  • 4 more arrested for role in train accident during test run

4 more arrested for role in train accident during test run

Four more individuals have been arrested by the police for their alleged involvement in last week’s train accident at Abortia in the Volta Region.

The individuals are Kokou Koudjo, a 34-year-old welder, Patrick Kwaku Sosu, a 52-year-old laborer, Alaza Prosper, a 28-year-old laborer, and Fiadugbe Emmanuel, a 31-year-old laborer.

They have been charged with “abetment of unlawful damage” for allegedly aiding Abel Adzidotor, the driver of the truck that caused damage to a Diesel Multiple Unit train.

During the court proceedings presided over by Justice Mrs. Lydia Osei-Marfo, the accused persons were not required to enter a plea. They were remanded into police custody pending further investigations.

The prosecution, led by Christabel Selma Anafure, Assistant State Attorney, requested the court to remand the accused persons into police custody due to ongoing investigations.

The court granted the prosecution’s request and asked the accused persons to secure legal representation by the next adjourned date.

According to the prosecution, the accused persons were on board a Hyundai Gold Truck on April 18, 2024, driven by Abel Adzidotor.

Preliminary investigations revealed that Koudjo purchased blocks from a block factory at Juapong and transported them to Abortia using the underpass of the railway lines. After unloading the blocks, they attempted to cross the railway lines with the vehicle to avoid the underpass.

However, the truck still got stuck on the railway line, and “the accused persons tilted the head of the truck and left the scene without providing any warning for trains plying the tracks.”

According to the prosecution, investigations revealed that there was no access route across the railway tracks connecting the Juapong road.

Even if the truck had managed to cross the railway, a large gutter on the west side of the railway lines would have blocked the accused persons from connecting to the Akuse-Juapong road.

The court heard that on the same day, the management of the Ghana Railway Corporation, led by the complainant and 28 engineers from Ghana and Poland, conducted a test run of the new Diesel Multiple Unit (DMU) Train from Tema to Mpakadan.

“This test run had been announced ahead of time. When the train got to the Abortia area, it rammed into the Hyundai Gold Truck, which was stuck across the railway lines.

“Both the train and truck got damaged. The train was sent to Tema for examination while the scrap of the vehicle, which was damaged beyond repairs, was taken to the Juapong Police Station for further action,” the prosecution said.

The prosecution stated that the accused persons were aware that the railway lines were not accessible to motor vehicles but still decided to use them as a shortcut. They placed stones on the railway lines to create a path for the truck to cross over.

Nkawkaw school bus accident: Municipal Education Director commiserates with bereaved families

The Municipal Education Director for Kwawu West Municipality, Mr. George Yankyera, has visited the families affected by the recent school bus accident at Nkawkaw Nankyea in the Eastern Region.

He expressed his deepest sympathies and provided support to the grieving families, as well as visiting the school affected by the accident and the hospitalized individuals.

The Education Directorate had previously advised the school to replace their bus due to its poor condition, but unfortunately, this advice was not followed, leading to the tragic incident.

The accident involved a Nissan Patrol vehicle, reportedly the official vehicle of the District Chief Executive for Atwima Kwanwoma in the Ashanti region, Prince Karikari.

Eyewitnesses stated that the driver attempted an unauthorized U-turn while driving on the shoulders of the road from the Accra-Kumasi direction near Nanchia. All the victims, including a female teacher identified as Dorcas Dede, succumbed to their injuries while receiving treatment at the Holy Family Hospital in Nkawkaw.

Mr. Yankyera emphasized the importance of adhering to safety recommendations and expressed concern that the prior advice on the school bus was not heeded. Investigations into the circumstances surrounding the accident are ongoing.

Bigger disaster looms if unauthorised access points to Accra-Kumasi Highway is not checked – Kwahu East MCE

The Municipal Chief Executive (MCE) for Kwahu East in the Eastern Region, Yaw Owusu Addo, has raised concerns about increasing accidents on the Nkawkaw stretch of the Accra-Kumasi highway.

He called for immediate measures to block unauthorized access points to the main road to prevent further accidents.

Mr. Addo’s concerns were prompted by a tragic incident on Thursday, February 15, which resulted in the death of three male pupils and a female teacher from the Ampeah Memorial School in Nkawkaw.

The fatal accident involved a Nissan Patrol vehicle believed to be the official vehicle of Prince Karikari, the District Chief Executive for Atwima Kwanwoma, which crashed into a Hyundai minibus.

According to an eyewitness, the driver of the bus attempted an unauthorized U-turn while driving on the shoulders of the road from the Accra-Kumasi direction at a spot near Nanchia.

Mr. Addo expressed frustration, stating that despite his efforts to address the issue and curb accidents on the stretch, he has been unsuccessful in persuading the highway authority to effectively tackle the problem.

“Since I became the MCE, we have also been raising that issue, but it is not an issue we can tackle single-handedly at the municipal level. We need bigger support to deal with the situation there, but I know there is a bigger disaster waiting to happen if we do not take action,” he said.

Accident victims can claim benefits from insurance company within 3 years – Lawyer

A Lawyer and Chartered Insurer, Jeffery Koranteng, has clarified the timeframe within which individuals injured in a road accident can file a claim with their insurance company.

According to him, those injured have a three-year window to submit their claims, while minors and individuals with disabilities have up to six years.

During an appearance on The Law, he elaborated on the reasons behind these limitations, emphasizing that victims often face challenges making immediate claims due to injuries sustained during accidents.

Mr Koranteng explained, “So within three years after the loss, if you have suffered an injury and then you are hospitalized or anything, I mean…, you are not able to report. You still have within three years within which to bring the claim.”

He stated that “If somebody is a child or somebody is of an unsound mind, we call that a disability in law. So even though there’s a three-year period within which you can bring the claim, if you’re under some form of disability, then the period of limitation does not run until you are out of that disability.”

“So if you were a child, for example, that means you are below the age of 18, so that that period of limitation, which is three years, does not start to run until you come out of that disability. And if you’re out of unsound mind, that same information applies to you,” he noted.

Concerning property damage, Mr Koranteng noted that individuals have a six-year timeframe to make a claim for damages resulting from the accident.

However, he cautioned accident victims against actions that could lead to the rejection of their insurance claims.

He advised drivers to obtain the appropriate licenses for their vehicles and emphasized the importance of reporting accidents promptly to the police.

“I have a B license and I’m driving a vehicle that requires a C license, I’ve not been trained or certified by DVLA to drive that kind of vehicle.”

Additionally, he urged victims to document the scene with photos and videos and report the issue to their insurance company before making any repairs, as fixing the vehicle without approval could complicate the assessment of the extent of damage.
