    ‘Side Chick” Deborah Seyram Adablah ordered to pay GHC10K to estranged ‘sugar daddy’ Nimako

    The High Court in Accra has ruled against Deborah Seyram Adablah, who filed a case against a former Chief Finance Officer of a bank, Ernest Kwasi Nimako, accusing him of sexual harassment.

    In the ruling on November 28, presided over by Justice John Bosco Nabarese, the court dismissed Adablah’s case, stating that although the relationship between the two was deemed immoral and against societal norms, there was no reasonable cause of action based on the filed writ.

    The court expressed that the foundation of the relationship was not one that should be endorsed judicially, stating, “You cannot recover the price of something you have committed into an immoral act.”

    As a result, the plaintiff, Deborah Seyram Adablah, has been ordered to pay a cost of GH¢10,000.

    This decision follows an application by the former Chief Finance Officer urging the court to strike Adablah’s case.

    Adablah’s initial suit, filed on January 23, 2023, alleged that Nimako, whom she referred to as her “sugar daddy,” made various promises to her, including buying her a car, covering accommodation for three years, providing a monthly stipend of GH¢3,000, marrying her after divorcing his wife, and offering a lump sum to start a business.

    The plaintiff claimed that despite the car being initially registered in Nimako’s name, he later took it back after just a year. Additionally, she asserted that Nimako paid for only one year of accommodation, despite promising three years.

    Adablah sought court orders for the transfer of the car’s title into her name, the return of the car, payment of the lump sum for starting a business, payment of the outstanding two years’ accommodation, and covering medical expenses due to the side effects of a family planning treatment recommended by Nimako.

    An Accra High Court has dismissed a lawsuit filed by a woman who claimed that her ‘sugar daddy’ failed to fulfill his promises to her and later dumped her.

    The woman, Deborah Seyram Adablah, had sued Ernest Kwasi Nimako, whom she referred to as her ‘sugar daddy’, for breach of contract.

    She alleged that Nimako agreed to buy her a car, pay for her accommodation for three years, provide a monthly stipend of GH¢3,000, marry her after divorcing his wife, and offer a lump sum to start a business.

    However, she said that Nimako reneged on his promises and took back the car he had bought for her after just a year. He also paid for only one year of accommodation, despite promising to cover three years.

    She was seeking an order from the court to compel Nimako to transfer the title of the car into her name, and also give her back the car.

    She also asked the court to order Nimako to pay her the lump sum to enable her to start a business, the outstanding two years’ accommodation, and her medical expenses as a result of a side effect of a family planning treatment he told her to do.

    The court however sided with lawyers for Kwasi Nimako, arguing that the case lacked merit. The legal representatives from Kulendi@Law contended that Adablah failed to disclose a reasonable cause of action and that any contract she sought to enforce was not legally binding.

    The court concurred with Nimako’s counsels, stating that no substantive issue was raised by Adablah in her suit.

    The case has generated a lot of public interest and debate on social media, with some people condemning the actions of both parties, while others sympathising with the woman or the man.

    The High Court in Accra has ruled in favor of First Atlantic Bank, dismissing the case brought by former National Service Person, Deborah Sayram Adablah. She had accused the bank and its former Chief Finance Officer, Ernest Kwasi Nimako, of sexual harassment.

    Under the jurisdiction of Justice Olivia Obeng Owusu, the Court ordered Deborah Sayram Adablah (the Plaintiff) to pay a compensation of GHc6,000 to First Atlantic Bank as part of the ruling.

    This was after the lawyers of the First Atlantic Bank had requested for GHc50, 000 and the Plaintiff offered to pay GHc5,000.

    Adablah, dragged Ernest Kwasi Nimako, a former Chief Finance Officer (First Defendant) and the bank (Second Defendant) to court and alleged among other things sexual harassment.

    Lawyers of the Bank filed a motion to have the name of the Bank struck out of the case.

    In a ruling on the motion on Friday July 21, the Court Presided over by Justice Olivia Obeng Owusu struck out the name of First Atlantic Bank from the case.

    Meanwhile, Lawyers of the Plaintiff (Deborah Adablah) had on June 15, 2023 filed a motion to set aside the ruling of the Court for execution and order for preservation of the Vehicle which is one of the subject matters in dispute.

    On the other hand, lawyers of Kwasi Nimako have also filed a contempt case against Adablah for certain publications made after the court had barred the parties from doing so.

    Background

    Adablah who is the plaintiff filed a writ alleging sexual harassment against Ernest Kwesi Nimako, former Chief Finance Officer and the bank.

    Following the action, the Bank has requested that its name be withdrawn from the lawsuit filed by the former NSS worker.

    In that application dated January 24, this year, the Bank requested that seven paragraphs of the writ be dismissed “on the ground that they disclose no reasonable cause of action against the applicant.”

    It contends that Paragraphs 7,8,9,10,11,31,32,33,34,36 and 37 which were requested to be excluded comprise portions of the writ that accuse the bank of watching on for female workers being harassed sexually by senior male officers of the bank.

    The substantive case alleging sexual harassment against Kwasi Nimako would be dealt with after this preliminary application.

    The High Court in Accra is set to announce its verdict in a compelling legal dispute involving Deborah Seyram Adablah, the plaintiff. She has filed a lawsuit against Ernest Kwasi Nimako, the chief finance officer of a bank, claiming that he did not uphold a previously agreed commitment to support her well-being.

    As reported by graphic.com.gh, during the last court hearing on Tuesday, May 16, 2023, Justice Olivia Obeng Owusu instructed Deborah Seyram Adablah to hand over a contested Honda Civic vehicle valued at GHC120,000 to the Court Registrar.

    The vehicle had been at the heart of the legal contention, and the court decided to retain possession until the case’s final resolution.

    Subsequently, the Court Registrar, with assistance from the Police, retrieved the vehicle from the plaintiff’s residence.

    Deborah Seyram Adablah filed her lawsuit on Monday, January 23, 2023, alleging that Ernest Kwasi Nimako, whom she referred to as her “sugar daddy,” made several promises to her.

    According to the plaintiff, Nimako agreed to purchase the car for her, cover her accommodation expenses for three years, provide a monthly stipend of GH¢3,000, marry her after divorcing his wife, and offer a lump sum to establish a business.

    The plaintiff contends that although the car was initially registered in Nimako’s name, he later reclaimed it, depriving her of its use after only one year.

    Furthermore, she alleges that Nimako only fulfilled one year of accommodation expenses, despite promising to cover a three-year period.

    In Justice Obeng Owusu’s ruling, Ernest Kwasi Nimako was directed to submit all documents related to the disputed vehicle to the Registrar of the High Court.

    Additionally, both parties were instructed to refrain from making any public statements concerning the case via social or traditional media.

    The pending judgment has aroused keen interest from both parties, as it will determine the outcome of the case and address the allegations leveled by Deborah Seyram Adablah against Ernest Kwasi Nimako.

    The case in which a woman has sued the chief finance officer of a bank for allegedly breaching an agreement to take care of her came up once more at the High Court in Accra with tangential issues hanging in the way of the substantive matter.

    At the court’s first hearing, the presiding judge, Justice Olivia Obeng Owusu, had ordered the parties in the case to file their written submissions to enable the court to delve into the substantive matter.

    However, when the case was called yesterday, lawyers for the man sued by Deborah Seyram Adablah had filed an application seeking leave to file a supplementary affidavit in support of their written submission.

    Counsel for Ernest Kwasi Nimako, a Chief Finance Officer of the bank where the young woman did her national service and has made sexual harassment claims against in her suit, notified the court about the application.

    However, counsel for the plaintiff, Mohammed Attah, told the court that his client had also filed an application seeking to oppose the application filed by Nimako.

    Counsel argued on grounds that lawyers for Nimako failed to state precisely the paragraphs of his affidavit they wanted to respond to. 
    He added that Nimako’s lawyers ought to have filed the supplementary affidavit as of right because that was the practice.

    Mr Ernest Kwasi Nimako, the First Atlantic Bank CFO who has been trending on the internet for the past 72 hours has allegedly been sacked by his employers according to information from a trusted source.

    It was obvious that the bank was going to throw him to the wolves when the writ of summons from his ex-side chick Debby found its way on the internet denting not only his reputation alone but that of the bank as well because it was dragged into the lawsuit.

    Prior to this, First Atlantic Bank unofficially reacted to the news of the suit against its CFO in the person of Mr Ernest Kwasi Nimako.

    The feat via e-mail was sent to a blog (MyNewsGH) over a publication of the CFO – Side Chick story, the Bank’s representative, James Christopher, indicated that the information circulating is fake.

    Both Mr Ernest Kwasi Nimak and the bank are yet to drop official statements but Deborah Seyram has refused to cease fire as she keeps dropping jabs day in and day out.

    Many people were outraged by the gentleman’s decision to date a National Service Personnel when he clearly had an adorable woman at home.

    “How do you cheat on such a prestigious woman?” “What do men really want?” This is one of the many questions people have been asking.

    Belinda Afriyie Nimako is a medical doctor with nine years experience spanning clinical work, project management, research, undergraduate training and leadership, in the public sector. She is a product of Wesley Girls’ High School and The University of Ghana Medical School.

    After graduating top of her Master of Public Health class, she chose to work in Ghana’s rural districts, using her knowledge and skills where they were needed most.

    Now, as the Acting Director of Health Services for South Dayi, Belinda leads a 124-person team to design and implement policies and projects and provide clinical care for about 53,000 predominantly rural inhabitants.

    She has been involved in developing an undergraduate program in public health for the University of Health and Allied Sciences in Ghana. Belinda also compiled a supplement on severe malaria for the World Health Organization. She currently serves on the Board of Ghana’s Food and Drug Authority.

    A former female member of the national service has filed a sexual harassment lawsuit against the First Atlantic Bank and its Chief Financial Officer, Ernest Kwasi Nimako.

    The plaintiff, Deborah Seyram Adablah, stated in her writ of summons that during her national service at the bank, she entered into a ‘parlor relationship’ as a result of persistent sexual harassment and abuse by Ernest Kwasi Nimako.

    According to her, Ernest Kwasi Nimako was her superior in the capacity of the Chief Financial Officer at the bank.

    Hence, failure on her part to accept Mr. Nimako’s sexual demands meant her days at the bank were going to be miserable.

    In her writ, she also alleged that virtually every senior manager has a girlfriend in the bank, and they change the ladies at their will, to the knowledge of the managers of the bank.

    She reiterated that failure on the part of the female staff to give in to their demands would mean they would be bullied by their bosses.

    Miss Adablah narrated that she was convinced by Ernest Kwasi Nimako not to take up a contract with the bank after he assured her of “a lump sum of working capital, a car, paying her accommodation for 3 years; GHC3000 a month, a promise to marry her after divorcing his wife, and a ring, among others.”

    The plaintiff alleges Ernest Kwasi Nimako stopped paying her rent and monthly allowance after they had some differences.

    She is therefore seeking an order from the court to direct Ernest Kwasi Nimako to transfer the title of car no GC 7899-21 into her name.

    She is also seeking a refund of the cost of repairs of over GHC10,000, which he promised to refund but failed to do.

    She also wants Ernest Nimako to pay a lump sum of money to enable her to start a business to take care of herself, as agreed by her and the defendant, among others.

    First Atlantic Bank is yet to respond to these allegations.
