    We don’t harass businesses for taxes – GRA dismisses claims

    The Assistant Commissioner of the Ghana Revenue Authority (GRA), Emelia Assam, has refuted claims made by Dr. Mahamudu Bawumia, the flagbearer of the New Patriotic Party, regarding alleged harassment of businesses for taxes.

    During a meeting with the Ghana National Chamber of Commerce and Industry, Dr. Bawumia accused the GRA of pressuring businesses under the guise of tax collection, citing unrealistic targets set for GRA officers.

    However, speaking at the Oxfam Tax Dialogue on Citi TV, Emelia Assam clarified that the GRA does not engage in harassing businesses for taxes.

    She emphasised that GRA staff are not authorised to harass clients and only deal with compliance issues when necessary.

    Assam explained, “There is no harassment with tax collection… GRA staff don’t go out to harass.”

    She further outlined the GRA’s procedures for dealing with non-compliance, such as sending notifications for registration and issuing invoices for VAT payments, but reiterated that this does not constitute harassment.

    “No tax officer who has been authorised to go out is expected to harass any client. In the sense that we have some compliance issues that we deal with everyday. One is every tax payer must register, failure to register, we can send you a notification to appear.

    “We can lock up your place if you fail to respond to these notifications. We have duties to issue invoices for people who are registered to pay VAT.”

    The Ghana Statistical Services (GSS) has unveiled the remarkable growth of Ghana‘s economy in 2023, reaching GH¢841.63 billion, a substantial leap from GH¢614.33 billion in 2022.

    This surge includes net indirect taxes totaling GH¢58.74 billion, indicating a robust economic performance.

    The services sector emerged as the primary driver, contributing GH¢357.34 billion, which accounts for 45.6% of the GDP.

    Following closely is the industry sector with GH¢247.941 billion (31.7% GDP contribution), and agriculture at GH¢177.606 billion (22.7% GDP contribution).

    Key sub-sectors fueling this growth include Crops (19.4%), Trade & Household Goods Repair (18.3%), Mining and Quarrying (12.9%), Manufacturing (12.1%), and Transport & Storage (6.0%).

    The last quarter of 2023 marked the highest real GDP growth rate at 3.8%, with the industry sector notably shifting from contraction to a 1.6% expansion.

    Despite these gains, Gross National Income per capita, while doubling since 2018 in local currency (from GH9,813 to GH25,349), has stagnated in US dollars, ranging between $2,453 and $2,126 over the past six years.

    The overall GDP growth for 2023 stood at 2.9%, surpassing the Finance Ministry’s revised estimate of 1.5%, albeit slightly below the 3.1% recorded in 2022, showcasing Ghana’s resilience and economic dynamism amidst global challenges.

    “So God has given all of us a divine gift and mine is doing gospel music but someone’s gift is being a teacher or a Doctor and that’s what God gave them. The same way the doctor needs money to educate themselves, we gospel artists also need money to go to the studio to record our songs and other online courses that we do.

    “It involves a lot of resources and so if the doctor graduates and makes money out of treating people, why should the gospel musician also not be supposed to make money from singing or performing?     AntiLGBTQ+bill: No pending court case can prevent Akufo-Addo from performing his constitutional duties – Dafeamekpor

    Co-sponsor of the Human Sexual Rights and Family Values bill, Rockson-Nelson Dafeamekpor has voiced his disagreement with President Akufo-Addo‘s decision to suspend assenting to the Anti-LGBTQ+ Bill until the court challenges are resolved.

    The Office of the President formally requested Parliament to hold off transmitting the Anti-LGBTQ+ Bill for the President’s assent.

    This request was outlined in a letter dated March 18 and signed by the Secretary to the President, Nana Asante Bediatuo.

    The reasoning behind the request stemmed from ongoing applications for an interlocutory injunction in the Supreme Court.

    Dafeamekpor, the South Dayi MP, argued on JoyFM’s Top Story on March 19 that no pending court case should hinder the President from fulfilling his constitutional duty.

    He cited previous instances where similar challenges did not impede presidential functions, particularly regarding election result disputes.

    “If you read the Supreme Court decision in the dismissal of the Electoral Commissioner Charlotte Osei, no court can injunct a president from performing his functions under the constitution.

    “That is why there is a presumption of regularity of performance of functions of the president until a court otherwise removes him.

    “So for instance, when a president is elected into office, sworn in, and takes the oath of office, and another who contested is aggrieved and goes to the Supreme Court, what the President does until the court pronounces on the validity or otherwise of the election of that President is not declared venality. So you cannot say that because the election of the President is challenged, you can bring an action to injunct the President not to perform the functions imposed upon the office of the President,” he said.

    The MP clarified that an interim injunction should not prevent the President from executing his responsibilities, including assenting to a bill.

    “It can only be, going forward, the decision of the court can only be going forward but it cannot affect any decision that he takes whilst occupying that office. That is why if anybody and in any case let’s this make clear you can only challenge an act of Parliament, a bill is not an act of Parliament properly so called.

    “So it only when a bill is declared unconstitutional that its effect can be challenged,” he added.

    He emphasised that until a court rules otherwise, there is a presumption of regularity in the President’s actions.

    “If the President decides not to sign the bill or assent to the bill but to wait for the court to pronounce on it, I think the President is doing the right thing. So, all we have to do is to wait for the President for him to make the determination of the injunction. I think that is what the President is trying to say,” he said.

    Furthermore, Dafeamekpor noted that the court’s decision would only impact future events, not past actions taken by the President.

    He highlighted the distinction between challenging an act of Parliament versus a bill.

    On the same program, Professor Kwadwo Appiagyei-Atua from the University of Ghana Law School remarked that the situation should not escalate into a constitutional crisis.

    He suggested that President Akufo-Addo’s decision to await the court’s verdict could be seen as a prudent move, particularly after criticisms surrounding the E-levy bill’s assent amid an injunction application.

    Regarding the letter from the Executive Secretary regarding the President’s stance, Appiagyei-Atua expressed reservations about its credibility, noting that it lacks the direct endorsement of the President himself.

    The Electoral Commission (EC) in a recent press conference held in Accra refuted claims made by Minority Leader Dr. Cassiel Ato Forson regarding missing Biometric Verification Devices (BVDs), assuring the public of the integrity of its systems and upcoming elections.

    On Tuesday, March 19, Dr. Cassiel Ato Forson indicated that the EC confirmed to them that the missing seven BVDs cannot be identified.

    The minority leader has since called on the Criminal Investigations Department (CID) of the Ghana Police Service and other security agencies to “immediately issue a statement giving us the details of their investigations so far,” adding, “I am concerned and worried because that devices in the hands of an unknown person can compromise the future elections”.

    In the conference, Deputy Commissioner Dr. Bossman Asare clarified that no BVDs were stolen, contrary to Dr. Forson’s assertion.

    The Commission discovered during routine maintenance that five laptops from the Biometric Voter Registration (BVR) kits were missing, not seven BVDs as reported.

    “For clarification, Biometric Voter Registration Kits, which comprise a laptop, camera, scanner, and printer, are entirely separate from the Commissions Registration Data Systems and are incapable of manipulating election outcomes as suggested. These kits, though crucial for voter registration, require specific activation to function accordingly. Without such activation, they serve no purpose beyond their individual components as a laptop, camera, scanner, or printer. What this means is that they are of no value beyond what they were manufactured to be.,” Dr. Bossman Asare stated.

    Dr. Asare emphasised the distinction between BVR kits and BVDs, highlighting that the stolen laptops were incapable of compromising election systems or outcomes.

    “Similarly, the stolen laptops, cannot be utilized for voter verification or registration. It remains just a laptop. As such, they cannot be used to compromise our systems and

    undermine the credibility of the upcoming elections in December 2024. The integrity of our systems and elections remain intact. Again there seem to be some confusion as to the use of our equipment. It’s imperative to understand that the Commission utilizes two (2) distinct equipment for its operations: the Biometric Voter Registration kits which is used for voter registration and the Biometric Verification Devices to verify voters using their fingerprints or facial features on election day. These devices, in isolation, cannot fulfill the functions of registration or verification without proper activation.”

    He assured that the stolen laptops contained no sensitive data and reiterated the Commission’s commitment to transparency and integrity in its operations.

    “It is important to note that at the completion of every registration exercise, all data captured are erased from the laptops in a process termed ‘End of Life’. As such, we assure

    the public that the stolen laptops contain no sensitive or valuable data. Consequently, the theft bears no impact on the integrity of upcoming elections, nor does it serve any political

    agenda as insinuated. Upon detection of the theft, the Commission promptly notified security agencies involved in the maintenance process, and investigations are actively ongoing to apprehend and prosecute the suspects. The Commission places high value on its assets including the Biometric Voter Registration Kits and Biometric Verification devices hence its continuous reliance on the Police and other security devices to protect all its installations.

    “The Commission urges public figures and citizens alike to exercise due diligence by verifying information before dissemination. This responsibility is paramount to maintaining

    public trust and preventing unwarranted fear or panic. The Electoral Commission remains committed to upholding the highest standards of transparency and integrity in itsoperations and elections.”

    The Commission urged the public to verify information before spreading it, emphasising the importance of maintaining trust and avoiding unnecessary panic.

    Professor Kwadwo Appiagyei-Atua has suggested that President Nana Addo Dankwa Akufo-Addo is treading cautiously regarding the law, awaiting the Supreme Court’s verdict on injunctions filed against him and Parliament.

    The Human Sexual Rights and Family Values Bill 2024, unanimously passed by Parliament on February 28, awaits the President’s assent.

    However, legal hurdles have emerged with two injunction applications lodged in the Supreme Court against the bill.

    Private legal practitioner Richard Sky  seeks to prevent the President from assenting to the bill,  “order restraining the President of the Republic from assenting to ‘The Human and Sexual Values Bill, 2024”.

    According to Sky, such action “will directly contravene the constitutional safeguards of liberties and rights of Ghanaians”.

    Prof. Appiagyei-Atua stressed the need to await the court’s decision before any action is taken.

    “When an application for an injunction is issued against a party to a suit, we have to wait for the court to determine whether the injunction should hold or not before any action can be taken,” adding, “so it is incumbent on the Clerk of Parliament not to take any action until the court has determined the matter.

    “Whether the injunction is thrown away or upheld, if it is thrown away, then what it means is that it paves the way for the Clerk of Parliament to submit the bill to the President and the President will be compelled and obliged by the constitution as well as the rules of court to accept that”.

    The bill, if enacted, imposes severe penalties of three to five years imprisonment for promoting LGBTQ+ activities, and up to three years for public identification with LGBTQ+ identities.

    The legal and societal debates surrounding these issues continue to intensify in Ghana’s legal and political spheres.

    “We are becoming the 21st century slaves, neo colonialism and that is what late president Kwame Nkrumah said. Politicians do not understand even though they are the cause of it, but it is happening.

    “You don’t partner and everything is being taken away from you,” he stated.

    The National Communications Authority (NCA) revealed in a press release that Ghanaians facing disruptions in their data services may need to wait another five weeks due to a faulty undersea cable.

    The NCA’s announcement follows a meeting with subsea cable landing service providers ACE, MainOne, SAT-3, and WACS, held after widespread data service outages impacted several African countries including Ghana, South Africa, Nigeria, Ivory Coast, Liberia, Benin, and Burkina Faso.

    Minister Ursula Owusu-Ekuful affirmed during an interview on Peace FM, “We will be using 5G in September, I can guarantee that.”

    Cynthia Appiadu, speaking on TV3’s New Day on March 20, expressed the profound impact of Kwabena Kwakye’s passing on the group, describing it as a “huge blow.”

    “We have cancelled Kwahu. The reason is we are bereaved, we lost our gem in our family, Kwabena Kwakye. We were planning all this with him but unfortunately something happened so we nearly stopped the programme,” Cynthia Appiadu shared.

    Man narrates how a soldier stopped him from rescuing more victims from GAF helicopter ‘crash’

    A courageous man from Bonsukrom in the Ahanta West Municipality shared his account of being hindered by a soldier while attempting to save more victims of a Ghana Armed Forces (GAF) personnel helicopter crash.

    The unidentified man recounted observing a helicopter from afar as it made an abrupt landing in their community, its front end pointing downward.

    He believed it was due to a brake failure.

    In a bid to minimise damage, an emergency landing was executed, resulting in injuries to those on board.

    The man managed to rescue nine individuals but was halted by a soldier while trying to save others.

    He expressed concern that had the soldier perished, blame might have been wrongly placed on him.

    “I witnessed the helicopter making a sudden stop, indicating a potential crash due to brake failure. Despite managing to save nine victims, I was prevented from aiding the tenth, despite his critical condition,” the man narrated.

    A Ghana Air Force helicopter crash-landed in Bonsokrom, within the Ahanta West Municipality in the Western Region.

    Eyewitnesses reported that the helicopter, which was reportedly carrying 14 individuals, including staff from the Petroleum sector regulators, landed in a bush near the Bonsokrom community.

    Despite the alarming nature of the incident, all personnel and crew onboard the aircraft are safe and have been rescued by Air Force personnel.
    The crash site has been cordoned off from public access by Air Force personnel.

    Details regarding the flight’s origin and destination remain unclear. It is uncertain whether the helicopter was en route from offshore locations to Takoradi or was travelling from Takoradi to Accra at the time of the crash.

    However, an official statement by the Ghana Armed Forces disclosed that on board were 21 passengers made up of staff of Ghana National Gas Company who were returning from a routine inspection of Atuabo gas plant when an emergency landing occurred.

    Emphasizing that she does not condemn the practice and noting its historical presence, she referred to biblical instances.

    However, she cautioned against taking it further by becoming pregnant with someone else’s husband.

    During her appearance on TV3’s New Day on March 18, 2024, she reiterated her stance, advising against the consequences of pregnancy in relationships involving married men.

    “If you are a side chick, don’t get pregnant for somebody’s husband but I am saying do not go for somebody’s husband and get pregnant for them,” Empress Gifty stated.

    During the interview, Guru expressed frustration at not receiving any compensation from the funds his manager received from MTN, highlighting the complexities and challenges faced by artists in the music industry.

    Former President John Dramani Mahama, representing the opposition National Democratic Congress (NDC), has strongly criticized the recent actions of the Presidency regarding the Anti-LGBTQ+ Bill.

    In a Town Hall meeting in Banda as part of his Oti Region tour, Mahama condemned the letter from the Presidency instructing Parliament not to send the Bill to President Akufo-Addo for assent.

    Mahama argued that the Secretary to the President had overstepped legal boundaries by issuing such a directive, asserting that it goes against the constitutional obligation of Parliament to send every Bill to the President.

    He emphasised that the letter’s tone was disrespectful and implied undue authority over Parliament.

    “We all know that our tradition is against LGBTQ. No religion in Ghana accepts it. Christianity does not accept it, Islam does not, even the traditionalists also reject it. It is a taboo in Ghana.

    “Parliament recently passed a Bill to be sent to the President for his approval. But he has refused to sign because he claims the case is in court so he will wait for the pronouncement by the Supreme Court.

    “But this morning I woke up to see a letter from the Secretary to the President to Parliament warning them against transmitting the letter to the Presidency. But everyone who is a lawyer will tell you that the President’s secretary has no authority to write such a letter because Parliament is obligated by the constitution to send every Bill to the President. So you cannot tell Parliament not to do its job,” the former President said.

    This controversy arose after the Office of the President officially requested Parliament to hold off on transmitting the Bill to President Akufo-Addo due to pending legal challenges in the Supreme Court.

    The letter, signed by the Secretary to the President, Nana Asante Bediatuo, cited ongoing applications for an order of interlocutory injunction and advised against taking any action until the court resolves the issues.

    Mahama’s criticism echoes sentiments expressed by Tamale South MP Haruna Iddrisu, who characterised the President’s office’s actions as hindering Parliament’s duties and seeking predominance over other state organs.

    “That is unacceptable and must be fought by all persons who love democracy and cherish the principles and values of the 1992 Constitution. This is a monumental threat to Ghana’s democracy and a monumental threat to Parliament as an institution. By Article 93 we are clothed with legislative authority and mandate.

    “If you study how the letter was written, the tone was disrespectful. He (Secretary to the President) wrote the letter as if he has more authority than Parliament,” he added.

    The clash highlights the ongoing debate and legal battles surrounding the Anti-LGBTQ+ Bill in Ghanaian politics, emphasizing the complex interplay between executive authority, legislative mandates, and legal procedures.

    The Majority Caucus in Parliament has strongly criticized former President John Mahama for his comments on President Akufo-Addo’s Agenda 111 project, labelling his remarks as “disingenuous” and “inconsistent.”

    Mahama had described the project as overly ambitious and unrealistic, particularly questioning the decision to increase the number of hospitals from 80 to 111.

    Mahama, who is the flagbearer of the main opposition National Democratic Congress (NDC), expressed concerns that many of the Agenda 111 projects might remain unfinished by the end of Akufo-Addo’s term.

    He suggested that the government should have focused on completing a smaller number of hospitals first before expanding the project.

    “This government started their Agenda 111 as they call it and they started with 80 hospitals”.

    “I don’t know what survey was done before the hospitals were being put in, but most of them are at a certain stage of completion.

    “One would have thought that they would start with what they can do and finish.”

    “And, so, if you can do 40 hospitals, finish and open them, then you start another. But you spread to 80 hospitals, the time they leave office, I don’t think many of them would have been completed,”Mr Mahama said.

    Dr. Ayew Afriyie, chairman of the Health Committee in Parliament and a member of the Majority Caucus, rebuked Mahama’s comments, highlighting that they indirectly undermine the NDC’s own manifesto promises.

    He argued that expanding healthcare infrastructure, as outlined in Agenda 111, is crucial for achieving universal health coverage and ensuring equitable access to healthcare across all districts.

    Afriyie pointed out that over 50% of the Agenda 111 hospitals have exceeded 60% completion, countering Mahama’s assertions about the project’s feasibility.

    He also mentioned that during the NDC’s tenure, only six hospitals were completed, emphasising the government’s commitment to fulfilling its healthcare objectives.

    The Majority Caucus reiterated its support for Agenda 111, emphasising the importance of providing modern healthcare facilities to every district in Ghana.

    They criticised Mahama for what they perceive as inconsistency and urged political leaders to remain steadfast in fulfilling their manifesto promises.

    “If you said you were going to build 88 hospitals and the NPP says it will do 111 hospitals, what is wrong with that? The former president is being disingenuous, he has been inconsistent and Ghanaians don’t have short memories as he has always said. We are clear on the principle that every district must have a hospital for universal health coverage and to be able to attain it, there must be access for all and there must be equity.

    According to him, “Over 50 per cent of Agenda 111 hospitals have past 60 per cent completion and under the NDC, they were able to complete 6 hospitals.”

    “We will outdoor it before we come into government and when we come into government we will hit the ground running with it. As I said, it is not going to be compulsory. If you want to join, you join,” Mr. Mahama said.

    Private legal practitioner Serwaah Sarfo Mensah has challenged statements made by actor and radio presenter Mickey Osei Berkoe, who claimed that airing foreign movies during prime time is a criminal act.

    Osei Berkoe, speaking on Showbiz A-Z with Kwame Dadzie, called for legal action against media houses showing telenovelas during prime time, citing financial losses to the state.

    He argued that laws should be enacted to address this issue.

    “I see Telenovelas streamed at prime time as criminal and that, media houses should be prosecuted for causing financial loss to the state. It is one of the solutions so policymakers should establish these laws”, Mickey Osei Berkoe said on Joy FM.

    In response, Lawyer Serwaah Sarfo Mensah disagreed with Osei Berkoe’s stance, emphasising that there is no specific law regulating the broadcasting of international content on Ghanaian television.

    During an interview on Daybreak Hitz with Andy Dosty, she clarified, “It is not criminal. No law regulates or governs the showing of international content on our TVs in Ghana.”

    “It is not criminal. No law regulates or governs the showing of international content on our TVs in Ghana. Also, for every crime, there should be an offence to it. No offence has been committed by the media or the TV station by showing international content during prime time.

    “Offenses should either have a negative or a positive impact on an individual. Even with that, not all things that affect people negatively become an offence”, Lawyer Serwaah Sarfo Mensah stated.

    Mensah further elaborated on the positive impact of foreign content, citing personal experiences where such shows aided her legal career.

    She also highlighted the benefits of cultural exchange and economic opportunities that arise from airing foreign programs.

    “We sometimes have to learn; I like to learn about other cultures, I know my culture but I keep on learning every time. I also love to learn about other cultures too. For example, about 2 years ago, I had a case in court, I watched one of these telenovelas which helped influence my case.

    “It did help me with regards to the strategies and plans with that case.”

    She concluded by urging Ghanaians to embrace the diversity and positive influence of international content, emphasizing the importance of competition, marketing, and education in the media landscape.

    “If I go to Mexico right now, I won’t have trouble fitting in because, by watching these telenovelas, I happen to know more about them. It is not only about telenovelas but Nigerians as well, we learn their culture and relate well with them.

    “It doesn’t cause financial loss because it rather brings income to the state. When telenovelas are being aired, people use it as a means to advertise and this generates income to the media houses and the country as a whole”, she stated.

    She admonished Ghanaians to embrace the positive influence this foreign content brings to them in all spheres.

    “We ‘Ghanaians’ are dynamic. We don’t only live here by ourselves. We do with our international brothers and sisters. For the sake of competition, marketing, and education, we ‘media houses’ do not have to only stick to our Ghanaian content to entertain our viewers. Mine is that, we shouldn’t limit or restrict ourselves to just our own.”
