  • SEC moves to protect investors with new directive

In an effort to further protect investors, the Securities and Exchange Commission has issued a new directive to all Capital Market Operators open, maintain and operate Trust Accounts for and on behalf of its clients, effective Thursday, July 16, 2020.

According to the Regulator, the Trust Fund shall hold all monies received from clients or on behalf of clients by Capital Market Operators shall be deposited for the purposes of investment.

A Trust Account as determined by SEC, shall not contain any other money except those deposited by clients or on behalf of clients of Capital Market Operators for investment purposes.

The Accounts shall be immune to bankruptcy and liquidation proceedings or processes of Court, thus, where a licencee becomes bankrupt or falls into liquidation or incurs a debt, a Trust Account operated by the Capital Market operator shall not be subject to bankruptcy or liquidation proceedings or be used as a payment for the debt.

The Regulator further indicates that monies held in a Trust Account are not available for payment of the debts of Capital Market Operator or liable to be paid or taken in execution under an order or process of a court.

In this regard, a Trust Account shall be separated from other Accounts maintained by the Capital Market Operator for operational or proprietary purposes.

To ensure that Capital Market Operators adhere to the directive, SEC has also directed that all Custodians and Trustees with which Trust Accounts are opened, maintained and operated shall ensure that receipts, payments and disbursements into and from a Trust Account are only in respect of clients investments and the beneficiary on behalf of whom the receipt, payment and disbursement is made is clearly identified by name and Identity card so that the entries on the Trust Account can be reconstructed such that a statement containing all debits and credits on the Account can be attributed to individual beneficiaries.

The Commission further stated that where it appears to a Custodian or Trustee that a Trust Account is not being used for the purposes above, the Custodian or Trustee shall notify the Regulator immediately before the transaction in question passes or is effected by the Custodian or Trustee.

Any Capital Market Operator that breaches the directive will be subject to sanctions under section 209, 159(7), (8), 160(1)(d), 160(2), 160(7)(8), and/or any other relevant provision applicable under the Securities Industry Act 2016 (Act 929), which includes revocation of license.

The minister and his group were seen wearing T-shirts with a bold inscription: “I have been attacked to COVID-19; I have survived it and fully recovered”. So far, the educative pictures have gone viral on social media.

Accompanying the pictures, Napo also posted a powerful message about the need for society to welcome COVID-19 survivors, noting that those infected by the virus endured difficult times so society should not cause them further emotional stress.

“Those who survive it (COVID-19) have a story to tell, and it is not a pretty one. We must not make it worse for them by stigmatizing and then ostracizing them,” Napo wrote on his social media platforms.

“As a society, we must do more to avoid stigmatizing those who contract and recover from the dreadful virus,” he added, indicating that the disease would surely be defeated with a united and collective effort.

Meanwhile, scores of social media users have showered tons of praises on Napo for his decision to share his personal experience with the society to help stop the spread of the virus and also stigmatizing COVID-19 survivors.

  • Kwaku Manu reveals why he can become president of Ghana

It is ambition that drives people to accomplish great things. Without it, nothing great would ever get done.

People with success stories believe that whatever personal goals one may have on his mind, he will work night and day to achieve them.

However, one goal is not good enough. Some goals take longer to achieve than others, and if you spend years working toward only one objective, you are likely to get discouraged when it does no happen right away.

It is based on this assumption that popular Ghanaian actor, John Tweneboa, known in the movie industry as Kwaku Manu, says he can be president of this country.

Appearing on Showbiz360, a popular Friday night entertainment show aired on TV3 and hosted by Geovani Kaleb, the Kumawood actor said he could rise through the ranks to become a president since he bears the name ‘John’.

“My real name is John Tweneboa. That was how I was called back in the school days …and you know many of our past leaders bear the name John, so I can be president in this country”, he sarcastically professed.

Sharing a story of how he ended up in the Creative Arts Industry, Bob Siga, as he is affectionately called, disclosed that he was dropped out of school at JHS 2 and since he was not good in academics, he decided to follow his passion (the acting).

“I wasn’t good in school in terms of academics but I was well trained at home to be a brainy child. One day I told my father that I could no longer stand the corporal punishment in class so I quitted”, he revealed.

Aside the acting, Kwaku Manu is also a media personality and currently serving as the General Manager of Ejisu-based Aben FM, a subsidiary of Joy Industries Ltd.

  • John Lewis: Civil rights icon and congressman dies aged 80

Rep John Lewis, a leader in the civil rights movement and later US congressman, has died at the age of 80.

Lewis was one of the “Big Six” civil rights leaders, which included Martin Luther King Jr, and helped organise the historic 1963 March on Washington.

As a congressman he was a Georgia Democrat, and represented an area which covered most of its capital Atlanta.

In December 2019 Lewis announced that he had been diagnosed with Stage 4 pancreatic cancer.

“I have been in some kind of fight – for freedom, equality, basic human rights – for nearly my entire life,” he said in a statement released at the time. “I have never faced a fight quite like the one I have now.”

During the civil rights movement, Lewis was one of the founders of the Student Nonviolent Coordinating Committee (SNCC), and then became its chairman from 1963 to 1966.

He co-organised and spoke at the March on Washington for Jobs and Freedom, the rally at which Dr King delivered his historic I Have a Dream speech.

Lewis was the last surviving speaker from the march.

Image captionJohn Lewis addressing the crowd at the historic March on Washington in 1963

Democratic Speaker of the House Nancy Pelosi confirmed Lewis’s death in a statement posted on her website and on social media.

She wrote that Lewis “was a titan of the civil rights movement whose goodness, faith and bravery transformed our nation”, and that as a congressman he was “revered and beloved on both sides of the aisle and both sides of the Capitol”.

“Every day of John Lewis’s life was dedicated to bringing freedom and justice to all,” she said. “As he declared 57 years ago during the March on Washington, standing in the shadow of the Lincoln Memorial: ‘Our minds, souls, and hearts cannot rest until freedom and justice exist for all the people.’

“How fitting it is that even in the last weeks of his battle with cancer, John summoned the strength to visit the peaceful protests where the newest generation of Americans had poured into the streets to take up the unfinished work of racial justice.”

Upon news of his death, civil rights group the NAACP tweeted that they were “deeply saddened”.

“His life-long mission for justice, equality and freedom left a permanent impression on our nation and world,” the organisation said. “The NAACP extends our sincerest condolences to his family, and we send prayers of comfort and strength to all.”

In a statement, former President Barack Obama said he had spoken with Lewis after a virtual town hall with a group of activists following the death of George Floyd. Obama said Lewis could not have been prouder of their efforts – “a new generation standing up for freedom and equality”.

“Not many of us get to live to see our own legacy play out in such a meaningful, remarkable way. John Lewis did,” he said.

“And thanks to him, we now all have our marching orders — to keep believing in the possibility of remaking this country we love until it lives up to its full promise.”

Former presidential candidate Elizabeth Warren tweeted that Lewis “was a true American hero and the moral compass of our nation”.

Lewis’s death comes on the same day as the death of fellow civil rights leader C T Vivian at the age of 95. Vivian helped organise the Freedom Rides – a protest to integrate buses in the south – and later went on to lead the Southern Christian Leadership Conference (SCLC).

  • We had sleepless nights Parent on Accra Girls SHS Covid-19 cases

Father of a second-year Gold track student at the Accra Girls Senior High School says news about the school recording some cases of Covid-19 left him and his wife with sleepless nights.

Salifu Dabre said he and his wife could not help but worry about their daughter when they were informed about the matter.

“Before she left for school, I advised her to observe all the protocols, after all, they were going to spend only six weeks in school but when news broke that Accra Girls had recorded six cases, in fact, I got scared.

“If I tell you what happened between myself and her mum; my wife and I could not sleep. The whole day her mum had to keep me up, insisting I go and find out the status of my daughter in the school,” he said on Ghana Connect, Friday.

Mr Dabre is among parents who rushed to the Accra Girls Senior High School to pick up their wards after news broke that some students have tested positive for the coronavirus.

At least eight cases had been recorded at that time.

He had gone to pick up his daughter but was denied access by school authorities, a situation he said compelled him to picket with other parents at the entrance of the school.

He further indicated that the agitations of parents got worse when school authorities refused to communicate with them about what was happening in the school.

“We are parents and for that matter, we are major stakeholders as far as the running of the school is concerned but school authorities did not inform us. We picked a feed from the media that the school has recorded 6 positive cases and then we try to find out from the school and yet nobody wanted to tell us anything.

“We tried to find out from our reps in the school that is the PTA but they were also not prepared to speak. Sometimes we relied on teachers for information on matters concerning our wards but they also were not willing to speak on that,” he added.

He also stated that parents still rely on speculations [as their source of information] because school authorities would still not open up on the matter.

“School authorities are not prepared to update us, they are not prepared to talk, so we know the situation there. We have a common Whatsapp platform for parents which we hoped the authorities would reach us on, at least for the assurance of our wards safety but that did not happen as well,” he said.

Meanwhile Accra Girls Senior High School continues to be the leading SHS with the highest confirmed cases of Covid-19.

As of 13th July, 2020, it had recorded a total of 55 cases involving both students and teachers.
