    Supreme Court to hear Richard Sky, others anti-lgbtq+ bill case on May 8

    Broadcast journalist Richard Dela Sky and researcher Dr. Amanda Odoi are set to present their respective lawsuits against the passage of the LGBTQ+ Bill before the Supreme Court on Wednesday, May 8, 2024.

    These legal challenges have halted the bill’s progress from parliament to potential presidential assent.

    The lawsuits, led by Sky and Odoi, question the constitutionality of Parliament’s approval of the LGBTQ+ Bill, which aims to restrict LGBTQ+ activities and advocacy.

    President Nana Addo Dankwah Akufo-Addo has refrained from receiving the bill, citing the ongoing legal disputes.

    Sky’s case specifically targets the “Human Sexual Rights and Family Values Bill,” seeking a declaration of its nullity on constitutional grounds.

    His claims cite multiple constitutional articles, arguing that the bill infringes upon fundamental human rights guaranteed by Ghana’s Constitution.

    Among Sky’s requests are an order to declare Parliament’s actions unconstitutional and an injunction against enforcing certain provisions of the bill.

    The Supreme Court is scheduled to hear these cases from May 7 to May 9, 2024, as outlined in its cause list.

    President Akufo-Addo has pledged to await the Supreme Court’s ruling before making any decisions regarding the contentious LGBTQ+ legislation.

    Reliefs sought

    Mr. Sky in his writ is seeking four declarations and four orders as follows;

    i. A declaration that upon a true and proper interpretation of Article 33(5) of the Constitution of 1992, in light of Article 12(1)(2), 15(1), 17(1) of the ‘Human Sexual Rights and Family Values Bill, 2024’ by Parliament on 28th February 2024, Contravened the Constitution and is to that extend null, void and of no effect.

    ii. A declaration that the Speaker of Parliament contravened Article 108(a) (11) of the Constitution, in light of Articles 296(a)(b)(c), by admitting and allowing Parliament to proceed upon and pass The Human Sexual Rights and Family Values Bill, 2024 into law as the same imposes a charge upon the Consolidated Fund or other public funds of Ghana.

    iii. A declaration that Parliament exceeded its authority under Articles 106(2) and 108(a)(ii) in passing “The Human Sexual Rights and Family Values Bill 2024, as the same imposes a charge upon the Consolidated Fund or other Public funds of Ghana.

    iv. A declaration that, upon the true and proper interpretation of Articles 102 and 104(1) of the Constitution, Parliament lacked the requisite quorum to pass “The Human Sexual Rights and Family Values BilI, 2024.”

    v. An order restraining the Speaker of Parliament and the Clerk to Parliament from presenting The Human and Sexual Values Bill, 2024 to the President of the Republic for his assent.

    vi. An order restraining the President of the Republic from assenting to The Human and Sexual Values Bill, 2024, as such action will directly contravene the Constitutional safeguards of liberties and rights of Ghanaians.

    vii. An injunction barring any attempts to enforce the provisions of The Human Sexual Rights and Family Values Bil 2024, particularly those criminalizing same-sex relationships and related advocacy efforts.

    vii. Such further orders or directions as to this Honourable Court may seem to meet.

    “You’ve had male friends in the industry, but it seems some bonds aren’t as strong as before, like with Funny Face.”

    When asked about his relationship with Funny Face, Kalybos mentioned that it’s not as strong as it used to be, but they are not enemies.

    He emphasized that certain situations can change dynamics and that not everyone who comes into one’s life is meant to stay.

    Addressing past accusations from Funny Face about pursuing a woman connected to him, Kalybos expressed confusion and stated that he wouldn’t involve himself with someone associated with Funny Face.

    He mentioned that even his fiancée finds the accusations baseless and jokes about them.

    Afenyo-Markin’s defense of GRA-SML deal is concerning – Ohene Ntow

    Former General Secretary of the New Patriotic Party (NPP) and now serving as Senior Advisor to independent presidential candidate Alan Kwadwo Kyerematen, Nana Ohene Ntow has voiced strong disapproval regarding the NPP’s support for the contentious revenue assurance contract between the Ghana Revenue Authority (GRA) and Strategic Mobilisation Limited (SML).

    In a recent statement, Ohene Ntow expressed concern over individuals such as Majority Leader Alexander Afenyo-Markin defending the GRA-SML deal, highlighting that the contract did not meet the necessary conditions for sole sourcing.

    He particularly criticized the selection of SML, labeling it a “nascent company.”

    Afenyo-Markin responded to calls for the full disclosure of KPMG’s report on the GRA-SML deal during a press conference in Accra on May 3.

    He asserted that it is not within anyone’s right to demand copies of the report, clarifying that the report serves as advisory to the President and not subject to public release.

    In a separate discussion on TV3’s The Key Points program, Ohene Ntow compared the GRA-SML deal to the ECG and PDS contract, expressing concerns over similarities in their structures.

    He pointed out what he considered to be established illegalities in the contract and criticized government officials, including Afenyo-Markin, for supporting it.

    “This issue becomes of big concern, especially with PDS in mind…PDS was not going to generate electricity, PDS was not going to provide any transmission facilities, just revenue collection. And the arrangement under which PDS contract was done is quite similar to this one [GRA-SML deal]. And those are the things that will raise concerns of nationally-minded citizens.”

    “All the illegalities have been established beyond doubt, that this is a contract that you couldn’t have said should go for sole-sourcing. And all the explanations and the conditions under which sole-sourcing can be done…none of these were met and yet you go for sole-sourcing.

    “This company is a nascent company, a company that was just born without any experience, no parliamentary and people in government, including the Majority Leader, Afenyo-Markin, are defending this matter. I mean, it’s very worrying,” he noted.

    The controversy surrounding the GRA-SML contract continues to draw attention, with stakeholders expressing divergent opinions on its legality and transparency.

    “But I’ve learned my lesson that next time I do a show in the UK, I will opt for a bigger venue because I didn’t expect the massive crowd that came. There were people stuck outside because the inside was already filled up,” he said.
    Medikal also addressed the delayed start and rapid-fire performances at the concert, attributing the timing issues to fans arriving later than anticipated.

    When quizzed about the next possible venue for a future UK show, Medikal hinted at the possibility of booking the 20,000-capacity O2 Arena to ensure ample space for fans.

    “The O2 Arena, because we want a very big space so a lot of people can attend and see the performances,” he revealed.

    He revealed that the event had to adhere strictly to schedule due to contractual agreements with the venue management, avoiding hefty penalties for exceeding the agreed-upon time limit.

    “They couldn’t come on time, that was the main problem, and I don’t blame them because many of them had to go to work, and by the time they closed and got ready to get to the venue, it wasn’t favourable,” he said.

    “We were supposed to end the show at 11 pm on the dot due to the agreement I had with the facility managers. If it had gone past 11 pm, I would have had to pay over £300,000 in penalties, and I couldn’t afford that,” he explained.

    “And they even asked me about ‘Wo Fie.’ I looked at the teachers and the other authorities, and everybody was quiet and calm, and then they (the children) started asking me what inspired the song.

    “So then I told them about how an office that was set up for the safety and counseling of queer people was raided by authorities, claiming it to be a brothel and giving out wrong information about it.

    “And then I linked it to the bill and told them how the bill is stupid, and we have more important issues to be focusing on, like lack of hospital beds, bad roads, lack of potable water, all these kinds of things. And then that was it.”

    Sister Derby also addressed allegations that she had advised a male student to pursue a same-sex relationship with another male student, labeling such claims as lies.

    “One boy asked me, ‘If he’s straight and a gay person says he’s fine, what should he do?’ I’m like, ‘Just take it as a compliment.’

    Sister Derby concluded by refuting allegations and highlighting the lack of evidence supporting the accusations against her.

    In his account during an interview on Neat FM, Ndego clarified his role as a developer who had sold the land to the late military officer at the start of January 2024 through intermediaries.

    “Then I noticed people working on the land. When I challenged them, they didn’t budge, so I called a soldier to witness the situation. The guard called others who then attacked me,” he said in an interview on Neat FM.

    “From what I was told, the military officers arrived without causing any trouble, but Ben Lord ran over Corporal Danso’s vehicle and shot him seven times, resulting in his death.

    “Ben Lord is known for his aggression. He recently brandished a firearm at soldiers on another property. He also threatened my life many times,” he said.

    Ndego expressed shock at discovering workers on the land despite the ban, leading to a confrontation that escalated when he called a soldier as a witness.

    This action, however, resulted in an attack on him by others present.

    While Ndego clarified that he wasn’t present during the officer’s murder, he learned about it through an eyewitness.

    He attributed the tragic incident to a person named Ben Lord, describing him as aggressive and citing previous instances of violence, including threats against his own life.

    The Ghana Police Service is actively pursuing the perpetrators of this crime to ensure justice is served.

    Community Tensions

    The incident has sparked tensions between the two communities, with Achiase residents accusing the chief of attempting to sell their land to the Adankrangya Manhene, Nana Oppong Frenyam, who claims ownership of Daa.

    The community has threatened to destool the chief, citing his alleged intentions to cause chaos between the communities.

    Call for Resolution

    Residents are urging the Asantehene, Otumfuo Osei Tutu II, to intervene and resolve the chieftaincy issue at Daa to prevent further conflict.

    They emphasize that the two communities have historically coexisted peacefully and do not want any chaos or division.

    Speaking to OTEC news, a resident said the town Daa, of which the Adankrangya Manhene is claiming ownership, is under the biggest oath of the Otumfuo Osei Tutu II, the King of the Ashanti Kingdom.

    Yet, Nana Oppong Frenyam, through his Gyaasehene who resides at Daa, has undermined the oath and has been allegedly selling plots to a number of people over the last six years.

    The witness said the two communities have always been at peace with each other and do not want any sort of chaos between the communities.

    They pleaded with the Asantehene, Otumfuo Osei Tutu II to resolve the chieftaincy issue at Daa to bring peace, adding tha.

    They added that, the Adankrangya Manhene will not help resolve issues among the two communities but rather do things that will result in chaos.

    Three individuals were apprehended red-handed for distributing 150mg and 250mg tramadol to dealers while posing as nurses.

    Their identities remain undisclosed, but they admitted guilt in their unlawful activities.

    One of the perpetrators falsely claimed affiliation with the Walewale Government Hospital as a nurse, while another posed as a nurse from the Kumbungu Health Centre.

    Both confessed to knowingly violating the law.

    A public notice from the Food and Drugs Authority (FDA) emphasized that offering Tramadol or Tramadol-containing products above registered dosages is strictly prohibited.

    Such medications are designated as “Prescription Only Medicines” and should not be dispensed below the level of District Hospitals.

    The FDA cited Executive Instrument E. I168, enacted under the Minister for Health’s powers per the Public Health Act, 2012 (Act 851), to regulate Tramadol and Tramadol-containing products.

    Likewise, Codeine-containing cough syrups are banned, with their registration and market authorizations revoked under Executive Instrument E. I. 167, also enacted under the Minister for Health’s authority as per the same act.

    All approved forms and strengths of these drugs are now classified as “Controlled Drugs” and “Prescription Only Medicines,” requiring a valid prescription for dispensation.

    Sources report that Adjei cleared out his accounts prior to the appointment of the current Special Prosecutor, Kissi Agyebeng, who took office after the funds were frozen.

    The scandal, known as the “Contracts for Sale” saga, led to Adjei’s dismissal following revelations of substantial unexplained deposits into his accounts during his tenure, totaling over GHc41 million cedis.

    An investigative documentary titled “Contracts for Sale,” produced by Manasseh Azure Awuni, prompted President Akufo-Addo to suspend Adjei in August 2019.

    The documentary exposed how Adjei’s company, Talent Discovery Limited, secured government contracts through questionable means and subsequently sold them without authorization.

    Adjei faced further scrutiny from the Commission on Human Rights and Administrative Justice (CHRAJ), which found him guilty of conflict of interest and other offenses.

    CHRAJ imposed a 10-year ban on him from holding public office, a decision upheld by the high court after Adjei’s appeal.

    The Special Prosecutor at the time, Martin ABK Amidu, also commended CHRAJ’s findings but noted discrepancies in the reported amounts in Adjei’s bank statements compared to actual deposits.

    The latest development indicates that Adjei managed to access his frozen accounts by securing a court order to lift the freeze, subsequently withdrawing all funds.

    The case raises questions about oversight from agencies like the Financial Intelligence Centre (FIC), which could have intervened to prevent such withdrawals or flagged suspicious transactions during Adjei’s tenure.

    With ongoing investigations into corruption-related cases, including the “Contracts for Sale” scandal, the spotlight remains on whether Adjei will face prosecution for his role in the contract sales or the unexplained wealth amassed during his time at the PPA, or both.

    “Let me note that, to protect depositors, while ensuring the stability and soundness of the banking system, the Bank of Ghana will continue to be vigilant to ensure that banks comply with regulatory requirements and guidelines to build trust and confidence in our financial institutions,” he said at an event for Name change Galla Dinner for FBN Bank, in Accra on Thursday May 2.

    Kpebu’s comments come in response to the Office of the Attorney-General advising the Economic and Organised Crime Office (EOCO) against pursuing money laundering investigations regarding former Sanitation Minister Cecilia Dapaah‘s transactions.

    The Attorney-General’s office, in a letter dated April 25, 2024, highlighted that the Office of the Special Prosecutor (OSP) had not submitted a collaborative investigation report to EOCO.

    Moreover, the OSP had not responded to requests for findings, presenting only limited documentation to EOCO.

    Disputing the Attorney General’s advisory, Kpebu stated on TV3’s Key Points show, “The advisory is totally wrong … hogwash. It is clearly a mistake and must be withdrawn. Failure to disclose the money itself can be used as money laundering; they can use it as a basis to charge for money laundering.”

    The Ghana Education Service (GES) has voiced alarm at the growing prevalence of tattooing, multiple piercings, and skin bleaching among students, describing it as a “worrying trend.”

    In addition, the GES has expressed serious concerns about teenage pregnancies and cohabitation, citing their negative impact on students’ academic endeavors, particularly young girls.

    During visits to various districts in the Central Region as part of the ‘Life Skills Programme,’ Priscilla Christabel Eshun, the Central Regional Girls Education Officer of the GES, noted with surprise that some students had noticeable tattoos with unconventional names and meanings.

    These observations were presented during the Second Quarter Sub-Implementing Partners (IPs) Review Meeting on sexual and gender-based violence, facilitated by the Regional Coordinating Council with support from the United Nations Population Fund (UNFPA).

    Eshun highlighted instances where students had excessively bleached their skin, leading to peeling and unpleasant odors.

    “In one of the schools we visited, a young girl had bleached her skin to the point where it was peeling off and emitting an unpleasant smell. We also observed students with multiple piercings in their ears.

    “This has become a fashion trend, and many girls are engaging in it without considering the potential health, employment, and other socio-economic consequences.”

    She also mentioned the prevalence of multiple ear piercings among students, attributing these trends to fashion without considering the potential health and socio-economic consequences.

    Furthermore, Eshun disclosed that many boys had dropped out of school and were operating tricycles, with investigations revealing that girls were associating with these boys for financial support.

    “Regrettably, many girls are enticed into such relationships for financial gain, using the money to purchase sanitary pads and other personal items,” Eshun revealed.

    Expressing regret over these developments, Eshun emphasized that the GES prohibits tattooing, multiple piercings, and skin bleaching according to its Code of Conduct for pre-tertiary school students.

    “Students shall not wear chains, bangles, caps, or braces. Wearing of spectacles shall require a medical prescription.

    “No alterations to school uniforms or dress shall be allowed. Possession or use of un-prescribed attire by a student is an offence,” Eshun explained.

    She reiterated the importance of students dressing neatly, adhering to prescribed dress codes, avoiding accessories like chains and bracelets, and maintaining a decent haircut as defined by school authorities.

    “Students should have a decent haircut as prescribed by the school authorities. Hair should be clean, neat, and modest, and avoid extremes in styles and colour. Men’s hair should be neatly struck and beard clean-shaven.”

    33-year-old former United States Army officer of Ghanaian descent, Sanda G. Frimpong has been given a 40-month federal prison term for laundering money from an extensive series of romance scams.

    Frimpong was convicted on three counts of money laundering on September 14, 2023, and has been directed to compensate victims with hundreds of thousands of dollars.

    The United States Attorney’s Office for the Eastern District of North Carolina, in a report dated April 18, 2024, detailed Frimpong’s involvement in the sophisticated scams.

    These scams involved assuming false identities such as romantic partners, diplomats, customs officials, and military personnel to gain victims’ trust.

    The scams often promised romantic relationships, inheritances, or other wealth to deceive victims into providing money or property.

    The report revealed that Frimpong laundered hundreds of thousands of dollars through his bank accounts across state lines and contacts in Ghana, where he was stationed as an active-duty Army member at Fort Bragg until shortly after his arrest in 2023.

    Sanda G. Frimpong, 33, was sentenced to 40 months in federal prison and ordered to pay hundreds of thousands of dollars in restitution to victims for laundering the illicit proceeds of an elaborate series of romance scams. Frimpong pled guilty to three counts of money laundering on September 14, 2023.

    “Romance scammers exploit our most vulnerable citizens, even our seniors and military veterans, sometimes leaving them financially and emotionally devastated,” said U.S. Attorney Michael Easley. “The fact that an Army servicemember was involved in romance scams while serving as a soldier is appalling. We are partnering with the Department of Defense to drum out fraudsters and money launderers like Frimpong from our military ranks and put them in prison where they belong.”

    “Integrity is a core tenet of the armed forces and when servicemembers choose to compromise their integrity for greed, it tarnishes the reputation of all others serving in uniform,” stated Special Agent in Charge Christopher Dillard, Department of Defense Office of Inspector General, Defense Criminal Investigative Service (DCIS), Mid-Atlantic Field Office. “DCIS and its law enforcement partners will continue to work with the U.S. Attorney’s Office to hold those accountable who cheat government programs and use online scams to prey on the most vulnerable.”

    Frimpong and other conspirators, engaged in elaborate scams, impersonating romantic love interests, diplomats, customs personnel, military personnel, and other fictitious personas for the purpose of ensnaring their victims by earning their confidence, including promises of romance, sharing of an inheritance or other riches, or other scenarios intended to fraudulently induce the victims to provide money or property to the conspirators. Frimpong then laundered hundreds of thousands of dollars in proceeds of these frauds through his various bank accounts across state lines and through his contacts in Ghana. Frimpong was also an active-duty Army servicemember stationed at Fort Bragg during the commission of the offenses up until shortly after his arrest in 2023.

    Michael Easley, U.S. Attorney for the Eastern District of North Carolina made the announcement after U.S. District Judge James C. Dever III announced the sentence. Defense Criminal Investigative Service led the investigation, and Assistant U.S. Attorney David G. Beraka prosecuted the case.
