back in 2006, the year after he married his third wife Melania who had just given birth to their son Barron.

    When the 2016 election came around, she was planning on selling her story, so Trump’s lawyer, Michael Cohen, paid her $130,000 (£105,000) for her silence.

    Trump is believed to have reimbursed Cohen more than double the original amount, but has continued to deny the affair.

    Hush money is not illegal but court documents claim that the former Apprentice star falsely listed his former lawyer’s reimbursement as ‘legal services’.

    Given that it allegedly happened as Americans went to the polls, there’s a chance it could also violate laws about payments that help an election campaign.

    In 2018, Cohen pleaded guilty to nine federal charges, including campaign finance violations, and was sentenced to three years in prison.

    What about Donald Trump and Karen McDougal?

    The new investigation into Trump is said to also be probing a second alleged payment of $150,000 (£120,000) made to former Playboy model Karen McDougal, who claims to have had an affair with Trump beginning in 2006.

    The parent company of the National Enquirer agreed to pay McDougal $150,000 (£120,000) for the rights to her story.

    But the tabloid never published her account, a practice known as ‘catch and kill’. Trump has also denied having this affair.

    It is not immediately clear whether this is definitely part of the criminal case, which remains under seal.

    What charges will Donald Trump face?

    Two sources have claimed the indictment includes multiple charges of falsifying business records, including at least one felony offence.

    But we don’t actually know yet – and we’ll hopefully find out tonight.

    To prove that Trump committed a fraudulent offence that rises above a misdemeanour, prosecutors need to present evidence that his records were intentionally falsified – and were done so with the intention of committing, aiding or concealing another crime.

    The 76-year-old is expected to be released by authorities because the charges against him do not require that bail be set.

    Unless his attorneys succeed in using pre-trial motions to get the case dismissed before it reaches a jury, there will be a trial where the billionaire can make his case.

    So what will happen with Donald Trump today?

    Trump is predicted to arrive at a Manhattan court at around 6.30am local time (11.30am UK time). 

    He is expected to be be fingerprinted and have a mug shot taken before investigators complete arrest paperwork.

    Following this, he will appear before a judge for his arraignment at around 2.15pm US time (7.15pm UK time). 

    The charges will be read and Trump will be asked to enter a plea.

    If he says not guilty, as expected, the judge will set a court date for a further hearing or a trial. 

    The former US leader is due back at his Mar-a-Lago estate in Palm Beach, Florida, at 8.15pm local time (1.15am UK time on Wednesday) where he will give a speech.

    Could Donald Trump go to jail?

    Technically, yes. The charge of falsifying business records in the first degree is a low-level felony carrying up to four years in prison.

    But first-time offenders rarely go to prison on violent, low-level felonies.

    The most likely outcomes are a fine, community service, or probation.

    If this is the case, it doesn’t mean the trial won’t matter in the long run though.

    Trump is facing a number of other criminal investigations which carry a risk of more serious criminal charges. A defendant’s prior criminal record can have an impact on sentencing. 

    What has Donald Trump said about the hush money case?

    Trump is expected to plead not guilty and has warned of potential ‘death & destruction’ if he faces criminal charges.

    He believes the New York grand jury indictment – and three additional pending investigations – are politically motivated and intended to weaken his bid to retake the White House.

    Writing on his Truth Social media site, he said: ‘What kind of person can charge another person, in this case a former President of the United States, who got more votes than any sitting President in history, and leading candidate (by far!) for the Republican Party nomination, with a Crime, when it is known by all that NO Crime has been committed, & also known that potential death & destruction in such a false charge could be catastrophic for our Country?’

    The former reality-TV star has been hyping that narrative to his political advantage, raising millions of dollars since the indictment on claims of a ‘witch hunt’.

    He has personally assailed the Manhattan district attorney, egged on supporters to protest, and claimed without evidence that the judge presiding over the case ‘hates me’ – something his own lawyer has said is not true.

    Can Donald Trump still run for president?

    Yes. There is nothing in the US Constitution that stops Trump from running to become president again.

    Even if he did go to prison, he could still – in theory – run.

    To qualify, you have to be born in America, to have been a resident for 14 years and be over 35. 

    But the case is likely to become a huge distraction amid his campaign.
