  • “Shocked” Minority demands public inquiry into demolition of Nigeria High Commission property

The minority in Parliament is demanding a public inquiry into the demolition of a property allegedly belonging to the Nigeria High Commission in Ghana.

According to the Minority, the act is one with the potential to mar the existing diplomatic relations between Ghana and Nigeria hence the need to investigate how such an action could occur.

Samuel Okudzeto Ablakwa in a statement Monday morning said it is neccesary “to unravel the facts of the matter and bring the perpetrators to book”.

He continued, “the Government of Ghana must not underestimate the implications of this reckless act of unprovoked aggression not only for Ghana-Nigeria relations but also the negative reverberations in larger diplomatic quarters.”

  • Nigeria and Cameroon declared polio free

The World Health Organization (WHO) has certified Nigeria and Cameroon to be free of polio, a crippling disease that usually affects children under five.

Afghanistan and Pakistan are now the only countries with cases of the wild polio virus.

The UN health agency is expected to formally present Nigeria with a certificate and also declare Africa free of the wild polio virus.

Nigeria’s head of primary health care agency Dr Faisal Shuaib described the achievement as a “proud moment for us and indeed all Nigerians”.

Cameroon’s Health Minister Malachie Manaouda had on Wednesday announced that the country had been certified free of polio.

Health experts in the country welcomed the development but urged caution.

For a country to be declared polio-free it must ensure high immunisation coverage and prove there have been no transmissions for at least three consecutive years.

It should also maintain a surveillance and outbreak preparedness system.

An airline in Nigeria has apologised to the aviation minister for flying musician Naira Marley on Saturday from the commercial hub, Lagos, to the capital, Abuja, to perform in a concert

The Executive Jet Company was suspended by the minister for facilitating what was classed as non-essential travel and was against the government’s recommendations to fight the spread of coronavirus.

In an apology letter to the aviation minister, the airline’s CEO, Sam Iwuajoku, said the flight had been initially booked for a judge on Sunday who then made other travel arrangements.

Mr Iwuajoku said in the letter that he had approved the flight on Saturday after reviewing the passenger manifest and thought one of them was a government minister.

“I saw Fashiola Babatunde, I thought it was the Honourable Minister for Works with his men, so we decided to do the flight since [it was] a serving minister of the Federal Republic of Nigeria, I didn’t know that it was a bunch of useless people,” Mr Iwuajoku said.

  • Nigeria records ‘one rape every five hours’

There were 717 rapes in Nigeria between January and May this year, amounting to one rape every five hours, the country’s police chief says.

Mohammed Adamu described rape as a serious and wicked offence and urged Nigerians to report any case.

Speaking to journalists after meeting President Muhammadu Buhari at the presidential palace in Abuja, the police chief said that 799 suspects had been arrested and 631 had appeared in court.

But Mr Adamu did not speak about the sentences or number of convictions. Activists are concerned that not many trials result in someone being found guilty.

Some of the recent victims were allegedly murdered after being raped prompting a series of protests across Nigeria demanding action from the authorities and communities.

The police chief said security agencies are partnering with non-governmental organisations in the areas of training, working with victims and evidence gathering for successful prosecutions as part of efforts to tackle the issue.

  • Buhari confident on Nigeria’s economy

Nigeria’s President Muhammadu Buhari is optimistic on the country’s economy, the largest in Africa, despite the impact of the coronavirus pandemic.

Mr Buhari says the pandemic has had a “moderate” effect in the country compared to other economies around the world.

Nigeria heavily relies on oil revenues and the economy has been struggling following the sharp fall in global oil prices.

Many Nigerians are complaining of massive job loses and extreme poverty.

Mr Buhari, in a televised address to mark Democracy Day, said the government is employing 700,000 people under a Special Public Works Programme to build roads and clean up the environment.

In April the International Monetary Fund (IMF) approved $3.4bn emergency funding for Nigeria, the largest loan to an African country to assist in dealing with the pandemic.

But there are ongoing discussions to cut basic healthcare budget by almost half, as the country struggles with the pandemic.

President Buhari also said he was upset by the recent spike of gender-based violence, describing the incidents as “heinous crimes” and assured that the perpetrators would be brought to justice.

  • Nigeria projects 39.4m job losses by end of year

A team charged with developing Nigeria’s economic recovery plan from the coronavirus pandemic says about 39.4 million people could be jobless by the end of 2020 if government fails to act.

The Committee on Economic Sustainability Plan, led by Vice-President Yemi Osinbajo, said restrictions imposed to prevent the spread of coronavirus had mainly affected agriculture, manufacturing and tourism sectors.

It said the dip in the nation’s oil earnings would result in a $473m (£375m) shortfall every month.

The committee presented its economic plan to President Muhammadu Buhari on Thursday.

Among its recommendations is the rolling out of mass programmes that create jobs and and utilise local materials in agriculture, housing and road construction.

Nigeria’s Lagos, Abuja and Ogun states were put on lockdown that ended in May to prevent the spread of coronavirus.

The country has so far confirmed 14,554 cases of coronavirus.

  • Nigerian men arrested for raping 12-year-old girl

Twelve men have been arrested in Nigeria, accused of repeatedly raping a 12-year-old girl over a two-month period.

Police in the north-western state of Jigawa were alerted to the alleged crime when they received a complaint about a man in his 50s luring the girl to a hidden place so he could have sex with her.

During a police interview the girl said that 11 other men had also raped her.

She is now in hospital and police have told the BBC there is medical evidence of rape.

The incident follows the killings in the last week of two young women that have sparked widespread anger.

In one case, the family of 22-year-old student Uwavera Omozuwa say she was raped inside a church and bludgeoned to death with a fire extinguisher in the city of Benin.

In the other, a 16-year-old was shot dead by a policeman in Lagos.

Amnesty International has said that although rape is a crime in Nigeria, the rising number of attacks is due to the failure of law enforcement.

The country has an extremely low conviction rate for rape and sexual abuse.

  • We were once approached by Nigerians to aid a robbery – Street boy alleges

Young Collins Amankwah, who happens to be a street boy in the busy city of Accra as a result of a broken home and its bizarre consequences, has narrated his rather sad and risky experience on the streets.

In an interview with Benabi Discovery, Collins made a shocking revelation that, in carrying out his means of livelihood on the streets, some Nigerians tried to convince him and his colleagues to join in a robbery operation; displaying guns in the process. Collins and his friends declined this offer anyway knowing the dangers of armed robbery.

Collins Amankwah has spent thirteen years on the street, having joined this risky venture at a tender age of nine years as an orphan.

In his narration, Collins Amankwah also uttered the fact that he’s been to school by the assistance of an NGO named 8pm foundation. With less support from government, this great path of Collins came to an abrupt end when he got to SHS two.

As a result, young Collins Amankwah returned back to the streets to continue his usual “windscreen” cleaning business to make a living.

On the streets, Collins and his team were offered some cash by a benevolent “client” to share among themselves.

“My senior colleague gave me a deep cut with scissors, when a scuffle ensued between us”. This Collins said by displaying a wound in the process. ‘survival of the fittest’ kind of life.

Young Collins also reiterated that social vices are temptations most of his colleagues find difficult to resist sometimes when the going gets tougher. So the possibility of a street boy to engage in armed robbery and other social vices is high.

Speaking to Benabi discovery, Collins Amankwah, has dreams to join the army. He hopes to be a Soldier one day; having gone through the hardships and toughest moments for thirteen solid years on the streets.

  • Nigerian wedding guests flee coronavirus raid

A pastor in Nigeria’s southern city of Calabar has been arrested for breaching lockdown rules by conducting a wedding in his church.

In a video, guests can be seen fleeing as officials entered the building.

The pastor, from the Apostolic Church, was arrested on Saturday by members of Cross River state’s Covid-19 taskforce who were on patrol. They got suspicious after seeing an unusual number of vehicles parked in front of the church.

“We were patrolling to see the compliance level when we noticed cars parked and it had me wondering where the cars had come from,” Potrait Peterson, the leader of the patrol team told BBC Pidgin.

He said when his team entered the church, they found more than 300 people gathered, in violation of social distancing guidelines in the state.

The state is one of only two in Nigeria yet to record any case of coronavirus and authorities had banned public gatherings of more than five people. The state was also one of the first in Nigeria to make face masks mandatory in public.

  • Two Chinese nationals arrested in Nigeria over N100 million bribe

The Sokoto State office of the Economic and Financial Crimes Commission (EFCC) of Nigeria has arrested two Chinese nationals Meng Kun and Xu Koi for allegedly attempting to bribe the head of EFCC zonal office, Mr. Abdullahi Lawal with N 100 Million.

The suspects were arrested in Sokoto with the cash as evidence.

The commission said the bribe was offered its Sokoto zonal head to compromise investigations into the operations of China Zhonghao Nig. Ltd, a company the two arrested persons work for.

The Chinese owned company, China Zhonghao Nig. Ltd, is under investigations following two contracts awarded by the Zamfara state government to the company to construct township roads in Gummi, Bukkuyun, Anka and Nassarawa in Zamfara State and the construction of 168 solar powered boreholes in the 14 local government areas of the state.

The EFCC said the investigation is as a result of intelligence gathered on alleged conspiracy, embezzlement and money laundering against the Zamfara State.

The construction company had reportedly received payments of over N 41 billion “but diverted about N 16 billion which the commission has traced to some bureau de change operators”.

Worried by the professional conduct and consistency of the investigations, China Zhonghao Nig. Ltd reached out to Abdullahi Lawal and offered him N 100 Million bribe to “bury the matter”, the EFCC statement said.

The first installment of a total of N 100 million was paid by the two arrested representatives of the company in cash contained in 4 table water boxes.

“In a grand design to trap the corrupt officials, Lawal played along and on Monday, two representatives of the company, Meng Wei Kun and Xu Kuoi, offered him cash totaling N 50 million in their office along Airport Road, Sokoto.

This adds to the tall list of Chinese corruption in Africa and brings to light the extent of the canker in many African countries by some Chinese investors.

Instances of Chinese business involved in corruption and other forms of illegality in Africa is not a new phenomenon as many African countries with poor, weak and corrupt systems create a safe haven for such wickedness to go on.

Ghana, Nigeria, Congo and many other mineral-rich African countries continue to battle the influx of Chinese illegal mining activities obviously perpetuated with high success with the connivance of indigenes.

On 28th April 2020, Nigeria police in Zamfara arrested some Chinese nationals for engaging in illegal mining activities. They were later transferred to Abuja for prosecution. The News media in Africa is awash with similar illegalities perpetuated by Chinese nationals in different African countries.

The action taken by the EFCC zonal office in Sokoto state and the conduct of its Zonal head, Mr. Abudullai Lawal in particular is not only commendable but also heroic and patriotic.

Many on the continent are praising officials in Sokoto state for standing up to such high temptation and enforcing the law but how many officials in Africa are willing to this?

African governments must sit up and demand respect for anti-corruption laws by enforcing the laws without fear or favor of nationality or status as investors.

  • Nigeria impounds British plane for breaking Coronavirus flight ban rules

Nigeria impounded a plane operated by a British company for allegedly contravening a flight ban imposed to prevent the spread of the coronavirus, the aviation minister said on Sunday.

Passenger flights into the country, with the exception of ones to evacuate people or repatriate Nigerian citizens, have been banned for weeks. The ban will remain in place until at least June 4.

Aviation Minister Hadi Sirika said on Twitter on Sunday that a plane had been impounded after the rules were broken.

Sirika said a UK company “was given approval for humanitarian operations but regrettably we caught them conducting commercial flights”.

The message added: “The craft is impounded, the crew being interrogated. There shall be the maximum penalty.”

James Oduadu, an aviation ministry spokesman, told Reuters later in a telephone interview that the plane was operated by a company called FlairJet.

FlairJet, a British private charter company that is an affiliate of Flexjet, in a statement, said the matter was an “evolving situation”.

  • Reduce salaries of appointees, sell presidential jets – Atiku tells Nigerian govt

Former vice president, Atiku Abubakar has advised the Nigerian Government to reduce the salaries of political appointees and sell some presidential jets as a way out of the economic quagmire the country finds itself.

In an article titled “Nigeria Cannot Afford Luxuries During an Austerity”, Atiku stated that “the best way out of this economic quagmire is to reduce our expenditure”.

He also pointed out that the current budget the country is running on was formed according to a projection on crude oil which is no longer the case.

The statement reads: “It is to my consternation that despite the crash in the price of oil, and the inability of Nigeria to expand our revenue base through the non-oil sector, the FG of Nigeria has only seen fit to slash our budget by a mere 0.6%. This represents a reduction of only ?71 billion.

“Putting politics aside, this is grossly insufficient and betrays the fact we have lost touch with the current realities in the global political economy.

“For the avoidance of doubt, when this budget was presented to the National Assembly on Tuesday, October 8, 2019, it was predicated on a projection that our nation would generate crude oil production of 2.18 million barrels a day, at an expected oil price of $57 per barrel.

“Today that is no longer the case. Both our production, and the price of oil have been severely affected by the coronavirus pandemic, to the extent that we have unsold vessels, and our income has tanked by more than 50%.

“Given that this is the case, how can anyone justify a reduction in expenditure of just 0.6%? We cannot be the only nation bucking the trend?

“Saudi Arabia, a nation with a much stronger production capacity than ours and with a larger global market share, as well as a foreign reserve that is 12 times ours, has slashed her budget by almost 30%. Ditto for other oil economies.

“Nigeria cannot make up for the loss of expected revenue by taking out more loans and issuing out more bonds. Debt will be the death of our economy, and bonds will put our people in bondage.

“The best way out of this economic quagmire is to reduce our expenditure. And a 0.6% reduction is no reduction. It is only window dressing.

“My counsel to Nigerian Government is this: put Nigerians first and cut your coat, not according to your size, but according to your cloth.

“Realistically slash the budget. Every pork barrel has to go. The billions budgeted for the travels and feeding of the President and Vice President has to be reduced. The ?27 billion budget for the renovation of the National Assembly has to go.

“The massive budgets to run both the Presidency and the Legislature has to be downsized. The budget for purchasing luxury cars for the President, his vice, and other political office holders must be abandoned.

“Leave the salaries of civil servants alone, but reduce the salaries of political appointees. Sell 8 or 9 of the jets in the Presidential Air Fleet.

“Any budget slash that is less than 25% will not be in the interest of Nigeria.

“And beyond a budget slash, Nigeria needs a budget realignment, to redirect expenditure away from running a massive bureaucracy, into social development sectors like education, infrastructure, and above all, healthcare.

“We must invest in the goose that lays the golden egg – the Nigerian people.

“These are the types of sacrifices that we need in a time of crisis. We do not need empty gestures that will lead to empty treasuries.

“In times of austerity, no nation, not the least a mono-product economy, such as ours, should be living in luxury at a leadership level”.

  • ‘Unusually high’ deaths in Nigeria raise queries

The authorities in the north-eastern Nigerian state of Yobe say 471 people have died in the past five weeks, adding it is an unusually high number of deaths from health issues.

It is not clear whether the deaths are linked to coronavirus

Nigeria has so far confirmed nearly 5,000 cases of the virus, with 164 deaths.

Yobe State Commissioner for Health Muhammad Lawan Gana told the BBC that an initial investigation found most deaths were of elderly people with pre-existing medical conditions such as hypertension and diabetes.

But some had shown symptoms of coronavirus.

He said the deaths occurred in just four areas of the state.

There have been reports of hundreds of unexplained deaths across northern Nigeria in recent weeks – including in the populous state of Kano.

The authorities are cautious to link them directly to the coronavirus pandemic, saying investigations are being carried out.

Low testing rates across Nigeria are raising fears that many people might be carrying the virus undetected.

  • Nigeria virus patients protest against ‘poor care’

Dozens of coronavirus patients held a protest outside a treatment centre in the north-eastern Nigerian state of Gombe, saying the authorities were not taking good care of them.

The patients complained of lack of drugs and proper feeding.

They mingled with members of the community during the Tuesday evening demonstration and blocked a nearby highway in the village of Kwadon – about 8km (five miles) from the state capital.

The state’s health commissioner, Ahmed Gana, told the BBC that the patients were asymptomatic and did not require drugs. The authorities also deny the allegation about a lack of proper feeding.

Officials later persuaded the demonstrators back into the treatment centre, but are worried about a possible spread of the virus to villagers who came out to witness the protest.

They have urged those who might have contacted the protesting patients to self-isolate for at least 14 days.

Gombe state has so far confirmed about 100 coronavirus cases against a national tally of 2,950.

  • Malawi opposition leader in buoyant mood

Lazarus Chakwera, the leader of Malawi’s main opposition party, the Malawi Congress Party, has named the country’s sitting Vice-President, Saulos Chilima, as his running mate as he seeks to wrestle power from incumbent President Peter Mutharika in fresh presidential elections slated for 2 July this year.

Mr Chakwera was buoyant as he presented his nomination paper to the election management body, the Malawi Electoral Commission, in the commercial capital, Blantyre.

Malawi will hold a fresh presidential vote after last May’s re-election of Mr Mutharika was nullified by the country’s Constitutional Court.

Mr Chakwera, who came a close second in the annulled vote, is leading a coalition of nine opposition parties, including the UTM party formed by Mr Chilima after he fell out with the president.

Mr Chilima came third in the annulled vote.

While the governing Democratic Progressive Party is keen to delay the vote, citing the emergence of Covid-9, there is a clear determination by the opposition to let the elections go ahead.

  • 22-year-old man stabbed to death in Nigeria over face mask

Tragedy struck at the Coca Cola Market in Onitsha, Anambra State, yesterday, when a 22-year-old man, Mr Cletus Chisom, was reportedly stabbed to death by a security guard monitoring the use of face mask in the market.

The suspect, Ibuchi Nwoju, who hails from Abia State, but resides in Onitsha, allegedly committed the offence following an altercation with the deceased.

An eye witness said the sister to the deceased was at the market with her mother to purchase some items when the suspect stopped her from entering the market for failure to put on a facemask.

Her mother was said to have later bought the facemask for her daughter after the suspect insisted she would only be allowed access to the market with a facemask.

However, trouble was said to have ensued after the girl reportedly rushed home and returned with her elder brother, who confronted the suspect. The witness said it was during their argument that the suspect drew a knife and stabbed the deceased in the chest, leading to his death.

Anambra State Police Public Relations Officer, PPRO, Mr Haruna Mohammed, who confirmed the incident, said the Commissioner of Police, Mr John Abang, has ordered for immediate transfer of the case to the State CID, Awka for investigation.

  • West Africa’s largest water park sets to launch in Nigeria

The largest water park in West Africa, Park Vega is set to launch in Nigeria.

Park Vega is a member of International Association of Amusements & Attractions ( IAAPA) and WWA World Waterparks Association(WWA) and acclaimed to be the first international standard water park in Nigeria and West Africa.

Experts’ ratings show that the park boasts internationally recognised features and standard facilities of a water park that ranks it matchless. These include: multiple water slides for adults and children, wave pools and splash pad, amongst others.

Speaking on the project, Public Relations Officer of the park, Anthony Elikene stated that the park which is sited at Delta state has answered government’s call for economy diversification and put Nigeria and West Africa on global tourism map.

He said, “This is long overdue. Nigerian families deserve to experience undiluted fun without worrying about getting passports, visas and scaling through immigration from both ends. The park is equipped with the best in class equipment compared with any international standard water park in the world. We aim to provide the best day ever experience for friends and family seeking fun, excitement and bonding.”

Describing the park further, Elikene said , “Sitting on 1,500m2 and containing close to half a million gallons of water, the wave pool mimics the ocean waves by pneumatically producing waves up to 1.1m height. It is the most up to date technology in the international market and the centrepiece of the waterpark, offering hours of splashing fun for all ages and swimming levels.

“Park Vega’s adult slides are aptly named: space-hole slide, free-fall slide, multi-surf slide, and black hole – wave combo slide. These slides offer different experiences to riders. The space hole slide is probably a favourite slide to many because of the twists and turns before being thrown into a jumbo bowl where centrifugal forces keep guest riders high on the wall for several rotations, then they are plunged into a slash pool.

“Whether sitting on an inner tube with a friend or riding solo, this slide is so much fun that there are repeat rides.

The multi-surf slide takes riders on an electrifying head-to-head competition over a series of gut-wrenching bumps propelling guest riders to the finish line to see the fastest.

“This ride was installed for our competitive guests to enjoy a high-volume of fun.

The freefall slide packs an extremely thrilling slide that gives riders a momentary feeling of weightlessness and pushes fun-seekers valour to the limits. We believe that the youths will be drawn to this slide.

“The freefall-slide is designed to have an extra enclosed tube at the top to build anticipation, this is a perfect recipe for those who appreciate the adrenaline rush.”

He said, “Blackhole-wave combo slide both add remarkable experience to the traditional waterslide. It features a steep drop that takes riders up a nearly vertical wall for a moment of weightlessness before they are swish-swashed down to the shutdown lane.

“With this slide, guests can enjoy their double raft while sharing laughter with family and friends. The children will experience a very colourful aqua tower and splash pad fitted with over 50 interactive elements such as tipping bucket, bubbler jets, slides, umbrella jets, water guns, water wheels, the pipe falls, net bridge, net climber etc. The kid’s pools have very shallow depth and are finished with anti-slip tiles for all-day safe play.

“There is also an activity pool which has an obstacle course, water volleyball and water polo for activity fanatics. In addition to all these, Park Vega has a swim-up bar that offers cocktails and mocktails.”

  • Nigerian government demands bank records of 60 companies, individuals from U.S. banks

The Nigerian government is demanding records of 60 companies and individuals from 10 banks in the United States as part of its efforts to overturn the controversial $9.6 billion P&ID fine.

Among the individuals whose bank records are being sought are a former Nigerian president, Goodluck Jonathan; his wife, Patience Jonathan; among others.

Earlier in the week, a Bloomberg report showed how Nigeria was seeking documents from banks, including Citigroup Inc. and JPMorgan Chase & Co., in a bid to overturn a $9.6 billion arbitration award.

Nigeria has asked a federal court in New York for permission to subpoena information about transactions involving government officials, including Mr Jonathan and his wife. The politicians were in office when the state signed a contract with Process & Industrial Developments Ltd., and later became involved in a costly dispute with the company.

“There is good reason to believe that ministers at the highest level were involved in a corrupt scheme to steal money from Nigeria,” Attorney General Abubakar Malami said in court filings submitted on March 24.

Nigeria’s chances of annulling the giant penalty lie on proving the 2010 gas supply arrangement was a sham designed to fail by P&ID and government officials.

The saga became a full-blown crisis for Nigeria last August when a U.K. judge ruled P&ID could enforce an arbitration tribunal’s 2017 ruling, now totaling $9.6 billion including interest, which found the country breached the agreement.

PREMIUM TIMES has now obtained a copy of the subpoena filing detailing names of the banks, the companies and the politically exposed Nigerians whose bank records are being sought.

The filings were done by Alexander Pencu, a partner of Meister Seelig & Fein LLP, attorneys for the Federal Republic of Nigeria and Abubakar Malami, the Attorney General of the Federation and Minister of Justice of Nigeria.

Mr Pencu listed the banks involved to include “Citibank, N.A. (“Citibank”) , Allied Irish Banks plc (“Allied Irish”), HSBC Bank USA (“HSBC”), Standard New York, Inc. (“Standard New York”), Deutsche Bank Trust Co. Americas (“Deutsche Bank”), J.P. Morgan Chase (“JPMorgan”), United Bank for Africa (“UBA”), Bank of Cyprus, Fortis Private Banking Singapore Limited (“Fortis”), and Standard Chartered International (USA) Ltd. (‘Standard Chartered”).

Details of the information being sought are meant for use in “ongoing foreign criminal investigations and criminal proceedings in the Federal Republic of Nigeria (the “Nigerian Proceedings”),” the filing, dated March 25, reads in part.

“The requested discovery will assist Applicants in the Nigerian Proceedings to investigate and prosecute individuals and entities that participated in, and were enriched by, P&ID’s fraudulent scheme,” it added.

In the testimony of the subpoena filing addressed to Citibank, for instance, the applicant sought the intervention of the bank or any of its officers to testify in the case.

“YOU ARE COMMANDED to appear at the time, date, and place set forth below to testify at a deposition to be taken in this civil action. If you are an organization, you must designate one or more officers, directors, or managing agents, or designate other persons who consent to testify on your behalf about the following matters, or those set forth in an attachment,” it stated.

“You, or your representatives, must also bring with you to the deposition the following documents, electronically stored information, or objects, and must permit inspection, copying, testing, or sampling of the material… ”

Similar requests were made in the case of the other banks involved.

According to the U.S. Federal Rule of Civil Procedure 45 (c), (d), (e), and (g) (Effective 12/1/13), for a Trial, Hearing, or Deposition, a subpoena may command a person to attend a trial, hearing, or deposition only as, first, “within 100 miles of where the person resides, is employed, or regularly transacts business in person; or within the state where the person resides, is employed, or regularly transacts business in person, if the person is a party or a party’s officer; or is commanded to attend a trial and would not incur substantial expense.”

In terms of Command to Produce Materials or Permit Inspection, the rule states that appearance is not required. Details showed that a person commanded to produce documents, electronically stored information, or tangible things, or to permit the inspection of premises, need not appear in person at the place of production or inspection unless also commanded to appear for a deposition, hearing, or trial.

Similarly, a person commanded to produce documents or tangible things or to permit inspection may serve on the party or attorney designated in the subpoena a written objection to inspecting, copying, testing, or sampling any or all of the materials or to inspecting the premises–or to producing electronically stored information in the form or forms requested. The objection must be served before the earlier of the time specified for compliance or 14 days after the subpoena is served, with stipulated rules.

However, according to the rule, the court for the district where compliance is required–and also, after a motion is transferred, the issuing court–may hold in contempt a person who, having been served, fails without adequate excuse to obey the subpoena or an order related to it.

    The Companies

The companies whose bank records are needed include Process & Industrial Developments Limited; Process & Industrial Developments (Nigeria) Limited; Industrial Consultants (International) Limited; Lismore Capital Limited; VR Advisory Services Limited; VR Advisory Services (USA), LLC and VR Capital Group.

Others include Marshpearl Nigeria Limited; Kristholm Limited; Trinitron Nigeria Limited; Albion Marine Company Limited; Marshpearl Nigeria Limited; Holgate Limited; Lurgi Consults Limited; Lurgi Consults West Africa Limited; Rotary Nigeria Limited; Goidel Resources Limited and Kent Marine Limited.

Also listed in the subpoena are Ecophoenix Limited; Lir Resources Limited; Niric Nigeria Limited; Hobson Industries Limited; MICAD Project City Services Limited; Babcock Electrical Projects Limited; NWMAS Nigeria Limited; Sabiex International Limited; Robey Oil & Gas Limited; Capinero Structures Limited; Pan African Drilling Company Limited; Panceltica Nigeria Limited; Marqott Nigeria Limited; Jamisaq Development Services Limited; Dbrite Imaging Nigeria Limited; Hexing Technical Services Limited; Pinimi Limited; Primetake Limited; Armcon Limited; Defthec Limited; Marshpearl Limited and SES FTF Progress Limited; ICIL Limited; Trinity Biotech; Kore Holdings Limited; Onmipol S.A. and Eastwise Trading Limited.

    Individuals

Among the politically-exposed persons named in the subpoena are a former oil minister who is now late, Rilwanu Lukman; President Goodluck Jonathan and his wife, Patience Faka Jonathan; Diezani Alison-Madueke, a former petroleum minister during the tenure of Mr Jonathan; and Allison Amaechina Madueke.

Others named in the subpoena are Taofiq Tijani; Grace Taiga; Mohammad Kuchazi; one Michael Quinn, who died in 2014; James Nolan; Adam Quinn; and Ibrahim Dikko.

Also listed is former attorney general and minister of justice, Mohammed Bello Adoke. The request includes “all documents concerning any transactions to, from, or for the benefit of” the aforementioned individuals and companies.

Bloomberg quoted a spokesman for P&ID as denying wrongdoing, arguing that Mr Malami has “manufactured a claim of fraud and bribery” to evade the state’s legal obligation to pay what amounts to about 30% of the country’s foreign reserves. Citigroup and Deutsche Bank declined to comment on the case, while JPMorgan and UBA didn’t respond to emails and calls.

In his reaction on Tuesday, Mr Jonathan said that he has no account or property abroad.

“Our attention has been drawn to international media reports to the effect that the Federal Government of Nigeria has subpoenaed bank records for former President Goodluck Jonathan and his wife, Dame Patience Jonathan in the United States of America,” a statement, signed by Ikechukwu Eze, spokesman to Mr Jonathan, said.

“We aver that the Federal Government of Nigeria did not contact Dr. Jonathan or his wife before issuing these subpoenas. If they had, we would have advised them of the fact that you cannot subpoena what does not exist.

“We also remind the public that on March 5, 2014, during the swearing in of new ministers, then President Jonathan said “I am loyal to Nigeria’s economy. I don’t have accounts or property abroad.”

Mr Jonathan’s spokesperson said Tuesday that the efforts to check the former president’s accounts were needless because Mr Jonathan had no such accounts in the United States.

“He has no accounts in the United States of America, and encourages US authorities to cooperate fully with the Federal Government of Nigeria’s subpoena,” the statement said.

“We would also like to state that during his tenure as President of Nigeria, Dr. Goodluck Jonathan extended every courtesy to former Presidents and Heads of state, because he believed and still believes that promoting, projecting and protecting Nigeria’s sovereignty and image is the paramount duty of her government, because it is not possible to belittle Nigerians without belittling Nigeria.

“Finally, we state that the signing of the P&ID contracts preceded the Jonathan administration, and that that government gave appropriate counsel to the incoming government in the handover notes of 2015, which advice, if carried out, would have prevented the current unfortunate circumstances.”

  • What is behind Nigeria’s unexplained deaths in Kano?

The Nigerian president has expressed deep concern over a high number of unexplained deaths in the northern state of Kano, amid fears they could be caused by Covid-19.

President Muhammadu Buhari said a lockdown would be imposed in Kano for an additional two weeks, and that he was sending a government team to investigate.

Nigeria’s Health Minister Dr Osagie Ehanire says the situation is being “monitored closely”.

But following preliminary investigations the state authorities have dismissed a connection with coronavirus.

Hundreds of people are rumoured to have died in the community but no official death records are kept.

Grave diggers initially raised concerns that they were burying a higher than usual number of bodies.

Ali, a grave digger at the Abattoir Graveyard, told the BBC: “We have never seen this, since the major cholera outbreak that our parents tell us about. That was about 60 years ago.”

This week, the state governor issued a statement saying the “mysterious deaths” were unrelated to coronavirus.

But after ordering a “thorough investigation into the immediate and remote causes of the deaths”, announced that their preliminary findings “indicated that the deaths are not connected to the Covid-19 pandemic”.

The state government said “reports from the state ministry of health has shown that most of the deaths were caused by complications arising from hypertension, diabetes, meningitis and acute malaria”.

“Governor Abdullahi Umar Ganduje is earnestly waiting for the final report from the state ministry of health so as to take the necessary action.”

The commercial and industrial centre of the north, Kano has become the epicentre of coronavirus in northern Nigeria. Its highly dense population is still in lockdown in an effort to contain the spread of the virus.

Don’t tests show the cause of death?

State officials started testing for Covid-19 two weeks ago and one lab has had to close due to contamination. Samples are being sent to the capital, Abuja, which authorities say is causing a delay in announcing how many positive cases have been detected in the state.

Dr Sani Aliyu, who is the national co-ordinator for the presidential task force on Covid-19, says a team of five medical experts were deployed to Kano to facilitate in reopening the testing centre this week after it was fumigated.

Officials also plan to open a second lab, at Bayero University, for testing for Covid-19 from next week.

    How many people have died?

It is unclear how many people have died, as the deaths causing concern are happening in the community. Deaths in many parts of Nigeria are not registered, and so for those who died outside of hospital, no records are kept.

This makes it difficult to understand how many people have died in recent weeks.

Sabitu Shaibu, the deputy head of the state task force on Covid-19, is hoping to release preliminary findings of the investigation by next week but believes that most of the rumoured 640 deaths are from natural causes and says the figure is below the average death rate for Kano.

Hospital records which provide the only death register available are thought to provide lower numbers than the real picture across the state.

Those on the investigating taskforce say they will conduct “verbal autopsies” with family members to help establish why people are dying.

If not coronavirus, what else could be going on?

Private hospitals which provide for a significant part of health provision in the region have been closed due to coronavirus fears. This could mean a lack of support for those with existing conditions who may have died as a result.

Dr Nagoma Sadiq who works at the Aminu Kano Hospital, thinks this could be behind the additional deaths, but he is also not ruling out coronavirus.

“It’s shocking to most of us that the count of the dead is alarming. But it’s likely due to the reduction in the number of health institutions available in the state.

“Because there are a lot of hypertensive patients, diabetic patients, asthmatic patients, cancer patients, and they don’t have much access to the hospitals. The lockdown is affecting everybody.

“Our poor majority don’t even have a vehicle to take them to the hospitals.”

    People at grave
    More funerals are happening

Grave digger Ali agrees, adding “some say the current situation is due to the epidemic, others say it’s difficulties of life. People have so many problems in their lives and a lack of peace of mind.”

However Covid-19 is known to be more dangerous for those with underlying health conditions, so it could be that the deaths are related to coronavirus. The only way to know for sure is to test for coronavirus.

Dr Sadiq also said that there was still a concern about an ongoing Lassa fever infection amongst communities. The state has had five confirmed cases and one death, according to the most recent report from the Nigerian Centre For Disease Control.

Kano currently has 77 positive cases of coronavirus with three deaths.

Authorities are urging the public not to panic.

What else did the president announce?

President Buhari announced a gradual easing of lockdown restrictions in Abuja, Lagos and neighbouring Ogun state from next Monday.

But he also said that the government would impose a curfew across the country between 20:00 and 06:00, require everyone to wear face masks in public, and stop “non-essential inter-state passenger travel”.

Bans on social and religious gatherings will also remain in place.

  • Nigeria coronavirus: Cases reach 782, Buhari wants prisons decongested

117 new cases of COVID-19 have been reported by close of day April 21 according to NCDC tallies. Of the figure, 59 in Lagos, 29 in FCT and 14 in Kano.

6 in Borno, 4 in Katsina, 3 in Ogun and one each in Rivers and Bauchi States. “As at 11:25 pm 21st April there are 782 confirmed cases of #COVID19 reported in Nigeria,” NCDC said in a tweet. Discharged tally stood at 197 with 25 deaths.

President Buhari has meanwhile written to the chief justice asking that certain categories of cases be expedited to allow for decongestion of prisons in the light of the danger congestion presents amid the COVID-19 pandemic.

The presidency on Tuesday issued a statement that quoted the president as saying: “From available records, the inmates population at various custodial centres across the country presently stands at about 74,127 out of which 52,226 are Awaiting Trial Persons (ATPs).

“Most of these custodial centres are presently housing inmates beyond their capacities and the overcrowded facilities pose a potent threat to the health of the inmates and the public in general in view of the present circumstances, hence the need for urgent steps to bring the situation under control.

“It has become imperative for Your Lordship to request State Chief Judges to embark on immediate visit to all custodial/correctional centres within their respective States to identify and release deserving inmates where that has not been done already.”

He also suggested to the Hon. Chief Justice of Nigeria to “at this stage, consider taking immediate steps as appropriate to ensure the setting up or designation of Special Courts in all States, including the FCT, to try cases of armed robbery, banditry, kidnapping and other serious offences, in order to facilitate speedy trials.”

“There is the need to ensure that the Chief Judges of States and FCT High Courts direct lower courts to comply with requirements of the Administration of Criminal Justice Act/Law in issuing remand warrants in criminal cases especially in cases which are not within their jurisdiction.”
